Resolution No. 2011-198 authorizing the City Managerto negotiate and execute Cooperative
Agreementwith San Joaquin Council of Governments for GrapeLine operating services (Fiscal
Year 2011/12 through 2013/14).

D. Comments by the Public on Non -Agenda Items
THE TIME ALLOWED PER NON -AGENDA ITEM FOR COMMENTS MADE BY THE
PUBLIC IS LIMITED TO FIVE MINUTES. The City Council cannot deliberate or take anv
action on a non-aaenda item unless there is factual evidence presentedto the City Council
0ndicatingthat the subiect brought up y the public does fall into one of the exceptions
under Government Code Section 54954.2 in that (a) there is an emergency situation. or
the need to take action on the item arose subsequent to the agenda's beingon sted.
Unless the City Council is presented with this factual evidence. the City Council will refer
the matter for review and placement on a future City Council agenda.
John Slaughterback spoke in regard to his preference to staff the new water treatment plantwith
City employees and his concern about uncollected debt in the City.
Brad Doell, Ron Penix, Paul Blandford, and Sherry Moroz, representing various bargaining
groups within the City, spoke in regard to retaining employee concessions versus making
permanent changes to labor agreements. A letter regarding the same was presented for the
December 21,201 1
City Council Members,
Opening
At the onset of concession bargaining it was clearly communicated to us concessions
would be temporary and as the City's economic health improved, the concessions would
be rolled back incrementally. This promise is what our concessions were predicated on
and was instrumental in getting the bargaining groups to participate. Thus far we have all
been accommodating and cooperative.
To change course from the aforementioned promise to make what has been termed
"Fundamental" changes is viewed as bargaining in bad faith. As a result, we feel
concessions were negotiated under false pretenses. The scope of the City's discussions
has taken an opportunistic t -un and has now included non -economic items. Maintaining
the annual concession format of collective bargaining will continue to allow the City to
recover from the economic downturn while maintaining the assurances that were given to
the bargaining groups.
We are committed to the overall health of the City and arguably have the largest stake in
its economic well being. There is no compelling reason not to extend our contracts and
we ask that you consider directing City staff to extend the term of our contracts and meet
with us to determine the need for continued concessions.
