HomeMy WebLinkAboutAgenda Report - October 30, 2012 B-02 SMCITY OF LODI COUNCIL COMMUNICATION AGENDA ITEM 6-2_ AGENDA TITLE: Adopt Resolution Approving Application For Land And Water Conservation Fund Lodi Lake South Shore Improvements Project MEETING DATE: October 30,2012 PREPARED BY: Parks, Recreation and Cultural Services Interim Director RECOMMENDED ACTION: Adopt a resolution approving application for Land and Water Conservation Fund Lodi Lake South Shore Improvements Project. BACKGROUND INFORMATION: The parking and vehicle access areas along the south shore of Lodi Lake Park east of the entry gate are in poor condition. The Parks, Recreation and Cultural Services Department has long planned to reconfigure and reconstruct this area. With the sale of park property for the Surface Water Treatment Plant, the Department now has the funds to realize these plans. In the meantime, the State of California Department of Parks and Recreation's Office of Grants and Local Services is administering a federal grant program that provides nearly $2 million in matching funds statewide to cities, counties and district to acquire or develop outdoor recreation areas and facilities. Projects may include constructing new and/or renovating existing facilities for outdoor recreation, which includes constructing support facilities, such as lighting and parking. There is $1 million in Parks Capital funding for this project, sufficient for matching funds. The chances of receiving a 50 -percent match for the project are slim, but a grant award of any size would benefit the City. Staff estimates the project cost is $793,505. Our application requests a $396,752.50 match. The project largely consists of reconstructing a two-lane drive with diagonal parking on each side and making other improvements consistent with the Americans with Disabilities Act. This will increase the depth of lakefront areas and other green space and improve pedestrian access for the enjoyment of outdoor recreation at Lodi Lake Park. The Recreation Commission reviewed and expressed its support of this plan at the February7, 2012 meeting. By adopting this ordinance, the City Council approves filing a Land and Water Conservation Fund grant application, agrees not to convert any of the developed property to uses other than public recreation, certifiesthe City of Lodi has matching funds, certifies the project is compatible with the General Plan, and appoints the City Manager as the City's agent to execute and submit all documents. The improvementsfunded under this program must be retained in perpetuity for public outdoor recreation use. The application deadline is November 1, 2012. If the City is successful with its application, grant funding would likely be available in the State's 2013/14 fiscal year budget. Vrir l VSM*KING BIKE / JOGGING TRAIL EARTH MOUNO SERVICE PATIO ENTRY WALLS 8 PARK SIGN NEW ENTRY / EXIT DRIVE RO PD GROUP PICNIC RESHAPED EARTH MOUND SHADE SHELTER w/ DRINKING FOUNTAIN CREATIVE PLAY AREA SHADE SHELTER PICNIC / BIRTHDAY PARTY AREA 0 S 15 317 517 1017 Lake Park - South Shore Improvements Lodi, California RESOLUTION NO. 2012-171 A RESOLUTION OF THE LODI CITY COUNCIL APPROVING THE APPLICATION FOR LAND AND WATER CONSERVATION FUND LODI LAKE SOUTH SHORE IMPROVEMENTS PROJECT WHEREAS, the Congress under Public Law 88-578 has authorized the establishment of a federal Land and Water Conservation Fund Grant -In -Aid program, providing Matching funds to the State of California and its political subdivisions for acquiring lands and developing Facilities for public outdoor recreation purposes; and WHEREAS, the California Department of Parks and Recreation is responsible for administration of the program in the State, setting up necessary rules and procedures governing Applications by local agencies under the program; and WHEREAS, said adopted procedures established by the State Department of Parks and Recreation require the City of Lodi to certify by resolution the approval of Applications and the availability of eligible Matching funds prior to submission of said Applications to the State; and WHEREAS, the proposed Lodi Lake South Shore Improvement Project is consistent with the most recent California Outdoor Recreation Plan (CORP); and WHEREAS, the Project must be compatible with the land use plans of those jurisdictions immediately surrounding Project. NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby: 1. Approve the filing of an Application for Land and Water Conservation Fund assistance; and 2. Agrees to abide by SECTION 6(F)(3) of Public Law 88-578, which states "No property acquired or developed with assistance under this section shall, without the approval of the National Secretary of the Interior, be converted to other than public outdoor recreation uses. The Secretary shall approve such conversion only if he finds it to be in accord with the then existing comprehensive statewide outdoor recreation plan and only upon such conditions as he deems necessary to assure the substitution of other recreation properties of at least equal fair market value and of reasonably equivalent usefulness and location." 3. Certify that said agency has Matching funds from an eligible source and can finance 100 percent of the Project, which up to half may be reimbursed; and 4. Certify that the Project is compatible with the land use plans of those jurisdictions immediately surrounding the Project; and 5. Appoint the City Manager as agent of the City of Lodi to conduct all negotiations and execute and submit all documents, including, but not limited to, Applications, contracts, amendments, payment requests, and compliance with all applicable current state and federal laws which may be necessary for the completion of the aforementioned Project.
