PETERSON Citv Manager ALICE M RELVICHE -� - t_; City Clerk BOBMCNATT i lity Attorney At its meeting of Monday, September 12, 1988 the Lodi City Planning Commission denied the request of Larry Busch on behalf of Concrete Inc. to extend the Temporary Use Permit for a portable batch plant and office trailer located at 1360 West Turner Road in an area zoned M-2, Heavy Industrial. This action means that Concrete Inc. must cease and desist its operations at that location until the Planning Commission has received and approved (1) a specific schedule for the installation of permanent structures, and (2) a means to guarantee that the work will be completed. Section 17.72.110 of the Lodi Municipal Code provides as follows: "Any applicant or person claiming to be directly or adversely affected by any action of the Planning Commission may, within five days (i.e. working days) after the action, file a written appeal with the City Clerk for transmittal to the City Council. The appeal shall stay the issuance of any permits in connection with the action pending the decision of the City Council." The appeal, if any, should be directed to Alice M. Reimche, City Clerk and must be received by her before 5:00 p.m. Monday, September 19, 1988. If no appeal is filed, Concrete Inc. must cease its operations after the completion of the appeal period (September 19, 1988). The CommunI It Development Director will enforce the Planning Commission's order after that date by issuing citations should Concrete Inc. continue operations at 1360 East Turner Road.
