HomeMy WebLinkAboutAgenda Report - August 17, 1988 (83)`{.0 0 CITY OF LODI PUBLIC WORKS DEPARTMENT TO: City Council FROM: City Manager COUNCIL COiVIMUNICATION MEETING DATE: August 17, 1988 AGENDA TITLE: Set Public Hearing on Sidewalk Installation at 1000 South Hutchins Street RECOMMENDED ACTION: That the City Council set September 7, 1988, at 7:30 p.m., as the time to hear and pass upon objections or protests raised by the property owner at 1000 South Hutchins Street regarding the Notice to Construct Sidewalks on this property. BACKGROUND INFORMATION: In March 1985, the City Council determined that it was in the City's best interest to ask property owners of developed lots to install .sidewalk where none presently exists on all majorstreet reconstruction projects. There is only one parcel on the Hutchins Street project between Rimby Avenue and Vine Street that has no existing sidewalk. After the Council's decision in 1985, the property owner was notified that at a later date he would be required to install this sidewalk and that he would be notified when that had to be completed. This hearing is set in compliance with the Streets and Highways Code to give the property owner an opportunity to object to or protest this decision. The property owner was recently sent a letter informing him that he would receive a Notice to Construct ten days before September 7, 1988. JaC L. Written statements may be filed with the City Clerk at any time prior to the hearing scheduled herein and oral statements may be made at said hearing. If you challenge the subject matter. in court you may be limited to raising only those issues you or someone else raised at the Public Hearing described in this notice or in written correspondence delivered to the City Clerk, 221 West Pine Street, Lodi, California, at or prior to, the Public Hearing. A you know, this project is now well underway and since your property is the only property without sidewalk within the project limits, it is requested that this sidewalk be installed. The work should be done by a licensed contractor of your choice and an Encroachment Permit, available in the Public Works office at City Hall, is needed before starting the work. There i s no fee for the permit. There will be a public hearing held on September 7, 1988 to give you an opportunity to protest the decision of the Council regarding this installation. In conformance with the Streets and Highways Code, ten days prior to that hearing you will receive a Notice to Construct. This notice begins a 60 -day period when the sidewalk installation must start. If the Council reaffirms its decision that sidewalks must be installed at the public hearing, you will have 50 days remaining to begin that installation.
