HomeMy WebLinkAboutAgenda Report - August 3, 1988 (47)CITY OF LORI PUBLIC WORKS DEPARTMENT +kl: City Council FROM: City Manager, MEETING DATE: August 3, 1988 COUN=CONIOA'iiON AGENDA TITLE: Approve Agreement with Woodbridge Irrigation Cistrici for Beckman Park Pump Station Remodel at 1426 West Century Boulevard RECOMMENDED ACTION: That the City Council approve the attached agreement with the Woodbridge Irrigation District (WID) for the Beckmai Park Pump Station Remodel . BACKGROUND The City is doing work at the Beckman Park Pump Station to make the G -Area storm system fully functional. Included in this -4ork is a parshall flume which wi 1 1 be used to monitor the City's discharge rate into the canal. ?he parshall flume will be 'located in the WID right-of-way but maintained by the City. The agreement with the WID describes the portion of the WID right-of-way where the parshall flume will be installed and which the City will now maintain. Ronsko Public Works Director AGREEMENT THIS AGREEMENT made this%� day of ,�iri 1988 by and between WOODBRIDGE IRRIGATION DISTRICT D STRICT organized and existing under the California Irrigation District Act, hereinafter called "District" and the CITY OF LODI , a Municipal Corporation, hereinafter called "City.it WITNESSETH: WHEREAS, DISTRICT and CITY have entered into an agreement dated July 1, 1971, and a further agreement dated November 9, 1983, regarding discharge of storm waters from the CITY into the South Main Canal of said DISTRICT; and WHEREAS, CITY proposes to modify the pumping structure and install a flow metering device at the "CENTURY BOULEVARD" outlet. NOW, THEREFORE, in consideration of and subject to the covenants and conditions herein contained, said agreements of July 1, 1971, and November 9, 1983, are supplemented, and it is further agreed by and between the parties as follows: First. THE CITY AGREES to: a. Install and maintain flow metering dellices on each outlet. DISTRICT shall be given constant access to instantaneous discharge data and furnished with available recorded data. d b. Do no work in the right-of-way of the DISTRICT other than inspection and maintenance without receiving authorization from the DISTRICT. c. Allow DISTRICT to inspect pumping statirns, flow metering and recording devices, and outlet facilities. d. install concrete or riprap material, at the request of the DISTRICT, where needed to protect the canal from erosion due to the introduction of water by the CITY. Grading of the levee area in the vicinity of the proposed work shall also be done by the CITY as directed by the DISTRICT. e. Install and maintain a chain link fence in the DISTRICT right-of-way. Said fence shall enclose the following described area : Commencing at the northwest corner of that 16.64+ acre parcel as described in Book 3344, Official Records, Page 655, recorded October 23, 1969, San Joaquin County Records, thence S 1'03'35" E, 40.02 feet, along the east line of the Woodbridge Irrigation District Canal right-of-way to the south line of Century Boulevard and the True Point of Beginning. Thence S 1°03' 35" E, 130 feet, continuing along said east line; thence N 33°36'02" W, 55.00 feet; thence N 1003'35" W, 84.6 feet, to the westerly extension of the south line of Century Boulevard; thence S 89°12' E, 29.6 feet, along said westerly extension to the east line of the Woodbridge irrigation District Canal right-of-way and the True Point of Beginning. (See Exhibit "A") The chain link fence shall be 6 feet high, topped with 3 -strand barbed wire, and include a man -gate and a vehicular gate. The CITY SHALL do all maintenance within the fenced area. With authorization from the DISTRICT, the CITY shall be allowed access through the DISTRICT gate on Century Boulevard for the purpose of doing maintenance work in the pumping station area." As herein amended and modified, said agreement of July 1, 1971, shall remain in full force and effect. In the event of any conflict between the language of this agreement and the agreements of July 1, 1971, and November 9, 1983, the language herein contained shall prevail. N01i, THEREFORE, BE IT RESOLVED that the President and Secretary of Woodbridge Irrigation District be, and they hereby are authorized, empowered and directed to execute in behalf of the District that agreement dated July 15, 1088. I hereby certify that the foregoing is a full, true and correct copy of resolution regularly introduced, adopted and passed by the Board of Directors of the Woodbridge Irrigation District at the regular meeting of said Board held on the 15th day of July, 1988.
