AGENDA TITLE: Acceptance of Improvements a t 1721 South Cherokee Lane
RECOMMENDED ACTUN That the City Council adopt a resolution accepting the
development improvements at 1721 South Cherokee Lane.
BACKGROUND Il470RMATM — Improvements at 1721 South Cherokee Lane have been
completed in substantial conformance with the requirements of the Development
Agreement between the City of Lodi and Darrel Fandrich, Village Properties,
and H&M Builders, dated September 7, 1988, and as specifically set forth in
the plans and specifications approved by the City Council.

A RESOLUTION OF THE LODI CITY COUNCIL ACCEPTING THE IMPROVEMENTS
INCLUDED IN THE DEVELOPMENT AGREEMENT FOR 1721 SOUTH CHEROKEE LAME
The City Council of the City of Lodi finds:
1. That all requirements of the Development Agreement dated

The City Council of the City of Lodi, at its meeting on June 21, 1989,
accepted the offsite improvements in the above subdivision.
This letter is your authorization to exonerate the Instrument of Credit
covering faithful performance. The Instrument of Credit covering labor
and materials must remain in effect until September 19, 1989, in
conformance with the requirements of the State of California and the
Subdivision Map Act. You will receive no further correspondence
regarding the release of the Instrument of Credit for labor and materials
unless a claim is filed.

The City Council of the City of Lodi, at its meeting on June 21, 1989,
accepted the offsite improvements that were made in the above property.
Enclosed for your files and for your information is a copy ^f the
resolution accepting the street improvements in this development and the
public storm and electrical systems installed within the right-of-way.
From the date of the resolution, the City of Lodi will maintain the street
and other public improvements.
The enclosed letter has been sent to the Bank of Stockton so the
Instrument of Credit for $4,800, posted by H&M Builders, covering faithful
performance on Parcel A can be exonerated. The Instrument of Credit
covering labor and materials must remain in effect for a period of 90 days
from the date of the resolution, in conformance with the requirements of
the State of California and the Subdivision Map Act. On September 19,
1989, this instrument can be released if no claims have been filed.
The certificate of deposit from Village Properties to the City to
guarantee faithful performance on Parcel B has been returned to Village
Properties. The certificate of deposit guaranteeing labor and materials
will have to remain in effect for a period of 90 days from the date of the
resolution in conformance with the requirements of the State of California
and Subdivision Map Act. VST will mail this certificate of deposit to
Village Properties at the end of the 90 -day period, unless me hear
otherwise.
