SUBJECT: APPROVE IMPLEMENTATION OF A FLAT $100 BUILDING PERMIT FEE FOR ALL
REHABILITATION WORK DONE WITH COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS
ADMINISTERED THROUGH THE HOUSING REHABILITATION LOAN PROGRAM
RECOMMENDED ACTION: The City adopt a flat 4100.00 building permit fee (in
place of the normal building permit fees) for all rehab work done at one address
for residences rehabilitated under the City's Single -Family Housing Rehabilitation
Loan Program.
BACKGROUND INFORMATION: The Single -Family Rehab Loan Program provides
low-interest loans from CDGB funds to low- and moderate -income persons for the
purpose of bringing their homes up to housing code standards. Regular building
permit fees limit the amount of rehab work that can be done since monies used for
paying permit fees often take the place of those that could be used for additional
rehah vror!..
Other jurisdictions with similar programs, such as San Joaquin County, have
instead adopted a fixed building permit fee; they charge a flat $90.50 for their
CDGB-funded housing rehab projects. Their reasons for doing so include:
1. It adequately covers the administrative costs of processing the building
permits and the costs of performing the required inspections.
2. It helps to relieve the financial burden involved with doing rehabilitation
wcrk and allows the homeowner to get more rehabilitation for the dollar than
if those dollars went into paying higher building permit fees.
CONCLUSION: Remembering that the principal purpose of these loans is to
provide financial assistance to low- and moderate -income persons, it would seem
inappropriate that the City provide these loans only to collect a large portion
back in fees. Since $100.00 should adequately cover any costs incurred by the
City, it is re ommended that the City reduce the building permit fees for any
rehabilitation vkork done with CDGB loan funds to $100.00.

THEREFORE, BE IT RESOLVED that the City Council of the City of Lodi
does hereby approve the implementation of a flat $100 building permit fee for all
rehabilitation work done at one address for residences rehabilitated with loan
proceeds administered through the City's Community Development Block Grant Housing
Rehabilitation Program.

Cocnty's Entitlement Statement for program year 1988-89 Community
Development Block Grant Program, The County has developed a
Community Development Plan with both short and long term
community development objectives in accordance with the primary
objectives and requirements of the Housing and Community
Development Act of 1974, as amended. Project descriptions for
planning and construction of water and sewer projects, as
required by Executive Order 12372, w i 11 be transmitted to the
State Offices of Planning and Research and the Council of
Governments on or about June 1, 1988.

COMITY DEVELOPS BLOCK GRANT
GRANTEE CERTIFICATIONS
In accordance with the Housing and Community Development Act of
1974, as amended, and with 24 GFR 570.303 of the Community
Development Block Grant regulations, the grantee certifies that:
(a) It possesses legal authority to make a grant submission and to
execute a community development and housing program;
(b) Its governing body has duly adopted or passed as an official
act a resolution, motion or similar action authorizing the
person identified as the official representative of the grantee
to submit the final statement and all understandings and
assurances contained therein, and directing and authorizing the
person identified as the official representative of the grantee
to act in connection with the submission of the final statement
and to provide such additional information as may be required;
(e) Prior to submission of its final statement to HUD, the grantee
has:
1. met the citizen participation requirements of
§570.301 (a)(2) and has provided citizens with:
A. the estimate of the amount of CDBG funds proposed to
be used for activities that will benefit persons of
low and moderate income; and
B. its plan for minimizing displacement of persons as a
result of activities assisted with CDBG funds and to
assist persons actually displaced as a result of such
activities;
2. prepared its final statement of community development
objectives and projected use of funds in accordance with
§570.301(a)(3) and made the final statement available to
the public:
(d) It is following a detailed citizen participation plan which:
1. provides for and encourages citizen participation, with
particular emphasis on participation by persona of low and
moderate income who are residents of sham and blighted
areas and of areas in which funds are proposed to be used,
and provides for participation of residents in low and
moderate income, neighborhoods as defined by the local
jurisdiction:

2, provides citizens with reasonable and timely access to
local meetings, information, and records relating to the
grantee's proposed use of funds, as required by the
regulations of the Secretary, and relating to the actual
use of funds under the Act:
3, provides for technical assistance to groups representative
of persons of low and moderate income that request such
assistance in developing proposals with the level and type
of assistance to be determined by the grantee:
4. -provides for public hearings to obtain citizen views and
to respond to proposals and questions at all stages of the
community developm nt rogram, including at least the
development of needs, Phe review of proposed activities, IV
and review of program performance, which hearings shall be
held after adequate notice, at times and locations
convenient to potential or actual beneficiaries, and with
accomodat i on for the handicapped;
5. provides for a timely written answer to written complaints
and grievances: within 15 working days where practicable;
and
6, identifies how the needs of non-English speaking residents
will be met in the case of public hearings where a
significant number of non-English speaking residents can
be reasonably expected to participate:
(e) The grant will be conducted and administered in compliance
with:
i. Title VI of the Civil Rights Act of 1964 (Public Law 88-
352: 42 U.S.C. §2000d et seg, ); and
2. Title VIII of the Civil Rights Act of 1968 (Public Law 90-
284; 42 U.S.C. $3601 -Qt as . ),-

(g) It has developed its final statement of projected use of funds
so as to give maximum feasible, priority to activities which
benefit low and moderate income families or aid in the
prevention or elimination of slums or blight; (the final
statement of projected use of funds may also include activities
which the grantee certifies are designed to meet other
community development needs having a particular urgency because
existing conditions pose a serious and immediate threat to the
health or welfare of the community, and other financial

resources are not available): except that the aggregate, use of
CDDG funds received under section 106 of the Act and, if
applicable, under section 108 of the Act, during
the 1988, 1989, 1990 program years) (a period specified
by the gran ee consisting of one, two, or three consecutive
years), shall. principally benefit perscns of low and moderate
income in a manner that ensures that not less than 60 percent
of such funds are used for activities that benefit such person:;
during such period;
(h) It has developed a community development plan, for the period
specified in paragraph (g) above, that identifies community
development and housing needs and specifies both short and
long-term community development objectives that have been
developed in accordance with the primary objective and
requirements of the Act:

Additional funds to install new sidewalks or to replace deteriorated sidewalks.
Sidewalk construction and reconstruction activities will be carried out in a
project area generally bounded by 11th Street to the north, 6th Street to the
south, Tracy Boulevard to the west, and McArthur Drive to the east.
Avamon Water Svstem S.J. County $200,000 B 3
Funds will be used to augpent those allocated during the past two years for the
acquisition of land, replacement of existing water well, construction of water
tank, auxiliary power equipment, and replacement of six existing fire hydrants.
The project is generally bounded by Orange Avenue to the north, Southern
Pacific Railroad line to the east, Center Street to the south, and Amore Street
to the west.
Thornton Terminal Drainaae S.J. County $220,000

Funds will be used to augment funds allocated during the past two years for the
construction of a terminal drainage outfall to the Mokelumne River, System
will provide emergency flood control for the town of Thornton.

south.

Funds will be used for construction of water system improvements, including a
new well. Provides match for State Proposition 55 funds. Service area is the
existing corrrnunity of Clements.

Tract 53.01.

Construction of sidewalk ramps for handicap access from 12th Street to 6th
Street and Tracy Eoulevard to MacArthur Drive. Approximately 40 intersections
will be improved. Project site is located in Census Tract 53.02 and 54.

PROVIDE FOR AND ENCOURAGE CITIZEN PARTICIPATION

Notice shall be sent to local organizations, neighborhood
groups, and non-profit housing and human service organiza-
tions,
Notice shall be placed in local public buildings which may
include city halls, libraries, fire and police stat-
ions.
Public notice shall be placed in a newspaper of general
circulation regarding availability of funds and types of
CDBG eligible activities.
Notice shall be sent to local organizations neighborhood
groups, County municipal advisory councils, and non-profit
housing and human service organizations.
. Notice shall be placed in local public buildings which may
include libraries, fire and police stations.
PROVIDE TECHNICAL ASSISTANCE TO GROUPS
Public notice of availability of funds shall advise that
City and County staff will be available to provide infor-
mation and technical assistance to local groups in pre-
paring project proposals for consideration by the city
councils and the Board of Supervisors.
PROVIDE REASONABLE ACCESS TO INFORMATION AND RECORDS
CITXES
' A minimum of one Public noticed meeting shall be held at
which time local community residents shall have the oppor-
tunity to hear staff discussions on local development
needs and to obtain citizen input.
Where possible such public meetings will be held in locat-
ions accessible to potential project areas to facilitate
citizen comments on project proposals.
All data and information on project proposals shall be
available and open to the general public prior to, during,. _
and after the meeting.
COUNTY

as well as the Cities and to receive comments from the
general public.
Notice of the Board of Supervisor's Public nearing on the
proposed CDBG Activities shall. be placed in paper(s) of

Hearing.
GENERAL REQUIREMENTS
Reasonable efforts shall be maoe to have bilingual indivi-
duals available at public meetings and hearings in the
case where non-English speaking residents would be reason-
ably expected to participate.
Public meetings and hearings shall be held in locations
and in facilities wnich are accessible to the handicapped
and cisabled.
Staff shall respond to all written proposals and inquires
within 15 working days where practicable.

Impediments to a Locations 1 Choice in Housing
The San Joaquin County Board of Supervisors adopted Community
Development Block Grant (CDBG) Fair Housing Goals on
The following goals and objectives provide policy
guidance for the use of CDBG administrative resources in
maintaining compliance with federal fair housing requirements,
The County administers an entitlement CDBG Program on behalf of
itself and the participating cities of Lodi, Manteca, Tracy,
Ripon, and Escalon.
Goal #1: To increase public awareness of discrimination -in
housing through increased educational outreach and
dissemination of information.
Goal #2: To promote the implementation of housing policies
adopted by the County and participating cities and to
specifically address problems of affordability,
availability, and access to housing for all county
residents.
Goal X3: To support efforts to monitor local practices in the
advertising and offering of housing to insure that
housing is provided on a non-discriminatory basis.
Objective #1: To pursue the development of a composite regional
directory on open and fair housing services.
Objective #2: To participate in a task force of public and
private sector representatives to review and
address regional issues involving housing
discrimination and the availability and
affordability of housing.
Objective #3: To utilize the local Community Housing Resources
Board (or designated contact persons in cities
with independant fair housing programs) as a
focal point to receive inquiries concerning
housing discrimination and accessibility.
