AGEP40A TITLE: Public Hearing to Consider Resolution to Vacate a Portion of
the Public Utility Easements Along the East Line of Lower
Sacramento Road, Between Taylor Road and Vine Street, and the
North and South Lines of St. Moritz Drive
RECOMMENDED ACTION: That the City Council adopt an order abandoning a
portion of the public utility easements along the east line of Lower
Sacramento Road, between Taylor Road and Vine Street, and the north and south
lines of St. Moritz Drive.
BACKGROUND INFORMATION: At its meeting of March 16, 1988, the City Council
adopted a resolution of intention to vacate a portion of the public utility
easements along the east line of Lower Sacramento Road, between Taylor Road
and Vine Street, and the ncrth and south lines of St. Moritz Drive, and
referred the matter to the Planning Commission.
The Planning Commission determined at its meeting of March 28, 1988 that
there was no public need, present or future, for this portion of the
easements.
The owners have paid the required fees to process this abandonment. Pacific
Bell, PG&E, King Videocable Company, and City utilities have been notified of
this proposed abandonment. Pacific Bell, PG&E, and King Videocable have
approved this abandonment and approval of the City Utilities Department will
be secured prior to the final action.
A sketch of the proposed abandonment is attached.

RESOLUTION NO, 88-33
RESOLUTION OF INTENTION TO VACATE A PORTION OF THE PUBLIC UTILITY EASEMENTS
ALONG THE EAST LINE OF LOWER SACRAMENTO ROAD, BETWEEN TAYLOR ROAD AND
VINE STREET, AND THE NORTH AND SOUTH LINES OF ST. MORITZ DRIVE
BE IT RESOLVED by the City Council of the City of Lodi as follows
It is the intention of the City Council of the City of Lodi, acting in
accordance with the provisions of Sections 8300 et seq. of the Streets and
Highways Code of the State of California, to vacate and abandon the portion of
the public utility easements along the east line of Lower Sacramento Road,
between Taylor Road and Vine Street, and the north and south lines of St. Moritz
Drive, described as follows:
Portions of the southeast quarter of Section 10, T3N, R6E,
MDB&M, City of Lodi, San Joaquin County, described as follows:
The East 4 feet of that 10 foot wide public utility easement
along the east line of Lower Sacramento Road and the South
4 feet of that 10 foot wide easement along the south line of
St. Moritz Drive, and the north 4 feet of that 10 foot wide
easement along the north line of S t . Moritz Drive being
described as follows:
Easement "A" A 10 foot wide public utility easement
beginning at the southwest corner of Parcel "A" as shown on
Parcel Map, Book 14, Page 9, San Joaquin County Records; thence
along the west line of a 10 foot wide public utility easement,
North 499.39 feet, N 45'00' E, 23.08 feet; thence along the
north line of a 10 foot wide public utility easement, East
58.19 feet; thence along a curve to the right, having a radius
of 472.50 feet, a central angle of 27°00' and an arc length of
222.66 feet; thence S 63°00' E, 167.11 feet to the point of
termination.
Easement "B" A 10 foot wide public utility easement

along the west line of a 10 foot wide public utility easement,
South 535.98 feet, S 45'00' E, 23.08 feet; thence along the
south line of a 10 foot wide public utility easement, East
58.19 feet; thence along a curve to the right, having a radius
of 527.50 feet a central angle of 27°00' and an arc length of
248.58 feet; thence S 6TOD' E, 160.65 feet to the point of
termination.
Reference is hereby made to a map or plan on file in the office of the City
Clerk of the City of Lodi for the particulars as to the proposed vacation.

EE IT FURTHER RESOLVED that this City Council does hereby fix Wednesday,
April 6, 1988, at the hour of 7:30 p.ri. , in the City Council Chamber, City Hall,
Lodi, California, as the time and place when and where all persons interested in
or objecting to this proposed vacation may appear before this City Council and be
heard.
6E IT FURTHER RESOLVED that the Public Works Director shall cause to be
posted notices of easement vacation conspicuously along the line of the easement
hereinabove described and proposed to be vacated in the manner, form, and for the
length of time set forth in Section 8323 of the Streets and Highways Code of the
State of Cal ifarnia.
BE IT FURTHER RESOLVED that copies of this resolution shall be published for
at least two successive weeks prior to April 6, 1988 in the "Lodi Nms Sentinel",
a daily newspaper of general circulation printed and published in the City of
Lodi, County of San Joaquin.
