BACKGROUND INFORMATION: Wbm the Division of Highways relinquished Cherokee Lane to the City of Lodi, they also gave to the City certain access rights in the area south of Vine Street. In order to have legal access, it is necessary for property owners to receive approval from the City Council to add new driveways. The new driveway location will conform to the approved tentative map of Century Place, Tract No. 2265. The Public Works Department has reviewed the request for this nwv driveway and is recommending that a resolution be adopted by the City Council approving one new driveway. Jack L. LANE (CENTURY PLACE) WHEREAS, the City of Lodi is the successor in interest to the strip of land in, and to the access rights along and abutting Cherokee Lane within the City Limits of the City of Lodi; and WHEREAS, the developers of Century :'lace are desirous of establishing one new driveway to the real property owned by them at 1951 South Cherokee Lane; and WHEREAS. said request appears reasonable to the City Council of the City of Lodi. NOW, 'I11REFORl, BE IT RESOLVED by the City Councii Cf the City of Lodi as follows: 1. A 30 -foot driveway located approximately 64 feet south of the north property line is hereby established. 2. This resolution is adopted on the express condition that the developers shall be fully responsible for the cost of installing street ' improvements to comply with the Cherokee Lane Beautification Plan as prepared by Paul Tritenbach, Landscape Architect, dated November 8, 1966. Said beautification plan required the installation of an automatic sprinkler system, the planting and maintenance of turf, and the planting and future care of Zel kova Serrata trees. If any existing olive trees are to remain, the number- of Zelkova Serrata trees to be planted may be reduced by a like amount. 3. The cost of all of the improvements herein required, including curb, gutter sidewalk, street paving, and the installation of the aforesaid landscaping, shall be at the cost and expense of the developers i n accordance w i t h the devel opnient agreements. 4. The Public 'Works Director is authorized to approve modifications to the driveway width and location in accordance with City Design Standards.
