HomeMy WebLinkAboutAgenda Report - March 16, 1988 (45)a4t Oi t0 4 15 Q CITY OF LODI• DE i COUNCIL COMINTUNICATION TO: City Council FROM: City Manager MEETING DATE: March 16, 1988 AGENDA TITLE: Adopt Resolution of Intention to Vacate a Portion of the Public Utility Easement Along the West Line of 122 Rivergate Place RECOMMENDED ACTION: That the City Council adopt a resolution of intention to abandon a portion of the public utility easement along the west line of 122 Rivergate Place as shown on the attached exhibit; refer the matter to the Planning Commission; and set it for public hearing at the regular Council meeting of April 6, 1988. BACKGROUND INFORMATION: This public utility easement abandonment has been requested by the owners of 122 Rivergate Place to allow them additional space in their rear yard for the installation of a swimming pool. The owners have paid the required fees to process this abandonment. Pacific Bell, PG&E, King Videocable Company, and City utilities have been notified of this proposed abandonment and their approval will be secured prior to the final actions. Jac L. Dote Public Works Director Dote RC E RESOLUTION h0. 88-34 RESOLUTI01H OF INTENTION TO VACATE A PORTION OF THE PUBLIC UTILITY EASF1V� AT 122 RIVERGATE PLACE BE 1T RESOLVED by the City Council of the City of Lodi as follows It i s the intention of the City Council of the City of Lodi, acting in accordance with the provisions of Sections 83GO et seq. of the Streets and Highways Code of the State of California, to vacate and abandon the portion of the public utility easement at 122 Rivergate Place described as follows: The easterly 3 feet of the westerly 5 feet of the northerly 95 feet of Lot 11 of "Rivergate Place", Unit No. 1, as recorded September 12, 1984, in Volume 26 of Book of Maps and Plats, at Page 158, San Joaquin County Records. Reference is hereby made to a map or plan on file in the office of the City Clerk of the City of Lodi for the particulars as to the proposed vacation. BE IT FURTHER RBOLVED that this City Council does hereby fix Wednesday, April 6, 1988, at the hour of 7:30 p.m., in the City Council Chamber, City Hall, Lodi, California, as the time and place when and where all persons interested in or objecting to this proposed vacation may appear before this City Council and be heard. BE IT FURTHER RESOLVED that the Public Works Director shall cause to be posted notices of easement vacation conspicuously along the line of the easement hereinabove described and proposed to be vacated in the manner, form, and for the length of time set forth in Section 8323 of the Streets and Highways Code of the State of California. BE IT FURTHER RESOLVED that copies of this resolution shall be published for at least two successive weeks prior to April 6, 1988 in the "Lodi News Sentinel", a daily newspaper of general circulation printed and published in the City of Lodi, County of San Joaquin.
