AGENDA TITLE: Accept Improvements for 1211 East Vine Street
RECOMMENDED ACTION: That the City Council adopt a resolution accepting the
development improvements for 1211 East Vine Street and as shown on Drawing
No. 85DO79.
BACKGROUND INFORMATION: Improvements at 1211 East Vine Street have been
completed in substantial conformance with the requirements of the Development
Agreement between the City of Lodi and MCP Investments dated November 15,
1988, and as specifically set forth in the plans and specifications approved
by the City Council.
The street to be accepted is as follows:

RESOLUTION NO. 89-23
A RESOLUTION OF THE LOuI CITY COUNCIL ACCEPTING THE IMPROVEMENTS
INCLUDED TN THE DEVELOPMENT AGREEMENT FOR 1211 EAST VINE STREET
The City Council of the City of Lodi finds:
1. That all requirements of the Development Agreement dated November 16,
1988 between the City of Lodi and MCP Investments for 1211 East Vine
Street, have been complied with. The improvements are shown on
Drawing No. 85DO79, on file in the Public Works Department.
The street to be accepted is as follows:

I hereby certify .that Resolution No. 89-23.was passed and adopted by
the City Council of the City of Lodi in a regular meeting held March

The City Council of the City of Lodi, at its meeting on March 1, 1989,
accepted the offsite improvements in the above development.
This letter, together with the security release, is your authorization to
exonerate the Instrument of Credit covering faithful performance. The
Instrument of Credit covering labor and materials must remain in effect
until May 30, 1989 in conformance with the requirements of the State of
California and the Subdivision Map Act. You will receive no further
correspondence regarding the release of the Instrument of Credit for
labor and materials unless a claim is filed.

The City Council of the City of Lodi, at its meeting on March 1, 1989,
accepted the offsite improvements that were made in the above development.
Enclosed for your files and for your information is a copy of the
.resolution accepting the street improvements in this development and the
public storm, water, sanitary and electrical systems installed within the
development. Frain the date of the resolution, the City of Lodi will
maintain the street and other public improvements installed.
A letter, together with the security release form, has been sent to your
bank in order that the Instrument of Credit covering faithful performance
can be exonerated. The Instrument of Credit covering labor and materials
must remain in effect for a period of 90 days from the date of the
resolution, in conformance with the requirements of the State of
California and the Subdivision Map Act. On May 30, 1989, this instrument -
can be released if no claims have been filed.
