BACKGROUND INF FNftTION At the Council meeting of November 28, the Council directed staff to attempt to sell Federal -Aid Urban (FAU) funds. If the staff was unable to sell the funds at not less than 70 percent, the Council directed the City to go forward with the traffic signalization at Kettleman and Mills and Hutchins and Vine and the upgrade of the Church Street signals. City staff contacted Alameda County Transportation Authority and Santa Clara County Traffic Authority and they .have both offered 80t on the dollar for our FAU funds. Copies of these agencies' correspondence are attached. They would exchange local dollars which could be used on any transportation project. Although Caltrans has not given us the figure for the 1990/91 apportionment, our unaudited figure shows that we would have approximately $192,000 to exchange. If the Council decides to go ahead with the sale of our FAU dollars, vie ask that a resolution authorizing the City manager to execute an agreement with one of these agencies be approved. Box 3006 Lodi, CA 95,241 Subject: Combined Road Program Funds Dear Ms. Blaufus : This letter refers to the telephone conversation between you and David Clerici, the Authority's Administrative and Finance Manager, on November 29, 1990. I am authorized to initiate negotiations for the purchase of CRP funds. Accordingly, this letter constitutes our initial offer for purchase of the City of Lodi CRP allocations. The Authority intends to use any available CRP funds on a Caltrans project which is scheduled for advertisement early in 1991. This will require a transfer between funding categories. We understand that you have approximately $180,000 available for trade. We believe that FAU funds are worth $0.80 as against "clean" dollars. Petrie, Caltrans, Sacramento John McCallum, MTC Dennis Fay, Alameda County Vince Harris David Clerici Joan Van Brasch 4 AGREEMENT FOR ASSIGNMENT OF COMBINED ROAD PROGRAM (CRP) FUNDS This agreement is made and entered into this _day of 1990, by and between ALAMEDA COUNTY TRANSPORTATION AUTHORITY, a political subdivision of the State of California, hereinafter referred to as "AUTHORITY" and the CITY OF LODI, a political subdivision of the State of California, hereinafter referred to as "CITY". WHEREAS, CITY wishes to assign the total amount available, $180,000 of its allocation of CRP funds to AUTHORITY in exchange for Eighty Percent (80%) of that amount in funds that may be used for any CITY street/road related purposes: WHEREAS, the AUTHORITY wishes to accept said assignment for use on an AUTHORITY street related project which qualifies for CRP funding: WHEREAS, the CRP funds are discounted to the buyer because of expenditure restrictions, federal engineering standards, and increased administrative costs associated with using said funds: WHEREAS, apportioned CRP funds may be transferred between local agencies from or within an urbanized area with the approval of the appropriate local agency officials and the appropriate governing body responsible for apportioning the funds to the seller; WHEREAS, AUTHORITY and CITY consider this assignment and exchange as fair and equitable treatment under the CRP program: NOW, THEREFORE, it is mutually agreed as follows: I CITY agrees to transfer $180,000 of J.ts CRP fund apportionment to the AUTHORITY; 2. Upon notification by Caltrans that the apportionment is available for use, AUTHORITY agrees to transfer $144,000 of its sales tax revenue to CITY in a payment to be made upon such notification. 3. CITY agrees to use the received funds on CITY transportation related purpose.
