AGENDA TITLE: Discuss low-volume residential solid waste collection option

RECOMMENDED ACTION: That. the City Council hear a presentation from
California Waste RerN:fal Systems regarding a proposed
low-volume collection option and give consideration
to the attached draft uncodified urgency ordinance.
BAC'CGROUND= City staff has received an enormous number of calls
regarding the new three cart collection system. Over
107k of these calls have been from single, elderly
residents stating they generate less than half a can
of trash per week, and have no need for threes carts.
In response to this sentiment, CWRS has devised an alternate collection
mechanism comprised c.f a 20 gallon waste cart at a reduced rate. By the time
this issue is discussed, Dick Warner of Casa de Lodi and CWBS will have made
presentations to Council regarding options for low-volume producers at a
shirtsleeve session held December 15, 1992.
It has also been proposed that the City ani Franchisee offer for sale
specially -marked tags which could be affixed to trash bags. These would be
used by residents when a large volume of refuse is occasionally generated.
Trash bags would be tagged and placed at the curb for collection with routine
service.
The attached urgency ordinance regarding the 20 gallon waste cart option and
pre -paid collection tags is presented to the City Council for Consideration.

AN UNCODIFIED URGENCY ORDINANCE OF 'THS CITY COUNCIL OF THE: CITY OF LODI
ESTABLISHING OPTIONS FOR REFUSE COLLECTION AND SETTING
RATES FOR LOW-VOLUME RESIDENTIAL WASTE GENERATORS
WH E W , the City Council of the City of Lodi on October 21, 1992
adopted Ordinance No. 1558 establishing services and providing rates
for residential waste collection including mandatory recycling; and
WHEREAS, it now appears reasonable and necessary to offer and
provide an option for low volume generators of residential waste; and
WHEREAS, it also appears reasonable and necessary to offer
<prepaid tags fox occasional collection of additional refuse generated
by residences;
NOW, THEREFORE, BE IT ORDAINED BY TIKE CITY COUNCIL OF THE CITY OF
LODI AS FOLLOWS:
SECTION 1. Lodi Municipal Code Chapter 13.16 - SOLID WASTE - as it
relates to residential solid waste collection monthly rates is hereby
amended by adding the following language thereto:

1. The rate for once weekly collection of a 20 -gallon waste cart
shall be ten -dollars ($10.00) per month.

2. Any rtaidential customer may also pu—nase from the City or the
franchisee for the price of five dollars ($5.00) each specially
marked tags for affixing to trash bags which will then be
collected with routine waste removal service. Such tags may not
be used in lieu of other required waste removal services for
residences.
3. The City Council of the City of Lodi hereby finds and declares
pursuant to Public Resources Code Section 21080 that such rates
are necessary and reasonable for the usual operating expenses of
the franchisee, including employee wages and benefits and for the
purpose of purchasing facilities, equipment and materials
necessary to implement and carry out a Council -mandated recycling
program.
SECTION 2. "his is an urgency ordinance under Government Code Section
36934, and is based on health, safety and welfare considerations
arising from the need to collect appropriate fees for waste removal.
SECTION 3. This urgency ordinance shall be published one time in the
"Lodi News Sentinel", a daily newspaper of general circulation printed
and published in the City of Lodi and shall be in force and take effect
immediately.

consider his proposal and certainly no time to consider the ramifications
of another cart (the 20 Gal. onei . At t!ie called meetln;�, trere were only
five voting members present. Cf the `'our tc one vote, I voted SG.
My first feeling was one of inadequacy. net in the wors vie :^.ad d one to
come up with the three cart system, but in not being able to better. communi-
cate with the public for the need of the system as established. Perhaps few
really understamf that the profit from the recycling and sale of compost is
credited back to fhe city, which keeps the rates down as low as possible.
This, in turn, kelps those with no need for more than one car:. in fact,
they get this bonus, while others clutter up their yards, etc. to do the
RIGHT thing for not only all of us, but for all who come in the future.
In taking it upon myself to further investigate this 20 gal. option,
I called Asst. Mg.. Jerry Glem who worked out the date Methodology which
was approved by council some months ago. (Worked out, I might acid, with
the assistance of two consulting firms, one for the City and one for Cal
Waste.) I asked him how this 20 gal. option would affect the financial
side of the picture. He properly said without figures he could not give
me an answer, So, I gave him a figure I feel could be realistic. What if
50% of the Lodi residents chose to take the 20 gal. cart. How would that
affect the rest of the residential customers? He quickly corrected nu
saying that any such change would have to be made up by an increase of rates
for ALL customers (residential), For example. the 310.00 cart would wind
up 8s $11.35 (not much less than the $12-83) and the $12.83 rate would
be $14.18. Is this what we really want? And I Bio believe the 50% figure
I used would be a close call. The point is, the mechanism is in place to
adjust to the same amount of income.
I for one do not need a 38 gal, cart, nor do many of my friends. We
just haven't complained and know the cost has to be spread about. My
conscience is clear since there Is an Advisory Board in place to help
those who need financial assistance. But If the 20 gal. cart were adopted,
I would feel free to prcmote it to all. But. you see, we would be defeating
our own purpose since the more who accent the 20 gal carts, the more they
w i 1 1 have to pay per month, and the more the others will pay also. Someome
else will have to pick up the tab, and if you expect to have the Calif.
Waste pick it up, then I think we are in for another long session on the
methodology. I urge the council to take the time to study any changes
presented, and not to make a hasty decision tonight due to the pressure
of a petition. I can think of other options, and wvu?d be glad to present
them at another time.
4 background is insurance, and I am well aware of how tho cost of
Insurance is determined in part by the number of people who subscribe to
the coverage. This helps everyone to have an essential protection. The
same is true of garbage service. As I said, those who are using the carts
and I mean the recycling and composting, are helping the rest of you in
kaeping the rates down. I urge you to give the system a chance and to
take the time to researc.nmore fully before nakl _g a change.
