AGENDA TITLE: Adopt Resolution Accepting Improvements Under Contractfor 2010 Street
Improvements Project and Appropriating Funds ($100,000)

RECOMMENDED ACTION: Adopt resolution accepting improvements under contract for 2010
Street Improvements Project and appropriating funds in the amount
Of $100,000.
BACKGROUND INFORMATION: The project was awarded to Granite Construction Company, of
Stockton, on May 19,2010, in the amount of $886,885. The contract
has been completed in substantial conformancewith the plans and
specifications approved by City Council on November4, 2009.
This project consisted of street improvements on Ham Lane and Vine Street, including new ADA
accessible ramps at every intersection and overlay and striping of Ham Lane between Kettleman Lane and
Century Boulevard and Vine Street between FairmontAvenue and Mills Avenue.
During construction it was discovered that the existing roadway subgrade on Ham Lane between
Century Boulevard and Brandywine Drive required cement treatment to stabilize the area prior to paving.
A geotechnical engineerfrorn Neil 0. Anderson & Associates was retained as part of this work to provide
direction on the best means and methods to resolve the subgrade issue.
There were two change orders for this project, one which included cement treatment of the roadway
subgrade adjacent to Tokay High School to stabilize the roadway ($72,075, 32) and the second for
increases in the base contract work quantities for asphalt paving, removal and replacement of concrete
sidewalk, curb, gutter and sign posts ($98,596,50), for a total cost of $170,671.82. The total final contract
amount is $1,057,556.82. The requested appropriation is to fund the change order costs, additional testing
and inspection services performed by Neil 0. Anderson & Associates ($6,514.00), and project costs (City
staff, printing, bidding, materials, etc.) not covered by the original appropriation of $1,064,262.
Following acceptance by the City Council, as required by law, the City Engineerwill file a Notice of
Completion with the County Recorder's office. The notice serves to notify vendors and subcontractors
that the project is complete and begins their 30 -day period to file a stop notice requiring the City to
withhold payments from the prime contractor in the event of a payment dispute.
FISCAL IMPACT: The projectwill reduce the maintenance costs in the project areas.

RESOLUTION NO. 2010-211
A RESOLUTION OF THE LODI CITY COUNCIL ACCEPTING
IMPROVEMENTS UNDER CONTRACT FOR 2010 STREET
IMPROVEMENTS PROJECT AND FURTHER APPROPRIATING
ADDITIONAL FUNDS FOR THE PROJECT
WHEREAS, the project was awarded to Granite Construction Company, of Stockton, on
May 19, 2010, in the amount of $886,885; and
WHEREAS, the contract has been completed in substantial conformance with the plans
and specifications approved by City Council on November4,2009; and
WHEREAS, this project consisted of street improvements on Ham Lane and Vine Street,
including new Americans with Disabilities Act accessible ramps at every intersection and
overlay and striping of Ham Lane between Kettleman Lane and Century Boulevard and Vine
Street between FairmontAvenue and Mills Avenue; and
WHEREAS, there were two change orders for this project, one which included cement
treatment of the roadway subgrade adjacent to Tokay High School to stabilize the roadway
($72,075.32) and the second for increases in the base contract work quantities for asphalt
paving, removal, and replacement of concrete sidewalk, curb, gutter, and sign posts

WHEREAS, staff recommends appropriation from the Proposition 1B fund to cover
change order costs and additional testing and inspection services not covered by project
contingencies.
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby accept
the improvements under the contract for the 2010 Street Improvements Project and directs the
City Engineerto file a Notice cf Completion with the County Recorder's Office; and
BE IT FURTHER RESOLVED that additional funds in the amount of $100,000 be
appropriated from the Proposition 1 B Fund for this project.
