040 AGENDA ITEM 19 ' CITY OF LODI %W COUNCIL COMMUNICATION Im AGENDA TITLE: Adopt Resolution Approving the Expansion c the San Joaquin County Enterprise Zone Boundary MEETING DATE: November 23,2010 PREPARED BY: City Manager RECOMMENDED ACTION: Adopt a resolution approving the expansion of the San Joaquin County EnterpriseZone boundary. BACKGROUND INFORMATION: The State of California granted the San Joaquin County Enterprise Zone (SJCEZ) designation effective June 22,2008. The designation is for 15 years. The Enterprise Zone offers attractive financial incentives for businesses located within the designated area of the zone, and is a key element not only in attracting but in retaining businesses in Lodi. All industrial zoned property and most commercial property in Lodi is included in the zone. This proposed expansion, if approved by the County's other governing bodies and the State, will add Lodi Nut Company, a business office complex on Kettleman Lane/Mills Avenue, and the Chili's restaurantto the Enterprise Zone. Lodi Nut Company and the office complex did not qualify when the zone was originally drawn, and the exclusion of Chili's was an oversight. On Aug. 18,2010, the City Council adopted a resolution acknowledging Lodi Nut Company's grandfathered industrial use at its FairmontAvenue location to strengthen this expansion application. As of Sept. 30, 2010, 74 Lodi businesses have taken advantage of EnterpriseZone benefits, submitting vouchers for 1,021 employees. Dueto the tax credits available for hiring qualifying employees, these 74 businessescould see tax savings of as much as $38 million over five years. City and County staff have reviewed the EnterpriseZone inclusion requests and determinedthe parcels are eligible additions to the Zone. Attached is the map and parcel listing by jurisdiction of the proposed area to be added to the EnterpriseZone. The current SJCEZ is approximately 656 square miles. The expansion will add approximately 5.5 square miles and, for the first time, portions of Escalon and Ripon. All expansion requests must be approved by all partner cities and the county. The California Departmentof Housing and Community Developmentwill determine the effective date. FISCAL IMPACT: The additions of Escalon and Ripon to the EnterpriseZone and expansions in other communitieswill reduce Lodi's share of zone marketing costs from $21,766 in FY 2010/11 to $21,464 in FY 2011/12. Rising fuel prices were again a major part of the quarterly increase. Pent- up demand and manufacturer incen- tives produced impressive gains in auto and RV sales. Capital investment in technology, equipment and supplies to reduce labor and energy costs drove expanded receipts from business and industrial purchases. Areas surrounding the Silicon Valley continue to be the center of greatest recovery though a recent up -tick in travel helped produce gains in some vacation/resort communities. The inland parts of California still lag the coastal regions. Us Official! The Recession is Over! The National Bureau of Economic Research (NBER) has announcedthat the recession ended in June of 2009. Technically, this means that econom- ic indicators show that the economy has finally bottomed out. It does not mean that a recoveryhas occurred. This year's earlier exuberance has given way to near consensus among economists that the state's recovery w i I I be slow with less than average growth over the next two years. The argument is that further delever- aging from years of over -spending, over -borrowing, hyper -speculative in- vestment and unsustainable real estate prices must occur before we reach the base on which normal growth restarts. With the focus onproductivity innova- tions rather than jobs, unemployment is expected to stay in double digits at least u1d1 the end of 2012. Sales tax revenues are expected to continue to recover but at slightly lower rates than experienced earlier in the year from various tax credit, stimulus rebate and manufacturer incentive programs. Green Energy Exemptions The California Alternative Energy and Advanced Transportation Fi- nancing Authority (CAEATFA) has fast -tracked adoption of their emer- gency regulations for implementing new sales and use tax exemptions for "Green Manufacturing" authorizedby SB 71, the only significant new sales tax related bill adopted in 2010 to date. The first approvals are planned for their November 17 meeting. Industry lobbyists have shut local gov- ernments out of the process and addi- tional regulations are now being devel- oped for exempting major alternative energy projects such as solar, geother- mal and wind.
