HomeMy WebLinkAboutAgenda Report - November 7, 1990 (49)CL N C I L C 0 M M U N I C A 1 ON TO: THE CITY COUNCIL FROM: THE CITY MANAGER'S OFFICE COUNCIL MEETING DATE: NOVEMBER 7, 1990 SUBJECT: ADOPTION OF ORDINANCE ND. 1500 - AM ORDINANCE OF THE LODI CITY COUNCIL AMENDING LODI MUNICIPAL CODE TITLE 17 - ZONING - SECTION 17.69.020 BY ADDING THERETO A NEW SUBSECTION "D" RELATING TO NONCONFORMING BUILDINGS Ordinance No. 1500 - "An Ordinance of the Lodi City Council Amending Lodi Municipal Code Title 17 - Zoning - Section 17.69.020 By Adding Thereto a New Subsection `D' Relating to Nonconforming Buildings" was introduced at the regular meeting of the Lodi City Council held October 17, 1990. Pursuant to State statute, ordinances may be adopted five days after their introduction following reading by title. This Ordinance has been approved as to f o m by the City Attorney. RECOMMENDED ACTION: Following reading by title, it would be appropriate for the Lodi City Council to adopt Ordinance No. 1500. 7h &,/t.,, Alice M. Reimche City Clerk AMR/imp COUNC047/TXTA.02J ORDINANCE NO. 1500 AN ORDINANCE OF THE LORI CITY COUNCIL AMESLIIl G LODI MUNICIPAL CODE TITLE 17 - ZONNCI - SECTION 17 69.020 BY ADDING THERETO A NEW SUBSECTION "D" RELATING TO NONCONFORMING BUILDINGS, BE IT ORDAINED BY THE LODI CITY COUNCIL AS NOUNS SECTION 1. Lodi Municipal Code Title 17 - Zoning, Section 17.69.020 - Nonconforming Buildings - is hereby amended by adding thereto a new subsection "D" to read as follows: "D. Notwithstanding subsection (c) above, any residential structure legally existing as a nonconforming use on October 1, 1990 , n any Industrial ("M") zone may be rebuilt or restored if damaged or destroyed by fire, other calamity, or act of God, provided that such restoration or rebuilding is commenced within six months of such damage or destruction. However, such rebuilt or restored structure shall not exceed the square footage of the original structure and shall otherwise conform to all applicable Building regulations for residences." SECTION 2. All ordinances and parts of ordinances in conflict herewith are repealed insofar as such conflict may exist. SECTION 3. This ordinance shall be published one time in the "Lodi News Sentinel", a daily newspaper of general circulation printed and published in the City of Lodi and shall be in force and take effect thirty days from and after its passage and approval. -1- ATTEST: 7r lS., vei-/ ALICE M.
