SUBJECT: CONSIDER RESOLUTION APPROVING THE NORTH COIM SANITARY LANDFILL AS THE
REPLACEMENT SITE FOR THE HARNEY LANE SANITARY LANDFILL

RECOMMENDED ACTION: That the City Council adopt Resolution No. 90-173, "A
Resolution of the City Council Approving the North
County Sanitary Landfill as the Replacement Site for
the Harney Lane Sanitary Landfill."

Hirata, the County's Public Works Director requesting
City Council action in this matter. The letter i s
self-explanatory. Also attached (Exhibit B) is a
copy of the appropriate resolution. Adoption of this
resolution further lending the City's support to this
project i s i n the City's best interest.

The County's Harney Lane Sanitary Landfill is reaching its
capacity and must be closed in 1991. The 1986 County Solid Waste
Management Plan, which was approved by your City Council on
June 25, 1986, recommended the procurement and development of a
replacement site for the Harney Lane Sanitary Landfill (HLSL)-
The replacement site was to be located near the existing HLSL.
Consistent with that recommendation, the County of San Joaquin,
in 1987, purchased a 320 acre parcel as a replacement site for
the HLSL. This site is located on Harney Lane, 1 1/2 miles east
of the HLSL. Presently, the County is in the process of securing
the necessary State operating permits for the landfill. This
landfill is referred to as the North County Sanitary Landfill
(NCSL), and is expected to be in operation by September 1, 1991-

Last month, Governor Deukmejian signed into law Assembly Bill
2296. Basically, the Bill facilitates the permitting of new
disposal sites until each county in California has a State
approved integrated waste management plan.
Since San Joaquin County does not have an approved integrated
waste management plan at this time, the NCSL project is subject
to the provisions of AS 2296, One of the provisions requires
that the facility be approved by the County and a majority of the
cities within the county representing a majority of the
population of the incorporated areas.
Accordingly, we respectfully request that your City Council
consider adopting a resolution, similar to the one attached,
declaring its approval of the NCSL. If adopted by your City
Council, please forward a certified copy of the resolutiin to us.

WHEREAS, Assembly Bill 2296 establishes criteria for the
approval of new disposal sites, until the counties in California
have State approved countywide integrated waste management plans:

WHEREAS, the County of San Joaquin does not currently have a
countywide integrated waste management plan: and
WHEREAS, one of the specified requirements of Assembly Bill
2296 establishes that any new solid waste disposal facility be
approved by the County and a majority of the cities within the
county representing a majority of the population of the
incorporated areas.
NOW, THEREFORE, BE IT RESOLVED that this City Council, in
conformance with Assembly Bill 2296, does hereby approve the
North County Sanitary Landfill, which is identified and described
above, as the replacement site for the Harney Lane Sanitary
Landfill.

A RESOLUTION OF THE LORI CITY COUNCIL,
APPRONING THE NORTH CJJ UY SANITARY LANDFILL
AS THE REPLACEMENT SITE FOR THE
HARNEY LANE SANITARY LANDFILL
WHEREAS, on June 25, 1986, this City Council adopted Resolution
Na 86-91 which approved the 1986 San Joaquin County Solid Waste
Management Plan; and
