HomeMy WebLinkAboutAgenda Report - November 4, 1992 (62)CIN OF LODI COUNCIL COMMUNICATION AGENDA TITLE: Adoption of Ordinance No. 1557 entitled, "An Ordinance of the City Council of the City of Lodi Amending Lodi Municipal Code Chapter 10.16 by Adding a New Section 10.16.015 Relating to Traffic Regulations on State Highways" MEETING DATE: November 4, 1992 PREPARED BY: City Clerk RECOMMENDED ACTION: Following reading by title, it would be appropriate for the City Council to adopt Ordinance No. 1557. BACKGROUND INFORMATION: Ordinance No. 1557 entitled, "An Ordinance of the City Council of the City of Lodi Amending Lodi Municipal Code Chapter 10.16 by Adding a New Section 10.16.015 Relating to Traffic Regulations on State Highways" was introduced at the regular meeting of the Lodi City council held October 21, 1992. Pursuant to State statute, ordinances may be adopted five days after their introduction following reading by title. This Ordinance has been approved as to form by the City Attorney. PETERSON ORDINANCE NO. 1557 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LODI AMENDING LODI MUNICIPAL CODE CHAPTER 10.16 BY ADDING A NEW SECTION 10.16.015 RELATING TO TRAFFIC REGULATIONS ON STATE HIGHWAYS BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LODI AS FOLLOWS: SECTION 1. Lodi Municipal Code Chapter 10.16 - TRAFFIC CONTROL DEVICES - is hereby amended to add a new Section 10. 16.015 to read as follows: 10.16.015. Traffic Regulations on State Highways. "Any provision of this ordinance which regulates traffic or delegates the regulation of: traffic upon State highway8 in any way for which the approval of the Department of Transportation is required by State law, shall cease to be operative six months after receipt by the City Council of written notice of withdrawal of approval of the Department of Transportation. "Whenever this ordinance delegates authority to a city officer, or authorizes action by the City Council to regulate traffic upon a State highway in any way which by State law requires the prior approval of the Department of Transportation, no such officer shall exercise such authority nor shall such action by the City Council be effective with respect to any State highway without the prior apprc-al in writing of the Department of Transportation when and to the extent required by the Vehicle Code." -1- S':C'.XON 2. All ordinances ants parts of -)rdinances in conflict herewith are repealed insofar as such conflict may exist. SFCTION 3. This ordinance shall be published one timt in the "Lodi News Sentinel", a daily newspaper of general circulation printed and published in the City of Lodi and shall be in force and take effect thirty days from and after its passage and approval.
