AGXNDA TITLE: Amend Refuse Rates Within the City of Lodi and
New Collection hechanism
MEETING DATE: October 21, 1992
PREPARED BY: Assistant City Manager
RECOMMENDED ACTION: The City council adopt the "three cart" curbside
recycling program and adopt the rates shown in
attached Ordinance 1558 and Ordinance 1559.
BACKGROUND INFORMATION: AB939 requires the City of Lodi and all California
cities to reduce the flow of solid waste to landfills
2St by 1995 and 50ir by the year 2000. From the waste
characterization studies we have conducted the only
means of meeting this requirement is to recycle.
The Solid Waste Management Task Force after much study has recommended to the
City Council a curbside recycling program. The major elements of this plan are
that 'residents will be issued one 38 -gallon waste cart to be used for all
ntm-recyclable waste. Residents will be given the option of obtaining one or
more 60 -gallon carts for recyclables and one or more 90 -gallon carts for yard
and garden waste. The 38 -gallon cart will be picked up every week at the curb
and the recyclables and yard and garden waste on alternate weeks.
Win this plan was first presented to the City Council it projected a
residential rate increase to $14.92 for basic service and another increase of
31% to $19.55 effective April 1, 1993. It also projected a 31% increase for
commercial and industrial customers now and an additional 31% in April 1993.

Upon review of the projected rates, staff of the City and Sanitary City
Disposal refined these numbers by reducing labor costs, the number of new
trucks to be purchased, the City's franchise fee and other operational costs.
After this refinement we were able to reduce the rate increase to $12.83
effective the first of November, 1992 with another rate increase in April, 1993
not to exceed $16.46.
It is recognized there is a segment of our population which cannot take or make
arrangements to have the waste carts taken to the street. Also we have a
sizable number of families in Lodi who live below the poverty level. In order
to alleviate the impact of this program on those citizens, it is recommended
that °a citizens' advisory board be established to review petitions to continue
back yard service and to ascertain if a family is living below the poverty
level. If the criteria for not being able to get the waste cart to the curb
are met, then back yard service will be continued. If a family is living below
the poverty level a reduced rate will be effected. It is suggested this board
consist of the following:
. Kirk Evans, Administrative Assistant to the City Manager
. One member from the Senior Commission
. One member from the Solid Waste Management Task Force
If a Ramily wishes to continue back yard pick up, this service will be
profided. However, there will be a $10.00 per month surcharge.

This program is designed to provide a strong incentive for the majority of our
population to encourage recycling. By only having available a 38 -gallon
container for solid waste, people will be forced to utilize the opportunity to
recycle or pay extra for additional capacity. For those who have little solid
waste we can only hope they will avail themselves of the opportunity to recycle.
There is little doubt this program is expensi•.e. It is very capital
intensive. Rear -loader collection trucks will be rarely used as they require
two people. Waste carts must be purchased. Finally, and the largest coat of
all, is the expansion of the material recovery facility. This alone is a
project in excess of $4,000,000 which must be included in the rate.
It must be understood by the City Council that another rate adjustment is
contemplated this spring. The initial estimates are that the increase will be
28%. However, I believe that increase will be significantly lower. We will
certainly have a better handle on the actual costs of trucks, waste carts,
interest, number of carte actually utilized, the actual costs of operation, and
a more clearly defined cost of the Material Recovery Facility.
One means of increasing efficiency and thus reducing costs is to allow service
to be shared by families in multi -unit residences. All of the ramifications of
this have not been worked out and the City policy on sharing service must be
rethought. This is certainly an item that can be considered and included in
the implementation.

The budget submitted includes over $100,000 for community education and
awareness. We envision utilizing newspaper and television advertising. One
idea has been to contract to have a video-tape prepared that would be suitable
for service clubs, church groups and the like.
This program cannot be implemented overnight, but by using equipment on hand,
and "begging, borrowing and stealing" resources we can begin the first phase of
the program within two weeks and have the whole city involved by February 1,
1993. The City would be divided into districts and each district would be
implemented at the same time.

BE IT ORDAINED BY THE CITY COMICIL OF THE CITY OF LODI AS FOLLOWS:
SECTION 1. Lodi Municipal Code Chapter 13.16 - SOLID WASTE - as it
relates to residential solid waste collection monthly rates is hereby
amended to read as follows:
Monthly rates.
A. The monthly rates to be charged for garbage collection service
shall be as follows:
1. For any private dwelling house or residence, the rate for one
weekly garbage collection shall be:
a. For the first waste cert provided by the contractor of
thirty-eight gallons and not to exceed sixty pounds, twelve
dollars and eighty three cents ($12.83);
b. For two waste carts provided by the contractor of
thirty-eight gallons and not to exceed sixty pounds each, thirty
two dollars and eight cents ($32.08);
C. For three waste carts provided by the contractor of
thirty-eight gallons and not :o exceed sixty pounds each, fi:ty
one dollars and thirty-two cents ($51.32)
2. Owners or occupants of flats, apartments, mobile home spaces
�. or the tenants or lessees thereof shall pay an amount equal to twelve
dollars and eighty-three cents ($12.83) times the number of apartment

units or mobile home spaces - :ed. Bin service requested shall he
charged according to the Commercial Rate struct,ire, but in no e-enr_
shall the City bill the tenant; more than the single cart rate.
3. For any residence requesting "backyard service" for the
collection of their waste cart(s), there shall be an additional rate of
ten dollars ($10.00) per month, unless the residence is granted an
exemption from the rate by the Citizen's Advisory Board.
4. For any residence requesting a commingled recyclables cart(s)
and/or a yard/garden waste cart(s), sufficient to meet its waste
diversion needs, there shall be no additional charge.
8, All of the rate schedules set forth in this section shall be
effective on all bills which are prepared on or after November 1, 1992.
The above rates reflect the first in a series of rate
adjustments. A second adjustment may be effective on all bills which
are prepared on or after April 1, 1993.
SECTION 2, All ordinances and parts of ordinances in conflict
herewith are repealed insofar as such conflict may exist.
SECTION 3. This is an urgency ordinance under Government Code
Section 36934, and is based on health, safety and welfare
considerations arising from the need to collect appropriate fees for
waste removal.
SECTION 4. This urgency ordinance shall be published one time in the
"Lodi News Sentinel", a daily newspaper of general circulation printed

RELATING TO COMMERCIAL SOLID WASTE COLLECTION MONTHLY RATES
BE IT ORDAINED BY THE LODI CITY COUNCIL.
SECTION 1. Lodi Municipal Code Chapter 13.16 - SOLID WASTE - as
it relates to commercial solid waste collection monthly rates is hereby
amended to read as follows:
Monthly rates.
A. The monthly rates to be charged for garbage collection service
shall be as follows:
1. For owners or tenants of business houses, the monthly
rates aha11 be:
a. As set forth in the Commercial Rate Structure schedule
attached, when commercial bin service is requested.
b. Forty-five dollars ($45.00) per month for once per week
collection, when a commercial waste cart provided by the
contractor of ninety-five gallons and not to exceed one hundred
and fifty pounds is requested.
8, All of the rate schedules set forth in this section shall be
effective on all bills which are prepared on or after November 1, 1992.

(INDUSTRIAL WASTE FRANCHISE)
An error appears in Item F14 of the October 21, 1992 City Council
agenda. The item incorrectly indicates that a public hearing should be
set for November 18, 1992 to consider introduction of ordinances
amending Chapter 13.16 of the Municipal Code and the franchise
agreement to include industrial waste. In actuality, these ordinances
(Ordinance No. 1512 and 1513) were introduced on May 1, 1991.
At that time, the City Council indicated it wished the ordinances to
become effective at the same time that rates for industrial waste
collection were set. To accomplish that, the ordinances were laid on
the table pending receipt of industrial rate information from the
f ra.nchisea
That information has now been received and the Council Can, if it
wishes, go forward with final adoption of Ordinances 1512 and 1513,
although they were introduced nearly 18 months ago. while Government
Code Section 36934 specifies that at least 5 days must elapse between
introduction and final adoption of an ordinance, I found no legal
guidance about how long a lapse between introduction and adoption voids
the first reading. As such, it is assumed that the introduction is
still valid and the Council can act on final adoption if it wishes.
Staff met with representatives of Lodi Sanitary City Disposal Company
on Monday, October 19, 1992 to decide how the various intertwined
ordinances should be presented to the Council for consideration. It
appears the most practical way of handling this is as follows:

October 21, 1992 -> Adopt residential and commercial rate
Ordinances 1558 and 1559 as urgency measures
(one reading only) .
-> Set second reading and final adoption
of Ordinances 1512 and 1513 addressing
industrial waste for the next regular Council
meeting (November 4, 1992).
November 4. 1992 -> Possible final adoption of Ordinances 1512
and 1513, amending Lodi Municipal Code
Chapter 13.16 and the refuse franchise to
include industrial waste.
-> Adopt urgency ordinance setting industrial
rates (one reading only) .

Several options were discussed, but the above proposal seems to
dovetail together in the most efficient fashion.
It is therefore requested that Item F14 on the consent calendar for the
October 21, 1992 Council meeting be removed, and the second reading of
Ordinances 1512 and 1513 be scheduled for November 4, 1992.

Lodi Municipal Code Chapter 13.16 - Solid Waste - is hereby
mended to provide for the addition thereto of industrial refuse
service, as follows:
13.16.020. Peauired Services: Exceotions_,
A. ^Every person owning or occupying residential, commercial or
industrial premises witt;in the City limits shall utilize the
refuse collection and transportation services of Contractor for
which the City has contracted, and shall pay the fees for those
services as set by the City. Each owner or occupier of
residential, commercial or industrial property shall directly
arrange with the City for the provision of services. •••"
13.16.040. All .Rea%ieats for Service to be Met,
^Contractor shall provide refuse collection and transportation
services to all residential, commercial and indtf$trial customers
within the area specified in its contract. ..."
13.16.050. Qlacement of Containers.

j "Commercial and industrial customers shall place refuse in a
location on their premises that is readily accessible to
Contractor's collection vehicles, and that has received
Contractor's prior approval as conforming to its specifications
and requirements for refuse container facilities.

customers to maintain refuse containers in a clean and sanitary

13.16.120 Monthly Rates
"The City shall establish by uncodified ordinance of the City
Council, pursuant to Health and Safety Code Section 5471, a
schedule of rates to be charged ... Such schedule shall set the
rates for commercial, residential, and industrial refuse
collection, and refuse permits."
SECTION 2. All ordinances and parts of ordinances in conflict
herewith are repealed insofar as such conflict may exist.
SECTION 3— This ordinance shall be published one time in the "Lodi
News Sentinel", a daily newspaper of general circulation printed and
published in the City of Lodi and shall be in force and take effect
thirty days from and after its passage and approval.

ORDINANCE NO. 1513
AN ORDINANCE OF THE LODI CITY COUNCIL
AMENDING THE CITY'S EXCLUSIVE FRANCHISE
FOR WASTE DISPOSAL SERVICES TO INCLUDE INDUSTRIAL WASTE
WHER2AS, on September 28, 1988 under Ordinance 1433, the Lodi
City Council granted to Lodi Sanitary City Disposal Company, Inc. the
exclusive right to collect all residential and commercial waste within
the City Limits; and
WHEREAS, it now appears necessary and desirable to modify that
Agreement to include the collection of industrial waste; and
WHEREAS, the Lodi City Council hereby dotermines pursuant to
Public Resources Code Section 40059 that the public health, safety and
well being require that refuse collection services in the City of Lodi,
including collection of industrial waste. be provided by means of an
exclusive contract without competitive bidding; and
'riXERZA.S, Lodi Sanitary City Disposal Company, Inc., a California
corporation, is qualified to perform such refuse collection services by
means of such contract in the interests of public health, safety, and
well being;
NOW, THEREFORE, THE LODI CITY COUNCIL ORDAINS as follows:

SECTION 1, The Agreement entered into between the City and Lodi
Sanitary City Disposal Company, Inc. on September 7, 1988 is hereby
amended as described in the Addendum to the Agreement attached hereto.
SECTION 2, All ordinances and parts of ordinances in conflict
herewith are repealed insofar as such conflict may exist.
SECTION 3. This ordinance shall be published one time in the "Lodi
News Sentinel", a daily newspaper of general circulation printed and
published in the City of Lodi and shall be in force and take effect
thirty days from and after its passage and approval.

Dear Council Members:
I am writing regarding the "three cart system" being proposed
by California Waste Removal System.
With the mandates being passed down by the State of California
and with the amounts of recyclable trash being thrown away by the
people of this state, I really feel that we have no choice but to
enforce this proposal. I am sure that there will bf: many people
who will object to this being done, not necessarily because of the
three cart system, but because of the fact that it will cost more
each month to have this plan implemented. You never find anyone
in favor of increases in monthly services. On the other hand,
what is being done for the people, to say nothing of the
environment, cannot be done without an increase.
If people are concerned about this world and what is happening
to it then we seed tc stand together to make it better. This does
not simply mean that the people who can afford it or the people
with families who naturally accumulate more trash should pay for
it. We have all caused this problem. Our parents and
grandparents helped (however unknowingly) create this situation
and now we all need to work together and pay whatever to resolve
it.
Recycling has to be done. Recycling costs money. These are
the facts and we need to accept them in order to make this world a
better place for the children who will inherit it.

My greatest concern regarding this program was the diffi—

Dear Mayor Pinkerton:
The State of California has mandated that cities reduce their land riill useage, I believe mist citizens would agree that
this is the right thing :o do both socially and environmentally.
The three -cart system and the related rate changes proposed by the task force provide a sound starting point in
achieving these goals. Pubtic.awarencss of our need to recycle is not enough if the average citizen feels that the
systren in place is inconvenient er too cumbersome to implement. That's why the three cart system makes sense.
Its easier to implement because there is less sorting on behalf of the citizen and easier to place out on the curbside.
Its unfortunate that we've continued to neglect our responsibility toproperlymanage the disposal ofour solidwaste^s
because increased costs are always associated with corrective measures, However, if the proposed program is
adopted, I believe that progress towards these goals will be made at a reasonable cost increase.
To explore other alternative means cr stop•gnp measures to tackk this issue would only result in more cries of
government "gridlock" and may not end up being cost beneficial considering the time and expense in developing
another program. F=n reading the newspaper articles, California Waste Removal Systems, I= has shown its
willingness to cooperate with the City of Lodi by scaling down the original program. They have a proven track
record in working with the City of Lodi in its waste management programs and in keeping Lodi a clean community
in which to live,
NIB need to step-up our recycling efforts. The plan before you fits into the long-term planning which the City of
Lodi needs to take to preserve our environment and our community.

I would like to comment on the city's proposed recycling
program. I am pleased to see Lodi taking a positive and
practical step to significantly reduce the amount of solid
waste we send to our local landfill. The proposed plan
seems to be both workable and affordable.
For the last four years I have been teaching recycling
and concern for the environment to my third grade class in
Stockton. Children today do realize that our earth is at
risk from the effects of pollution. They also realize that
we adults too often "talk" about environmental problems
without being willing to take action to solve these problems.
I am pleased to see Lodi taking action on this important issue.

Open letter to City Council/Lodi News sentinel '
After reading about the garbage fee hike and all the �ditptites going
on at the City Council meetings I feel a letter of SEJ]�PORT for the
PROPOSED PLAN is necessary.
We as Citizens of Lodi are so concerned about our recycling
programs that we are teaching those programs to kindergarten
students in our schools, we all want Lodi to have the best of
recycling programs, however, we don't want to have to pay for it.
The BUCK CAN'T be the responsibility of California waste Removal
Systems. We all have to do our share so that we will not only
comply with new laws that are going to be imposed on all cities but
to insure that we have a place to put future garbage in the coming
years,
Garbage is something that we all have so why do we think we do not
have to pay to have it disposed of, We have to pay for our sewer
systems, lights, gas, water and all the other services we as humans
need to survive, Garbage is no different -- we use, throw away and
then expect our local garbage man to pick it up for nothing. Sorry
citizens, think again - there is no free ride even on a garbage
truck. There are special circumstances that some of our citizens
may have but I am sure within our city Council they can come up
with a way to solve such problems. It seems that California Waste
has tried to accommodate in every way they can, to help all the
citizens who have special needs, We have dial -a -ride for those who
can't drive themselves to city hall to petition the review board.
Those who can't use dial -a -ride can make petitions in writing or by
calling city hall. So, citizens of Lodi, let's get this program
going and get on with the future business of our community.

had the opportunity in June of 1992 to work with California Waste Removal
Systems as the director and production consultant for a video featuring the 3 cart
system. I spent the better part of ten days working on this production and it
enlightened me to our landfill problem in California.
live and work in Stockton and there is no action being taken here to address
the garbage problem and provide recycling programs. People in Lodi should feel
fortunate to have a waste hauler and a city government with a progressive approach
to these issues. The problem of garbage and landfills is our problem and it is up to
each of us to do our part in solving the problems.
During the taping of the video, I had the opportunity to talk to various
residents about the 3 cart system. While taping on South Pleasant Avenue, we placed
15 sets of carts along the street to set up a shot. Naturally homeowners came out
to see what we were doing and after a brief explanation of the system, I founa
everyone to be receptive about this method. During the segment showing the existing
system of backyard collection I was astounded to see what the drivers had to go
through to access some of these cans. I certainly believe that a curbside collection to
be the best method to collect trash and recyclables.
I understand that a decision to accept the 3 carts in Lodi is before the City
Ccuncil. I certainly hope that council members have had the chance I had to observe
and understand this great system and the wisdom to utilize it. I hope you make it
possible for the rest of Lodi to use it as a way to throw away less and recycle more.

Dear Lodi City Council,
While not an expert on trash management, I have followed the discussions of Lodi's long-
term p!ajis for waste reduction, recycling and trash collection programs. I commend the City
of Lodi, the City Council and California Waste Removal Systems for developing recycling
afterratives to reduce landfill waste.
It appears to me that the proposed increase in garbage rates to fund an aggressive recycling
program will be money wisely spent, Money spent now on the front end of trash
management will reap future dividends through conserving resources and landfill space.
I understand that this garbage rate increase will be an added financial burden on those with
fixed incomes and/or low incomes. The options of a citizens advisory review board appeal or
developing subsidized moneys through a franchise fee would be helpful solutions in limiting
the financial burden on hardship cases.
The lack of backyard pickup in the new collection program will take some getting used to, for
some, but in the long-term the routine of rolling oLq the carts will be just another one of those
things you do during the week. By automating and the three cart system, Cal Waste can
reduce mar -hours and over -time cost for trash service. The $10 monthly surcharge seems a
minimal fee for those that want to pay for the backyard service. For those incapable of
bringing the owts to the curb, they could appeal to the review board. I presume that this
would be a very small minority. The Cal Waste drivers typically know who these people are
and they can work directly with them or they could note on their bill from Cal Waste the need
for backyard pickup.
I am aware of a host of Cal Waste efforts to reduce its costs in managing waste for the City of
Lodi. We should all be thankful that we have such a responsible, progressive and
considerate waste management company as Cal Waste. California Waste Removal Systems
has proven over and over through their responsiveness to community concerns that they ars
"People Who Care" This proposed recycling plan is an example of their desire to be
prepared for the City of Lodi's future waste management.

To the Honorable City Council Nembers:
I am writing in support of Garbage pickup service as suggested
by a Trash Task Force for the new recyling service for Lodi. I
am totally in favor of the program advocated by the Task Force.
The three cart system that the Task Force suggested should be
adopted, as it was designed to meet standards required by the
State.
The cost of the program, even if increased to $20, would be in-
significant to the total cost of most home budgets.
Councilman Sieglock's, recent remark that this is a raid on the
Bank does not relate to reality and I would assume was an unthought
remark.
The $11.90 rate that I am currently charged is a bargain, when you
consider it picks up all my waste at my front door and I do not
have to l if t a finger.
When I relate my garbage pickup fees to my phone, gas, PCE, and
Cable TV, I feel the trash rates are inexpensive.
Since the program has been studied by the Task Force for helping
the City comply with the State mandated reduction, I believe
it is the time to get into action and stop talking, in the words
of Ross Perot.

I have taken the time tDwrite this letter because have been following the articles in the
Lodi News Sentinel about recycling and I would hate to see Lodi lase it's chance iD cxyele more
and dispose of less. I atn aware of the state law that says we as residents of California must recycle
more artdthrow away less crwe are subject iD severe fines. As a business owner and as ares ident
of Lodi, I an concerned about rates as well as what is good for the community socially and
environmentally.
I think the3 cart system w I I provide the means for Lodi to achieve the goals set forth by
state laws and as residents of Lodi, we must do our part to support and participate in such a
program -
Please consider the ahem adves if you do not adopt this program, higher landfill costs, no
future forourchUdmn from an environmental standpoint, and fisc for not meenng state laws.

TOMORROW► ABOUT RECYCLING. THEY ARE LEARNING ABOUT RECYCLING AND
HOW WE CAN IMPROVE OUR ENVIRONMENT IN WHICH WE LIVE.
CALIFORNIA WASTE REMOVAL SYSTEMS HAS PROVEN IN THE PAST THAT
IT CARES ABOUT LODI IN THE FACT THAT THEY EMPLOY MANY LOCAL
RESIDENTS, DONATE: TO MANY ORGANIZATIONS, HELP WITH SCHOOL, FUND
RAISERS THROUGH RECYCLING PROGRAMS AND THE LIST GOES ON AND ON.
WE NEED TO BE AWARE OF WHAT WE DO IN THE PRESENT EFFECTS THE
FUTURE AS WELL. THE DECISION OF ACCEPTING THE 3 C�,R'I' SYSTEM IS A
STEP TOWARD PROGRESS. CALIFORNIA WASTE REMOVAL SYSTEMS BELIEVES IN
THIS FACT, BECAUSE 11' IS WILLING TO COOPERATE WITH THE CITY
REGARDING RATE INCREASES. V1E ASK 'THAT THE CITY COUNCIL WILL USE ITS

plan. What you have been presented appears to be the best long
term solution to meet standards set by the state and to recycle
the greatest amount of materials possible.
The vaccarezza family is a leader and innovator in the waste
industry and has served the city well for many years. bet's let
them do what. they do best and even give them some incentive to
lower costs if they can.

Dear City of Lodi Council Members,
I support the waste reduction, recycling and trash collection
programs proposed by California Waste that are before you this
evening.
I believe the residents of Lodi are fortunate to have a waste
collection company such as California Waste that is innovative and
pro -active in dealing with a concern that each and every citizen of
Lodi comes in touch with - garbage. if it is not addressed now
(which state law does require us to do!, it will no longer exist as just
a concern but yet another problem that everyone will scurry to find
a solution to.
The implications of not dealing properly with our refuge now is a
frightening thought for me and especially for my children and
grandchildren and 1 encourage each council member to vote
favorably for this program.
