SUBJECT: ORIGINATE ANNEXATION PROCEEDINGS FOR THE INDUSTRIAL SUBSTATION AND THE
REMAINING DIEKMAN PARCEL
INDICATED ACTION: that the City Council consider originating the annexation of ;
the 8.1 acre Industrial Substation site and the remaining 7.1 acre Diekman parcel
(i .e. Industrial Substaticn Addition).
BACKGROUND INFORMATION: The combined parcels are adjacent to the Cityy limits on
the north, west an south. As a part of the settlement with the Diekman heirs,
the City agreed to annex the remainder parcel at the time the substation site was
added to the City.
It is in the City's best interest to annex City owned property whenever possible.

INDUSTRIAL SUBSTATION ADDITION
(Diekman Annexation)
The True Point of Beginning being the northwest corner of the Northeast
Quarter of Section 7, T3N, R7E, MDB&M;
thence S87°20'49"E, 533.24 feet along the north line of said Northeast
Quarter and also along the south line of the parcel of land annexed to
the City of Lodi as the "Bischel Addition" described in City of Lodi
Resolution No. 3270 and extending past said "Bischel Addition" along
the south line of the parcel of land annexed to the City of Lodi as the
"Wickes -Foster Addition" in City of Lodi Resolution No. 3920, said
north line of said Northeast Quarter also being the north line of the
Central California Traction Company Railroad right of way (100 feet
wide) and the existing City Limit line;
thence leaving the existing City Limit line, SO°47'19"E, 1232.57 feet,
across the Central California Traction Company Railroad right of way
and along the east line of that 15.16 acre parcel as recorded July 11,
1990 in Book 31 of Surveys at Page 75, San Joaquin County Records, to
the south line of the north one half of Section 7, the north line of
the parcel of land annexed to the City of Lodi as the "Vogel Addition"
described in City of Lodi Resolution No. 2105, and the existing City
Limit line;
thence along the existing City Limit line, N87°33'30" W, 539.08 feet
along said south line of said North one half and also along the north
line of said "Vogel Addition" and the north line of the parcel of land
conveyed to Norman Gertmenian, et ux, by deed recorded March 26, 1948
in Volume 1133, Page 88 Official Records, San Joaquin County Records,
said Gertmenian parcel being also described in the parcel of land
annexed to the City of Lodi as the "Super Mold Addition" described in
City of Lodi Resolution No. 3030;
thence continuing along the existing City Limit line, NO°32'00"W,
1334.40 feet along the west line of said Northeast Quarter and also
along the east line of said "Super Mold Addition" to the True Point of
Beginning, and containing 16.4 acres more or less.

The undersigned, on behalf of the proponents of the subject proposal, hereby
give notice of intention to:

To further deliberations by the Commission, we submit the following:
1. Three (3) copies of this completed "Justification of Proposal"
2. Fifteen (15) copies of legal metes and bounds description of affected
territory consistent with standards acceptable to the County Surveyor's
Office.
3. Fifteen (15) copies of maps showing affected territory and affected
agencies (maps to be no smaller than 831'x 11" which is the most
preferable size and shall be no larger than 18" x 26".
4. Filing and processing fees in accordance with LAFCO fee schedule.
The following persons (not to exceed three) are to be mailed copies of the
Executive Officer's Report and Notice of Commission hearings regarding the
subject proposal.

The City of Lodi provides sanitary sewer, water, storm drainage and
electric power, as well as police and fire protection to all parcels
within the City limits. Natural gas is provided by P.G. & E., and
Pacific Bell provides local telephone service.
Level and Range of Service
The City of Lodi will provide the full level and range of rE au i red
urban services. There is an existing 10" sanitary sewer line, a 10"
water main and it 30" storm drainage line that is accessible from the
north side of the property at Lodi Avenue. The above stated services
will serve the City's proposed electrical substation on the north half
of the property. Upm development of the electrical substation the
City will be extending Thurman Street to the east property line, along
with its 10" sanitary sewer line, 10" water line and 36" storm
drainage line. The southern half of the property will be serviced by
the Thurman Street extensions. There is also a 54" storm drainage
line running along the entire west edge of the property that may serve
both properties. Electricity, natural gas and telephone service are
available to the property.
Availability of Service
All City and public utility company services are available to the
property subject to the City and developer making the necsssary line
extensions.

Improvements Required
When the property is developed, the developer will be required to make
any necessary utility extension.. This will include the following:

4. Streets - extension of Thurman Street to the east property line
will include curbs, gutters, and sidewalks.
Method of Financing
All required service extensions and other improvements will be done by
the City under an agreement that the developers of the Diekman
property will reimburse the City for one half of the street
improvements and extensions of the 8" water, 10" sewer, and 36" storm
drainage lines.
Statement on the Conversion of Prime Agricultural Laid
Development of the City's electrical substation and the Diekman
property will result in the conversion of 14.37 acres of prime
agricultural land. Unfortunately, in Lodi the conversion of prime
agricultural land is unavoidable. All the land in and around the City
of Lodi is prime agricultural land; consequently, it is not possible
to direct development toward non -prime agricultural land.
The electrical substation and the Diekmanproperty is a reasonable
extension of the existing City limits. The properties abut the
existing City limits on the north, south, and west. The north
property fronts on Lodi Avenue and the south property has access to
the extension of Thurman Street. Each or the properties can be served
by City utilities.

FCR APPLICATION 10 THE SAN JOAQUIN COUNTY LOCAL AGENCY FORMATION
COMMISSION IN THE MATTER CF THE PROPOSED 'INDUSTRIAL SUBSTATION
ADDITION" INCLUDING TFE DETAf.1-M13VT OF CERTAIN TERRITORY WITHIN
THE AREA PROPOSED FCR ANNEXATION TO THE CITY CF LODI
WHEREAS, this proposal i s made pursuant to the Local Government
Reorganization Act of 1985, and;
WHEREAS, the nature of the proposed change of organization i s the
annexation to the City of Lodi of a combined area comprising 16.4
acres more or less adjacent to the City limits on the north, west and
south, and withdrawal of said 16.4 acres from the Mokelumne Rural
County Fire District and Northern San Joaquin Water Conservation
District, and located within the area to be annexed to the City of
Lodi, APN 049-070-02, 5200 East Sargent Road, as described in Exhibit
A attached hereto and incorporated herein by reference, the northern
one-half of which property i s to be used for a City of Lodi electric
utility substation, and the southern cne-half to be used for industrial
development by private developers, and;
WHEREAS, no other counties, cities, or districts are affected,
and;
WHEREAS, the subject area proposed to be annexed to the City of
Lodi and detached foil the the Mokelumne Rural County Fire District and
Northern San Joaquin Water Conservation District i s uninhabited, and;
WHEREAS, no new districts are proposed to be formed by this
reorganization, and;
WHEREAS, the reasons for this proposal are as follows:
(1) Use as a City of Lodi electric u ti I i ty substation on the
northern one-half of the property; and use for industrial
development on the southern one-half of the property by
private developers .
(2) The uninhabited subject area is within the urban confines
of the City andwill generate service needs substantially
similar to that of other incorporated urban areas which
require municipal government service;
(3) Annexation to the City of Lodi of the subject area will
resul t in improved economics of scale i n government
operations while improving coordination in the del iveiy of
planning services;
(4) The residents and taxpayers of the County of San Joaquin
wi 11 benefit from the proposed reorganization as a result

of savings to the County by reduction of County required
services in unincorporated but urban oriented area;
(5) The subject area proposed to be annexed to the City of
Lodi is geographically, socially, economically and
politically part of the same urban area of which the City
of Lodi is also a part;
(6) The subject area is within the Lodi Sphere of Influence;
(7) Future inhabitants in the industrial development subject
area will gain immediate response in regard to police and
fire protection, unlimited City garbage and trash
collection service, street lighting service, a modern
sewer system, other municipal services, and improvement of
property values;
NOW, THEREFORF, BE IT RESaV® by the Lodi City Council that the
San Joaquin County Local Agency Formation Commission i s hereby
requested to approve the proposed "Industrial Substation Addition'
which includes annexation of a combined 16.4 acres, and dstachment from
the Mokelumne Rural County Fire District and Northern San Joaquin Water
Conservation District, as described i n Exhibit A attached hereto. This
