BACKGROUND INFORMATION: The Lodi Lake Park NatureArea is a popular destination for walkers and joggers, school groups, bird-watchersand others who enjoy its natural setting and roughlytwo miles of trails. None of the NatureArea's maintained trails reach rivervistas, however, and the City can not afford to expand the trails. The City, however, does have an opportunity apply for State grant funds targeted to acquire, restore, protect and develop river parkways such as the NatureArea trail system. Adopting the attached resolution will allow the City to apply for some of the $30 million available through The Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Bond Act of 2006. This is the final round of this grant program, also known as Proposition 84. If the City's project, the Mokelumne RiverTrails Overlook Project, is funded, the Nature Area trails will be expanded by approximately 725 feet, adding tiro Mokelumne River overlooks and improving approximately 250 feet of existing trails near Pigs Lake. The project also includes interpretive panels at the overlooks that educate visitors on aspects of the river's wildlife and causes of erosion. The cost is estimated to exceed $1 million. The City applied for grant funding in 2008 for a similar project, but one that focused on hardening an eroding riverbank with rip -rap to avoid a collapse of the riverbank next to Pigs Lake. That approach was not welcomed by the grant review committee. This proposal does more to expand the trail system, but does not directly address erosion on the bank near Pigs Lake. it does, however, result in a slightly elevated trail surrounding Pigs Lake that would protecttrails from erosion and provide some flood protection for the Nature Area in the event of high flows on the Mokelumne River, as seen in July 2011. These funds will not be used to rehabilitate the riverbank near Pigs Lake. Staff, however, continues to seek funding for a hydrology study that could lead to a long-lasting solution to riverbank erosion. FUNDING AVAILABLE: Not applicable. fAOD o4mun9ications Specialist Attachments: Resolution, illustration 04, Konradt Bartlam, City Manager RESOLUTION NO. 2011-155 A RESOLUTION OF THE LODI CITY COUNCIL APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE CALIFORNIA RIVER PARKWAYS GRANT PROGRAM UNDERTHE SAFE DRINKINGWATER, WATER QUALITY AND SUPPLY, FLOOD CONTROL, RIVER AND COASTAL PROTECTION BOND ACT OF 2006 (PROPOSITION 84) WHEREAS, the Legislature and Governor of the State of California have provided funds for the program shown above; and WHEREAS, the California Natural Resources Agency has been delegated the responsibility for the administration of this grant program, establishing necessary procedures; and WHEREAS, said procedures established by the California Natural Resources Agency require a resolution certifying the approval of the applications by the Applicant's governing board before submission of said applications to the State; and WHEREAS, the Applicant, if selected, will enter into an agreement with the State of California to carry out the project. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lodi does hereby approve and certify the following actions: 1. Approves the filing of an application for the Mokelumne River Overlook Trails Project; and, 2, Certifies that Applicant understands the assurances and certification in the application; and, 3. Certifies that Applicant or title holder will have sufficient funds to operate and maintain the project(s) consistent with the land tenure requirements; or will secure the resourcesto do so; and, 4. Certifies that it will comply with all provisions of Section 1771.5 of the California Labor Code; and, 5. Certifies that the project will comply with any laws and regulations including, but not limited to, the California Environmental Qualify Act (CEQA), legal requirements for building codes, health and safety codes, disabled access laws, and, that prior to commencementof construction, all applicable permitswill have been obtained; and, 6. Certifies that applicant will work toward the State Planning Priorities intended to promote equity, strengthen the economy, protect the environment, and promote public health and safety as included in Government Code Section 65041.1, and 7. Appoints the Public Works Director, or designee, as agent to conduct all negotiations, execute and submit all documents including, but not limited to applications, agreements, payment requests and so on, which may be necessary for the completion of the aforementioned project.
