COUNCIL COMMUNICATION AGENDA TITLE: Accept Improvements Under Contract for DeBenedetti Park (G -Basin) Storm Drain Improvements Project MEETING DATE: October 5, 2011 PREPARED BY: Public Works Director RECOMMENDED ACTION: Accept improvements under contract for DeBenedetti Park (G -Basin) storm drain improvements project. BACKGROUND INFORMATION: The project was awarded to Teichert Construction, of Stockton, on October 7, 2009, in the amount of $362,168. The contract has been completed in substantial conformance with the plans and specifications approved by City Council on September 2, 2009. This project consisted of installing approximately 870 lineal feet of 72 -inch storm drain pipe, 42 lineal feet of 42 -inch storm drain pipe, one weir structure, three outfall structures, and other incidental and related work. There were two change orders for this project. At the November 17, 2010 meeting, City Council approved Change Orders No. 1 and 2, in the amount of $143,864.73. The delay in accepting the project was due to the above -normal rainfall last year, which prevented the contractor from installing the metal grating at one of the outfall structures. The City has negotiatedwith the G -Basin Storm Pump Station contractor to install the remaining items as water levels permit. The $3,000 cost will be deducted from the retention funds due Teichert Construction after contract acceptance. The total final contract amount is $503,032.73. Following acceptance by the City Council, as required by law, the City Engineerwill file a Notice of Completion with the County Recorder's office. The notice serves to notify vendors and subcontractors that the project is complete and begins their 30 -day period to file a stop notice requiring the City to withhold payments from the prime contractor in the event of a payment dispute. FISCAL IMPACT: There will be a slight increase in the long-term storm drain maintenance of the new facilities. FUNDING AVAILABLE: Storm Drain Impact Fee funds were used for this project. J�, J,,., F.
