BACKGROUND INFORMATION: The California Department of Transportation's Division of Mass Transportation has updated the guidelines for the Public Transportation Modernization, Improvement, and Service Enhancement Account (PTMISEA) Proposition 1B Programto include certifications and assurances documents. This update is in response to new California State Auditor requirements. The certifications and assurances requirement began in January 201 1 and continues until the end of the program. Each PTMISEA project sponsor is required to sign the certifications and assurances document prior to receiving a fund allocation for Fiscal Year 2010/1 1 or later. The certifications and assurances documents contains general conditions of the PTMISEA program already stated in the guidelines, as well as some additional cost principles and record retention requirements that are standard for other State -funded projects. Each agency only needs to sign and submit the document once for the remainder of the PTMISEA program. FISCAL IMPACT: Execution of the certifications and assurances documents is necessary to receive PTMISEAfunds. FUNDING AVAILABLE: Not applicable. F. Wally S elin PublicWorks Director Prepared by Paula Fernandez, Transportation Manager/Senior Traffic Engineer cc: Aaron Hoyt, SJCOG Transportation Manager/Senior Traffic Engineer APPROVED: Bartlam, City Manager K:\WP\TRANSIT\CPTMISEA CertAssur.doc 7/5/2011 RESOLUTION NO. 2011-118 A RESOLUTION OF THE LODI CITY COUNCIL AUTHORIZING AND DIRECTING THE TRANSPORTATION MANAGER TO EXECUTE CERTIFICATIONS AND ASSURANCES DOCUMENTS FOR THE PUBLIC TRANSPORATION MODERNIZATION, IMPROVEMENT, AND SERVICE ENHANCEMENT ACCOUNT BOND PROGRAM WHEREAS, the City of Lodi is an eligible sponsor and may receive state funding from the Public Transportation Modernization, Improvement, and Service Enhancement Account (PTMISEA) now or sometime in the future for transit projects; and WHEREAS, the statues related to state -funded transit projects require a local or regional implementing agency to abide by various regulations; and WHEREAS, Senate Bill 88 (2007) named the Department of Transportation (Department) as the administrative agency for the PTMISEA; and WHEREAS, the Department has developed guidelines for the purpose of administering and distributing PTMISEA funds to eligible project sponsors (local agencies). NOW, THEREFORE, BE IT RESOLVED by the Lodi City Council that the City of Lodi agrees to comply with all conditions and requirements set forth in the Certifications and Assurances document and applicable statues, regulations and guidelines for all PTMISEA funded transit project; and BE IT FURTHER RESOLVED that the City Council hereby authorizes and directs the Transportation Manager to execute all required documents of the PTMISEA program and any amendments thereto with the California Department of Transportation.
