City Council Amending Lodi Municipal Code Chapter 3.12 - 'Transient
Occupancy Tax' by Adding Thereto a Nov Subsection 3.12.035 Entitled
'Surcharge' "

RECOMMENDED ACTION Following reading by title, it would be appropriate for the
City Council to adopt Ordinance No, 1515.
BACKGROUND P4il MATION Ordinance No. 1515 entitled, "An Ordinance of the Lodi City
Council Amending t o d i Municipal Code Chapter 3.12 -
'Transient Occupancy Tax' by Adding Thereto a Nov
Subsection 3.12.035 Entitled 'Surcharge"' was introduced at
the adjourned regular meeting of the Lodi City Council held
June 20, 1991. This ordinance will be in force and take
effect immediately upon its passage and approval.
Pursuant to State statute, ordinances may be adopted five days after their
introduction following reading by title.
This Ordinance has been approved as to form by the City Attorney.

AN ORDIlVANM OF THE LODI CITY COUNCIL
AINENDING LODI MUNICIPAL CODE CHAPTER 3.12 - "TRANSIENT GCCUPANCY TAX",
BY ADDM THERETO A NEW SUBSBCTION 3.12.035 ENTITLED "SURCHARGE"
BE IT ORDAINM BY THE LODI CITY COUNCIL AS F0M0A :
SECTION 1. Lodi Municipal Code Chapter 3.12 - "Transient Occupancy
Tax", is hereby amended by adding thereto a new subsection 3.12.035
entitled "Surcharge", to read as follows:
"3.12.035 Surcharge.
A. In addition to the six percent transient
occupancy tax imposed by Section 3.12.030 of
this Code, there is hereby added a surcharge of
an additional three percent, for a total of nine
percent of the rent charged by the operator, for
the privilege of occupancy in any hotel. This
surcharge shall be subject to all other
conditions and terms specified in Section
3.12.030 and shall be for the usual current
expenses of the City.
"S. The provisions of this section are
severable. Should any portion of .his Chapter
be deemed invalid by a court of competent
jurisdiction, the provisions of Section 3.12.030
shall remain in full force and effect."

SECTION 2. ordinances and parts of inances in conflict
herewith are rep,,led insofar as such conflict may exist.
SECTION 14. This ordinance is for the usual and current expenses of
the City and is adopted pursuant to Government Code § 36937(d). This
ordinance shall be published one time in the Lodi News Sentinel, a
daily newspaper of general circulation printed and published in the
City of Lodi and shall be in force and take effect immediately upon its
passage and approval.
