RECOMMENGED ACTION: 1. Council consideration of extending the existing
moratorium on second residential units in the eqst
side rezoning area for a period of 10 months and 15
days;
2. Council adoption of the attached report
describing measures taken to alleviate the situation
which lead to the moratorium.
BACKGROUND At the June 20, 1990 Council meeting, an urgency
ordinance was adopted by the Council, imposing a
moratorium on second residential units ("granny
units") in the east side rezoning area. This was deemed necessary based on
the inadequacy of certain City facilities available in this area.
This ordinance is valid for a. period of 45 days from its adoption. Under
Government Code §65858(b), it is necessary that not later than 10 days prior
to the expiration of this 45 -day period, that the Council adopt or issue a
report describing the steps which have been taken or are to be taken to deal
with the situation. That has been prepared by Public Works and is attached
hereto.
An extension of 10 months and 15 days now appears adequate the purpose of
drafting and implementing a plan to ensure that adequate water and sewer
facilities are available for those properties in the east side area upon which
"granny units" might be placed.
It is therefore recommended that the Council extend the ordinance f c r 10
months and 15 days, and adopt the attached report.

Subj: EAST SIDE R AREA SECOND RESIDENTIAL UNIT MORATORIUM
Under Government Code §65858(d), when an urgency moratorium on
development is adopted, the Council is required to issue not later than 10
days before the first extension of such ordinance, a report on steps taken
to alleviate the situation on which the action was based. The ordinance
adopted at the June 20, 1990 Council meeting expires August 4, 1990. The
Council meeting of J�Ay 11, 1990 is the only regularly -scheduled meeting
before that date.
In order to meet the time requirements, it is recommended that the Council
adopt this memornandum as its report on the situation and extend the
ordinance 10 months and 15 days to June 19, 1991.
REMEDXAL STEPS:
The east side rezoning area represents the majority of the portions
of the City served by substandard water and wastewater lines.
Additional units i n these areas will reduce water pressure for
adjacent residences and could overload wastewater lines.
Since the adoption of the ordinance, Public Works and Community
Development staff have met with the City Attorney to determine a
course of action. It was noted that:
o Although some parcels in the subject area could not accommodate
second units, there are likely to be lots within the zone for
which services are adequate to support a second unit.
o While the moratorium as adopted does not apply to subdivisions,
those are few in number and adverse impacts can be addressed
through conditions placed on the tentative map.
It is recommended that moratorium be extended until a set of public
services evaluation criteria can be developed in order to assess the
impact of any second residential units within the City, and specifically
within the east side rezoning area. These criteria would be a screening
tool that would indicate whether additional engineering analysis is
needed. it is also recommended that this criteria be established after
the adoption of the General Plan in the fall of 1990, but prior to
determination of the recommended extension.
