AGENDA TITLE: Acceptance of Improvements at 1301 East Vine Street
MEETING DATE: June 3, 1992

ACTION: That the City Council adopt the attached resolution accepting
the development improvements for 1301 East Vine Street.
BACKGROUND INFORMATION: Improvements at 1301 East Vine Street have been completed
in substantial conformance with the requirements of the
Improvement Agreement between the City of Lodi and MCP
Investments, dated July 11, 1989, as shown on Draw ngs
No, 88D101 through 88D104, and as specifically set forth in the plans and
specifications approved by the City Council.
No street dedications were made with this development.

ACCEPTING THE DEVELOPMENT IMPROVEMENTS INCLUDED IN THE DEVELOPMENT
AGREEMENT FOR 1301 EAST VINE STREET

The City Council of the City of Lodi finds:
1. That all requirements of the Development Agreement between the
City Lf Lodi and MCP Investments dated July 11, 1989 for the
development improvements for 1301 East Vine Street have been
substantially complied with. The improvements .are shown on
Drawings Nos. 8SD101 through 8SD104 on file in the Public Works
Department.
2. No street dedications were made with this development.

I hereby certify that Resolution No. 92-100 was passed and
adopted by the City council of the City of Lodi in a regular meeting
held June 3, 1992 by the following vote:

The City Council of the City of Lodi, at its meeting on June 3, 1992,
accepted the public improvements in the subject project. A copy of the
resolution is enclosed,
This letter is your authorization to exonerate the bond covering faithful
performance. The bond covering labor and materials must remain in effect
until September 1, 1992 in conformance with the requirements of State
law, You will receive no further correspondence regarding the release of
the bond for labor and materials unless a claim is filed,

The City Council of the City of Lodi, a t its meeting on June 3, 1992,
accepted the public improvements that were made in the subject project.
Enclosed for your files is a copy of the resolution accepting the public
improvements. From the date of the resolution, the City of Lodi will
maintain the street and other public improvements installed within
rights-of-way and public utility easements as shown on the approved plans.
A copy of this letter will be sent to your bonding agency in order that
the bond covering faithful performance can be exonerated. The bond
covering labor and materials will have t o remain i n effect for a period of
90 days from the date of the resolution in conformance with State law. On
September I, 1992, this instrument can be released if no claims have been
filed.
