requirement of the collection and d isposal ` of
infectious waste i n the City of Lodi (Exhibit A), and
introduce Ordinance Na 1486 amending the Municipal Code of the City of Lodi to
reflect same (Exhibit B),
BACKGROUND INFORMATION: Sanitary City Disposal Co., Inc. i s desirous of
removing itself firm the business of the collection
and disposal of infectious waste generated i n the
City of Lodi. Staff i s i n concurrence with this
request. The collection and disposal of infectious
waste has become a highly technical field; an operation performed by
specialists. It is in the City's best interest that this activity no longer be
performed by the City's contract hauler. Private sector generators of
infectious waste, i.e. hospitals, doctors' offices, convalescent facilities,
will be free to negotiate collection and disposal arrangements with companies
specialized in this field. The market will dictate the collection and disposal
costs .

IT IS AGREED by and between the parties hereto that the original
agreement shall be amended in the following fashion to delete therefrom''

franchisee's exclusive right to collect infectious waste in the City of
Lodi:

A. Section 1(a) shall be amended to delete from the definition of
"refuse" all infectious waste, and this section shall hereafter read
as follows:
"a. Refuse
Any and all discarded items and substances of every kind,
including salvageable or recyclable materials, and garden wastes,
tut not including infectious wastes, sewage, septic tank
contents, sand trap contents, grease trap contents, or hazardous
wastes as defined by state and/or federal law."
IN WITNESS WHEREOF, the parties hereto have set their hands the day
and year first hereinabove mentioned.

CHAPTER 13.16
SOLID WASTE
Section 13.16.010 DEFINITIONS. '
{
For the purposes of this chapter, unless otherwise apparent from
the context, the following definitions apply:
1. "Refuse" means any and all discarded items and substances of _
every kind, including WWIM WW AAA salvageable or
recyclable materials, and garden wastes, but not including infectious
wastes, sewage, septic tank contents, or hazardous wastes as defined by
state and/or federal law."
SECTION 2. All ordinances and parts of ordinances in conflict
herewith are repealed insofar as such conflict may exist.
SECTION 3. This ordinance shall be published one time in the "Lodi
News Sentinel", a daily newspaper of general circulation printed and
