Reimche C it y Clerk 15.20.010 ADOPTION The provisions set forth in the "Uniform Fire Code, 1988 Edition", together with the appendixes I—A, I—B, I—C, 11—A, II—B, II—C, II—D, II—E, III—A, III—C, III—D, IV—A, V—A, VI—A, VI—B, VI—D thereto, are hereby adopted as the fire prevention code of the city. The fire prevention code of the city shall apply in all matters pertaining to storage, handling and use of hazardous substances, materials and devices; and to conditions hazardous to life and property in the use or occupancy of buildings or premises within the city. 15.20.020 AMENDED BY ADOPUM OF 1989 SUPPLEMENT The "Uniform Fire Code, 1988 Edition" is hereby amended by adopting the 1989 Supplement to the Uniform Codes relating to the Uniform Fire Code, Uniform Fire Code Appendix and the Fire Code Standards, as promulgated by the International Conference of Building Officials and the Western Fire Chiefs Association, and by this reference is made a part of this ordinance with the force and effect as though set out herein in full. 15.20.030 BUREAU OF FIRE PREVENTION The Bureau of Fire Prevention is established in the Fire Department of the City of Lodi and which shall be operated under the supervision of the chief of the Section 2.103b of the "Uniform Fire Code, 1988 Edition" adopted by Section 15.20.010 is added to read as follows: All sworn members assigned to the Fire Prevention Bureau are hereby assigned as Arson Investigators and as such shall enforce the provisions of the California Penal Code as it pertains to arson. 15.20.070 SECTION 2,105 AMENDED AUTHORITY OF FIRE PERSONNEL TO EXERCISE POWERS OF POLICE OFFICE}' Section 2.105 of the "Uniform Fire Code, 1988 Edit -ion" adopted by Section 15.20.010 is amended to read as follows: The Fire Chief and members of the Fire Prevention Bureau shall be peace officers as described in Section 830.31 of the California Penal Code. 15.20.080 SECTION 2.303 AMENDED APPEALS Section 2.303 of the "Uniform Fire Code, 1988 Edition" adopted by Section 15.2G.010 is amended to read as follows: Whenever the Fire Chief disapproves an application or refuses to grant a pernit applied for, or when it is claimed The Fire Chief further shall have the power to revoke, suspend, or deny the granting of any permit required pursuant tc the provision of the Code for any of the following reasons: (a) When deemed necessary for the protection of life, limb, or property; or (b) For the violation of any provisions of this Code; or (c) For changing the occupancy, equipment, materials, processes, or other conditions in such a manner as to create a greater danger of fire or explosion or less protection than was present at the time of the issuance of such permits. 15.20.110 SECTION 4.109 ADDED FEES Section 4.109 of the "Uniform Fire Code, 1988 Edition" adopted by Section 15.20.010 is added to read as follows: A schedule of fees may be established to be charged and collected for plan checking, inspection services, and for the issuance of permits pursuant to Section 4.108 of this Code. Section 10.306(d) of the "Uniform Fire Code, 1988 Edition" adopted by Section 15.20.010 is deleted. 15.20.220 SECTION 10.306(i) ADDED AUTOMATIC FIRE EXTINGUISHING SYSTEMS Section 10.306(1) of the "Uniform Fire Code, 1988 Edition" adopted by Section 15.20.010 is added to read as follows: In addition to the requirements specifed in Sections 10.306(a) through 10.306(h), automatic sprinkler systems shall be installed and maintained in an operable condition in the following locations and in the following buildings hereafter constructed, remodeled ur changed in occupancy regardless of the installation of area separation walls: (:1) Every building hereafter constructed in which the total floor area is 6,000 square feet or more. (2) Every building hereafter constructed of three or more stories as defined in the Uniform Building Code. (3) Every building hereafter remodeled when the cost of remodeling exceeds $100,000.00 and the total floor area is 6,000 square feet or more. The S100,000.00 valuation shall be based or, Building Valua'.ion Data 15.20.230 SECTION 10.314 ADDED REGULATED SYSTEMS Section '.0.314 of the "Uniform Fire Code, 1988 Edition" adopted by Section 15.20.010 is added to read as follows: Appendix III -C of the "Uniform Fire Code, 1988 Edition" shall apply to all Fire Sprinkler Systems, Standpipes and Combination Systems installed, regardless if the system was installed as a requirement of any code or not. The date of installation or the date of an approved inspection conforming to the requirements of Appendix III -C shall be used when applying interval periods. 15.20.240 SECTION 11.101 DELETED BONFIRES AND OUTDOOR RUBBISH Section 11.101 of the "Uniform Fire Code, 1988 Edition" adopted by Section 15.20.010 is deleted. 15.20.250 SECTION 11.105 - DELETED ARTICLE 1 1 , DIVISION 1 SECTION 11.115 Section 11.105 through Section 11.115 of the "Uniform Fire Code, 1988 Edition" adopted by Section 15.20.010 are deleted. 15.20.260 SECTION 11.117 ADDED OUTDOOR FIRES PROHIBITED Section 11.117 of the "Uniform Fire Code, 1988 Edition" adopted by Section, 15.20.010 is added to read as follows: No. person shall. kindle or maintain any outdoor fire within the =:linki.ts of....:.the:..C.ty.;.of Iodi, except that this section shall not. p=�hibit those.;fir.es.t.iat are approved by the Fire Chief for 'the :1.ollowing purpo`s:est, a, The prevention of a fire hazard which cannot be abated by any tither r,eans, ;. b. Nothing in this section shall be construed as prohibiting open outdoor fires used only for cooking food for human consumption where such use is accomplished in an approved fireplace or barbecue pit, or for recreational purposes in areas approved by the Fire Chief, provided that the material burned does not produce a dense smoke or offensive odor, 15.20.270 SECTION 11.118 ADDED CONSTRUCTION SITES Section 11.118 of the "Uniform Fire Code, 1988 Edition" adopted by Section 15.20.010 is added to read as follows: No fires shall be permitted to burn on any construction site for any purpose. This section is not to prohibit the use of devices or tools producing a flame when used in an approved manner and necessary for the construction of the building. 15.20.280 SECTION 11.205c ADDED LIGHTED CANDLES AND OTHER OPEN FLAME DEVICES Section 11.205c of the "Uniform Fire Code, 1988 Edition" adopted by Secticn 3:5.20.010 is added to read as follows: No person shall place or maintain, or permit to be placed or maintained, any lighted candle on any tree or shrub, or use or maintain any candle or other open flame device in any building or place in such a manner as to create a hazard to life or property as determined by the Fire Chief. 15.20.290 SECTION 11.208 DELETED PARADE FLOATS Section 11.208 of the "Uniform Fire Code, 1988 Edition" adopted by Section 15.20.010 is deleted. Section 11.211 of the "Uniform Fire Code, 1988 Edition" adopted by Section 15.20.010 is added to read as follows: All buildings and premises shall be maintained in good repair and in a clean and orderly manner, free from any Condition that presents a fire hazard or a condition which would contribute to the rapid spread of fire. 15.20.320 SECTION 11.212 ADDED ELECTRICAL DISCONNECT Section 11.212 of the "Uniform Fire Code, 1988 Edition" adopted by Section 15.20.010 is added to read as follows: All buildings providing electrical service through more than one (1) service meter or through multiple service connections, shall have each main electrical disconnect identified in a manner approved by the chief indicating areas or units served. 15.20.330 SECTION 11.2 13 ADDED GAS DISCONNECT Section 11.213 of the "Uniform Fire Code, 1988 Edition" adopted by Section 15.20.010 is added to read as follows: A 1 1 buildings providing natural gas service through more that one (I) service meter or through multiple service connections, shall have individual gas shut— offs identified in a manner approved by the chief indicating areas or units served. 15.20.340 SECTION 11.411 AMENDED VACATING PREMISES Section 11.411 of the "Uniform Fire Code, 1988 Edition" adopted by Section 15.20.010 is amended to read as follows: Upon vacating or abandoning any premises, the owner or occupant thereof shall remove any and all noxious and The Fire Chief may require that copies of inspection reports be forwarded to the Bureau of Fire Prevention. 15.20.360 SECTION 14.109 ADDED ALARM SYSTEM WIRING Section 14.109 of the "Uniform Fire Code, 1988 Edition" adopted by Section 15.20.010 is added to read as follows: A 11 wiring referred to in Section 2-2 of the "Uniform Fire Code Standards NO. 10-2, 1988 Edition" shall be installed in electrical metallic conduit. 15.20.370 SECTION 25.115 — DELETED CANDLES AND OTHER OPEN SECTION 25.116 FLAME DEVICES Section 25.115 and Section 25.116 of the "Uniform Fire Code, 1988 Edition" adopted by Section 1.5.20.010 are deleted. 15.20. 380 SECTION 77.106b LIMITS EXPLOSIVE AND BLASTING AGENTS The 1 i m i t s referred to in Section 77.106b of the "Uniform Fire Code, 1988 Edition" adopted by Section 15.20.010 in which the storage of explosives and blasting agents is prohibited is the entire city except in areas zoned M-2 as such zone is defined in the zoning regulations of the City. 15.20.390 SECTION 78.102a AMENDED MANUFACTURING OF FIREWORKS Section 78.102a of rhe "Uniform Fire Code, 1988 Edition" adopted by Section 15.20.010 is amended to read as follows: The manufacture of fireworks within the 1 i m i t s of the City of Lodi is prohibited. 15.20.400 SECTION 79.110 AMENDED OPERATING HEATING, LIGHTING, COOKING APPLIANCES hazardous ;v-aterial or waste matter which has been d e p o s i t,ed a,ll'owed" to:,come'::to rest or 1 ermitted to accumulate thereon; :--.and -'such such prems ses shall be I eft in `a. clean and neat .condition..''; =15.20.350. The prescribed periodic inspection interval for fire alarm systems shall be quarterly. The Fire Chief may limit the number of flammable liquid tanks that are scored on any property. The storage of tanks shall be as approved by the Fire Chief. _5.20.420 SECTION 79.501 LIMITS STATIONARY TANK STORAGE, ABOVEGROUND OUTSIDE OF BUILDINGS The limits referred to i n Section 79.501 of the "Uniform Fire Code, 1988 Edition" adopted by Section 1.5.20.010 i n which the storage of Class I and Class II liquids in aboveground tanks outside of buildings is prohibited in the entire city except areas zoned C—M, M-1 and M-2 as such zones are defined in the zoning reguiations of the city. 15.20.430 SECTION 79.902c AMENDED SPECIAL EXCLOSURES Section 79-902c of the "Uniform Fire Code, 1988 Edition" adopted by Section 15.20.010 is amended to read as follows: Special Enclosures. When installation of tanks in accordance with Division VI is impractical or because of property or building limitations, tanks for Class I, II or III—A liquids may be installed in buildings if enclosed as follows: Enclosure shall be liquid tight and vapor tight with out backfill. Sides, top and bottom of the enclosure shall be of reinforced concrete at least 6 inches thick, with openings for inspection through the top only. Tank connections shall be so pi_)ed or closed that neither vapors nor liquid can escape into the enclosed space. i•1eans shall be provided whereby portable equipment may be employed to discharge to the outside any vapors which might accumulate should leakage occur. Tanks containing Class I, II or III—A liquids providing storage within a special enclosure in a building or in an outside aboveground special enclosure shali not exceed 1100 gallons individually or 1100 gallons aggregate per parcel. The .storage of Class I, II or 1117A flammable or combustible.liquids'within a special enclosure in a building or in an 0utside'aboveground special enclosure is prohibited except 'areas zoned C=M, M-1 and M-2, as such zones are defined in the zoning regulations. Class I or Class II liquids may be dispensed into the fuel tank of a motor vehicle from an outdoor aboveground special enclosure conforming to this section. { Outside aboveground special enclosures shall have tanks enclosed by reinforced concrete at least 6 inches thick and 71 shall bear an Underwriters's Label. Fill opening shall be equipped with a closure designed so that it may be locked. Outside aboveground special enclosures shall be at least 10 5- feet from any building or combu.tible storage and so located as such additional distance shall be provided as will ensure that any vehicle, equipment or container being filled directly from such tank shall be not less than 10 feet from t any structure or other combustible. Outside aboveground special encicsures shall be kept at least 5 feet from t property line and public ways. Flammable and combustible liquids shall not be transferred from aboveground special enclosures by gravity discharge. Electrical controls shall 'r.2et all requirements of Section 79.903e of the "Uniform Fire Code, 3988 Edition". Dispensing devices shall conform to Section 79-903c of the "Uniform Fire Code, 1988 Edition" . Vents shall meet all requirements of Section 79.604 of the "Uniform Fire Code, 1988 Edition" . Portable fire extinguishers with a minimum classification of 2A, 20B:C shall be provided and so located that it will be not more than 75 feet from any pump. A conspicuous sign prohibiting smoking, and requiring the motor to be shut off during fueling operations shall be posted. Aboveground special enclosures shall display a flammable placard on both sides of the special enclosure on opposite corners, the type and material stored shall also be displayed directly below- the flammable placard. The grade of the land shall be such that a fuel spill will. not drain to a storm drain, building or other exposure. Protection against physical damage shall be provided as required by the Fire Chief. 15.20.440 -Section 79.903(e) AMENDED EXCEPTION ADDED Section 79.903e of the **Uniform Fire Code, 1988 Edition" adopted by Section 15.20.010 is amended to read as follows EXCEPTION: Dispensing of Class II liquids into the fuel tanks of motor vehicles from an approved aboveground fuel dispensing system for private, nonretail use when in conformance with Section 79.913 15.20.450 Section 79.913 ADDED DISPENSING INTO FUEL TANKS OF P10TOR VEHICLES FROM ABOVEGROUND TANKS Section 79.913 of the "Uniform Fire Code, 1988 Edition" adopted by Section 15.20.010 is added to read as follows: SCOPE This section shall apply to new and existing locations. Existing locations not in compliance with this section may continue the non—conforming use until January 1, 1992 at which time compliance with this section shall be met or the use discontinued TANK CONSTRUCTION Aboveground tanks used for dispensing of Class II liquids into the tanks of motor vehicles are prohibited except in areas zoned M-2. Tanks shail be built to meei Underwriters Laboratories Inc., Standard for Steel Aboveground Tanks for Flammable and Combustible Liquids, U.L. 142 Tanks shall be securely supported by concrete, masonry or protected steel. Tanks supports shall rest on foundations of concrete. Tank foundations shall be designed to minimize the possibility of uneven settling of the tank. Steel supports for tanks shall have a fire resistance rating of not less than two hours, except that solid web steel sadd1.es need not be protected if less then 12 inches at their lowest point. Design of supports shall be in accordance with Section 79.505(d) of the Uniform Fire Code, 1988 Edition 'rormal venting and emergency venting shall neet all requirements of Section 79.509 of the "Uniform Fire Code, I988 Edition". All connections, fittings or other appurtenances shall be installed in accordance with Division VII, "Piping, Valves and Fittings." Tanks containing: C1:a;s II liquids shall not exceed 12,000 gallons a'nd sh all be limited to one tank per parcel. CONTAINMENT WALL A containment wall of concrete or masonry shall be constructed regardless of tank construction and shall be designed to contain 110 percent of the tank capacity. The containment wall shall have no side closer than 15 feet to any property line or building. The minimum distance between tanks and the interior containment walls shall be not less than 3 feet and not more than 5 feet. Containment walls shall not be less than 3 feet in height and not more than 5 feet in height. Provision shall be made for removing water from the containment area in accordance with Section 79.507. Rain water drainage should be designed to exit below floor surface. Piping shall not be allowed to pass through containment walls. The containment area shall be kept free of combustible material, empty or full drums or barrels. ELECTRICAL Electrical controls shall meet all requirements of Section 79.903e of the "Uniform Fire Code, 1988 Edition". DISPENSING SYSTEMS Dispensing systems shall not be by gravity feed and shall be designed Lo limit the quantity dispensed to 150 gallons each activation of the dispensing system Dispensing pumps shall be installed at the top of the tanks. A normally closed solenoid valve is to be installed on the outlet of the dispensing pump. This valve is to be electrically k,ired so that it will open when the pump is operating. Dispensing devices stall conform to Section 79-903c of the "Uniform Fire Code, 1968 Edition". Each pump shall have installed on the discharge an approved leak -detection device �,,hich will provide an indication ii. the piping and dispensers are not essentially liquid tight. The grade of the land shall be 'such.that a fuel spill will not drain to a storm drain;; building or other ..... ........ ...:..... . exposure. The system site shall be provided with a fire alarm transmitting device. Such a device may be a telephone not requiring a coin to operate. 15 .20.460 SECTION 79.1401b ADDED FLAHMABLE LIQUID BULK PLANT Section 79.1401b of the "Uniform Fire Code, 1988 Edition" adopted by Section 15.20.010 is added to read as follows: New bulk plants for flammable or combustible liquids are prohibited in the entire city except in the area zoned M-2 as such zone is defined in the zoning regulations of the City of Lodi. 15.20.470 SECTION 82.104b LIMITS LIQUID PETROLEUM GAS STORAGE LIMITS The limits referred to in Section 82.104b of the "Uniform Fire Code, 1988 Edition" adopted by Section 15.20.010 in which the storage of liquified petroleum gas is prohibited is the entire city except areas zoned 1`1-2 as such zone is defined in the zoning regulations of the City of Lodi. 15.20.480 APPENDIX I— A, AMENDED EFFECTIVE DATE SECTION 1 b Appendix I—A, Section lb of the "Uniform Fire Code, 1988 Edition" adopted by Section 15.20.010 is amended to read as follows: Within 90 days from the date of written notification to the building owner and occupant requiring compliance of this appendix, plans for compliance shall be submitted and approved, and within 12 months thereafter the work shall be completed or the building shall be vacated until made to conform.
