BACKGROUND INFORMATION: California Government Code Section 3500 et seq., commonly
known as the Brown Act, provides that public employees have a
rightto organize and bargain collectively or individually with local
government public employers over wages, hours and other terms and conditions of employment. In order
to conduct the City's labor relations program it is necessary for the City Council to meet in closed session
from time to time to provide direction and authority. Government Code Section 54957.6 provides that
prior to a closed session meeting with its negotiatora local agency must hold an open session in which
the agency identifies its designated labor representative. As such, it is recommended that the City
Manager be designated as the City's labor negotiatorfor purposes of discussing the Electric Utility
Director and Interim City Manager positions later this evening in Closed Session.
