HomeMy WebLinkAboutAgenda Report - April 4, 1990 (41).s, a i C O U N C I L C 0 M M U N I C A T 1 0 N TO: THE CITY COUNCIL COUNCIL MEETING DATE FROM: THE CITY MANAGER'S OFFICE APRIL 4, 1990 SUBJECT: CONSIDER CITY COUNCIL COMPENSATION PREPARED BY: City Manager RECOMMENDED ACTION: Council consideration of an ordinance authorized by Government Code Section 36516, setting Council salaries at the specified statutory amount. BSD INFORMATION: California Government Code Section 36516 establishes salaries for council members of general law cities, based on population. Under this section, the Council in 1985 set the salary at $400 per month, which was the allowable rate for cities having populations of between 35,000 and 50,000. There have been no increases since that time. Under subsection (a)(3) of this statute, council members' salaries in cities with populations exceeding 50,000 but less than 75,00 may be set at up to $500 per month. It is noted that Lodi's population was expected to exceed 50,000 in October 1989, and our city limit signs were changed to reflect that figure. In order to increase the council salary to that which the statute authorizes, the population determination must be based on an estimate validated by the California State Department of Finance, which issues such figures yearly on May 1. It is assumed that figure will confirm the population as being in excess of 50,000. Should the Council choose to adopt this ordinance, under the terms of Government Code Section 36516.5 and Municipal Code Section 2.08.030, the increase cannot become effective until following the November 1990 Council election. Section 2.08.020 of the Lodi Municipal Code relating to city cil salaries is hereby amended as authorized by ' Govemment Code Section 36516 (a) (3) to read as follows: "Each nxn1ber of the council of the City shall receive, as salary, the sum of five hundred dollars ($500)per month, as prescribed in Govemment Code Section 36516(a)-(3) in cities over fifty thousand up to and including seventy five thousand inpopulation, which shall be effective December 6, 1990 and shall be payable from and after the operative date of the ordinance codified in this chapter at the same time and in the same manner as the salaries are paid to other officers and employees of the city." SECTION 2. All ordinances and parts of ordinances in conflict herewith are repealed insofar as such conflict may exist. SECTION 3. This ordinance shall be published one time in the "Lodi News Sentinel", a daily newspaper of general circulation printed and published in the City of Lodi and shall be in force and take effect thirty days from and after its passage and approval.
