AGENDA TITLE: Adopt Resolution Rescinding Resolutions No. 2005-83 and 2010-138 and Revising
the Name and Purpose of the Lodi Budget/Finance Committee

RECOMMENDED ACTION: Adopt Resolution rescinding Resolutions No. 2005-83 and 2010-138
and revising the name and purpose of the Lodi BudgetlFinance
Committee.
BACKGROUND INFORMATION: The Lodi City Council formed the Lodi BudgetlFinance Committee
by Resolution 2005-83. Subsequently, the Council revisedthe
membershipfrom seven to five members by Resolution 2010-138.
Council discussed the continuation and purpose of the Committee at the regular Council meeting of
November 17, 2010 and at the Shirtsleeve session of February 8, 2011. At the February 8,201 1
meeting, Council provided general direction to staff to draft a resolution setting forth the specific purpose
of the Committee.
Much of the discussion regarding the Committee has revolved around the purpose and charge for the
group. Since its inception, the Committee has struggled with its role in relation to the City management.
Much discussion has occurred within the Committee as to who would determine agenda items for the
group. Some current and former members believe that the Committee should have the authority to
investigate any element of city operations it wishes underthe theory that all city operations have a
budgetary/financial impact. Some believe that the Committee should have the authority to determine its
own agenda and should not be dependent upon city staff or Council to set agenda items. Some believe
that the committee should meet regularly with the Council. City staff does not believe that this committee
should function as a "citizen audit body" in relation to city operations and be allowed to determine its own
agenda, as that was not its purpose when created in 2005.
Staff is not recommending any changes to the purview of the Committee; that of advising the City Council
and City Manager on financial related matters. However, staff is recommending that the Committee be
charged with only providing input on items that are brought to it by the Council as a whole, by the City
Manager or by the Deputy City Manager as the liaison for the Committee. Further, staff is recommending
that the name of the Committee be changed to the Lodi Finance Committee to more properly reflect the
nature cf the work items that are likely to be brought before the Committee. The attached resolution
clarifies the purpose and name of the Committee as noted above.
As an alternative, the Council could choose to disband the Committee.

A RESOLUTION OF THE LODI CITY COUNCIL tr
RESCINDING RESOLUTION NOS. 2005-83 AND 2010-
138, AND FURTHER REVISING THE LODI FINANCE
COMMITTEE
WHEREAS, the Lodi City Council directed that a Lodi Budget/Finance
Committee be established in Resolution 2005-83; and
WHEREAS, the Lodi City Council revised the membership of the Lodi
Budget/Finance Committee in Resolution 2010-138; and
WHEREAS, the City Council desires to revise certain items relating to its
establishment;
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby
rescind Resolution Nos. 2005-83 and 2010-138, and re-establishes the Lodi Finance
Committee as follows.
1. Membership. Effective March 16, 2011, the membership shall consist of five (5)
members appointed by the Mayor and approved by the City Council in accordance
with the procedure outlined in Resolution 2003-156. Standing members are hereby
re-appointedfor the reminder of their pre -established terms.
2. Term of Office of Members. The term of office of the members of the Committee
shall be four (4) years. Current members of the Committee shall complete their
respective terms. Appointments of Committee members are staggered such that the
term of three (3) members expire in even numbered years and the term of two (2)
members in odd -numbered years. Each member shall serve at the pleasure of the
Mayor and the City Council until his/her successor is appointed and qualified.
3. Vacancies. If a member of the Lodi Finance Committee shall be absent from three
(3) consecutive regular meetings of the Committee without leave of absence from
the Committee expressed in its official minutes, such office shall become vacant.
The Secretary/Liaison of the Committee shall notify the City Clerk of any vacancy
whenever such occurs.
4. Officers of the Committee. The Lodi Finance Committee shall, at its first regular
meeting of each calendar year, select one of its members as Chairman and one of
its members as Vice Chairman. The Chairman shall serve for a period of one (1)
year, and the Vice Chairman shall serve for a period of one (1) year. Members so
selected may serve in such positions for a maximum of two (2) consecutive years.
5. Meetings of the Committee. The Lodi Finance Committee shall establish a regular
time and place of meetings and shall hold at least one (1) regular meeting each
month. Special meetings of the Committee may be called at any time by the
Chairman, or by any three (3) or more members of the Committee, by providing
notice of said meeting as required by law.
6. Secretary/Liaison to the Lodi Finance Committee. The City Manager shall appoint
an officer or an employee of the City who shall act as the Secretary/Liaison to the
Lodi Finance Committee.
7. Functions of the Lodi Finance Committee. The functions of the Lodi Finance
Committee shall be to advise the City Manager and City Council on financial related
matters, but in no circumstances shall it interfere with or relieve the City Manager
from budget related duties as indicated in Lodi Municipal Code Section 2.12.060(G),
Preparation of Budget.
8. Agenda Items. Agenda items for the Lodi Finance Committee shall come from
direction of the City Council as a whole, from the City Manager or from the
Secretary/Liaison to the Committee.
BE IT FURTHER RESOLVED that it is the intention of the Lodi City Council that
the Lodi Finance Committee shall function in an advisory capacity and shall not be an
administrative body.
