THE CITY COUNCIL FROM: THE CITY MANAGER'S OFFICE COUNCIL MEETING DATE: FEBRUARY 21, 1990 SUBJECT: C -BASIN REORGANIZATION, SOUREAST CORNER CF SOUTH BECKMAN ROAD AND EAST VINE STREET (CONTIGUOUS!, INCLUDING ANNEXATION TO THE CITY CF LODI AND DETACHMENT FROM THE WOODBRIDGE FIRE DEFARTiNBVT AND THE MOKELUMNE FIRE DISTRICT ssssssssassssssasasasssassaaaaaassasaassssssxssassassssssssasssassaasssssasssssssaa,-.ssaaaas RECOMMENDED ACTION: Thdt the City Counci t adopt Resclution No. 90-22, A Resolution of the todi City Council Ordering the C -Basin Reorganization including Annexation to the City of Lodi and Detachment from the Woodbridge Fire District and the Mokelumne Fire District. The C -Basin Reorganization application was filed with the Local Agency Formation Commission by submittal of Resolution No. 89-175 adopted by the Lodi City Council December 6, 1989 proposing annexation of 9.21 acres of contiguous City -owned property. The City of Lodi recently purchased the subject two parcels to permit the expansion of the C -Basin Park to its ultimate size in accordance with the master plan for the facility within the City 1i m its. The purpose of the annexation is to allow City jurisdiction over the City -owned property and to allow the property to be removed from the property tax roll. The proposed reorganization includes territory i n both the Woodbridge Fire District and the Mokelumne Fire District. As a part of the proposed reorganization it would be necessary to approve detachment of the subject property from these fire districts. Following a Public Hearing before the Local Agency Formation Commission of San Joaquin County held January 25, 1990, the Commission adopted Resolution No. 774 approving the C -Basin Reorganization (LAFC 28-89) Including Annexation to the City of Lodi and Detachment from the Woodbridge Fire District and the Mokelumne Fire District with the following conditions: o The boundaries are hereby approved as submitted, said boundaries being set forth i n Exhibit A. o The affected territory is uninhabited. o The City of Lodi is designated as the conducting authority and the City Council i s authorized to complete proceedings for uninhabited reorganization without notice and hearing i n accordance with Section 57002(b) of the Government Code. Sub-iitted in favor of and in opposition to the proposed raorganization and all persona present were given an opportunity to be heard. NOW THEREFORE, the Local Ager -c7 Fornation Commission of San Joaquin County DOES HEREBY RESOLVE, DETERMINE, AND ORDER as follows: Section 1. The Negative Declaration adopted by the omit.' of Lodi, as lead agency, was reviewed and considered. Section 2. The above entitled reorganization is approved subject to the terms and conditions containc3 herein. Section 3. The boundaries are hereby approved as submitted, said boundaries being set forth in Exhibit A. Section 4. The affected to ritory :s uninhabited. Section 5. P.Mic 1PO'La Director Dole n C I N 4 EXHIBIT A C—BASIN ANNEXATION TO THE- CITY OF LODI San Joaquin County, California Janaary 5, 1990 A portion of the South half of Section 7, Township 3 North, Range 7 East, Mount Diablo Base and Meridian, more particularly described as follows: Begihning at the northwest corner of the Southeast Quarter of said Section 7, said corner being on the north line of that certain 28.32 acre parcel shown on map filed i n Book 3G of Surveys at page 83, San Joaquin County Records, said corner also being on the Lodi City Limit line as said line is described in the *Lone Oak Addition", annexed to the City of Lodi by Ordinance No. 796; thence along the boundary of said 28.32 acre parcel t h e following five (5) courses: (1) South 87° 45' 32" East along the north line of said Southeast Quarter, being along said City Limit line, 176.84 feet, (2) leaving said City Limit line, South 1` 04' East, 1018.36 feet, (3) North 870 45' 32" West, 176.84 feet to the west line of said Southeast Quarter, (4.) RECOMMENDED AP.— % %--RjpnVn lit; ,x^� ;r,.= .mac•%%l,G.+�`.� A'ri �: E: E t✓_ ,f- � ___ . i i %'i c.��'� 11.(Q_ RESOLUTION N0. 90-22 A RESOLUTION OF THE LODI CITY COUNCIL ORDERING THE C -BASIN REORGANIZATION (LAFC 28-89), INCLUDING ANNEXATION TO THE CITY OF LODI, AND DETACHMENT FROM THE WOODBRIDGE FIRE DEPARTMENT AND THE MOKELUMNE FIRE DISTRICT, SOUTHEAST CORNER OF SOUTH BECKMAN ROAD AND EAST VINE STREET (CONTIGUOUS), CITY OF LODI UITHOUT NOTICE AND HEARING IN THE MATTER OF THE C -BASIN REORGANIZATION (LAFC 28-89) SOUTHEAST CORNER OF SOUTH BECKMAN ROAD AND EAST VINE STREET (CONTIGUOUS) RESOLUTION MAKING DETERMINATIONS AND ORDERING ANNEXATION WITHOUT NOTICE AND HEARING Section 1. RESOLVED, BY THE CITY COUNCIL OF THE CITY OF LODI that it determines: a) Preliminary proceedings for the annexation of certain described contiguous territory to the City of Lodi and detachment from the Woodbridge Fire Department and the Mokelumne Fire District were initiated by the filing of Resolution No. 89-175 with the Local Agency Formation Commission in the County of San Joaquin, proposing annexation of 9.21 acres of contiguous City -owned property, pursuant to the requirements of the Municipal Organization Act. b) Thereafter, appropriate_proceedings were conducted by said Local Agency Formation Commission, and said Comnission on January 26, 1990, adopted Resolution 774 approving the proposed annexation, subject to certain conditions. �) Resolution No. 774 of the Local Agency Formation Commission approving the proposed annexation also authorized the City of Lodi to complete proceedings for uninhabited reorganization without notice and hearing as the designated conducting agency in accordance with Section 57002(b) of the Government Code. Section 2. BE IT FURTHER RESOLVED, BY THE LCDI CITY COUNCIL: a) That the proposal for annexation is ORDERED in accordance with Section 57002(b) of the Government Code of the State of California. 1. C -Basin Reorganization (contiguous) Annexation to the City of Lodi. 2. A description of said territory is attached hereto and made a part hereof, as though set out in full.
