REMMMENDED ACTION: That the City Council adopt an Ordinance repealing present
Lodi Municipal Code (LMC) Sections 13.20.010 and 13.20.020 and reenacting LMC
Section 13.20.01.0, allowing adopt ion by Resolution o* new Rules and Regulations.
BACKGROUND P4UMATION ?he City of .Lodi Municipal Electric Department has
furnished electric service in accordance with rules and conditions which until now
have been generaliy unwritten. In the interest of uniform ,understanding and
application, we are requesting that formalized, written rules and regulations be
adopted and provided ;;. or ready reference by the public as well as City staff.
A review of the services which the City has been providing disclosed some areas
requiring immediate change to conform with modern utility practice. These areas
generally include the following three items: (1) No future MASTER METERING
installations will be made, 2) Developer's construction responsibility will
include a non-refundable payment prior to construction, and (3) Interruption of
service for necessary repairs will be coordinated with customers and involve the
least inconvenience; however, if a customer requests aftzr-hours (overtime) work
by the City for customer's convenience, customer shall pay all payroll and
associated costs for services requested outside normal working hours.
Periodic review of these Rules and Regulations should be made no less often than
every 36 months.
Existing LMC Section 13.20.010 (Service Wires) and 13.20.020 (Resale of Electrical
Energy) should be repealed and Section 13.20.010 reenacted as amended, allowing
adoption of Rules and Regulations by Resolution of the Council (Ordinance
attached).

REPEALING LODI MUNICIPAL CODE §§ 13.20.010 and 13.20.020,
AND REENACTING § 13.20.0I0
BE IT ORDN'NED BY THE LODI CITY COUNCIL AS FOLLOWS:
SECTION,1 Lodi Municipal Code - §§ 13.20.010 and 13.20.020 are
hereby repealed, and § 13.20.010 is reenacted as follows:
ARTICLE I. GENERALLY
§ 13.20.010 Rules and Regulations
The furnishing of electric utility services to all users in the
City of Lodi shall be subject to official Rules and Regulations, as
established by the Electric Utility Director, and approved by
resolution of the City Council. A current copy of such Rules and
Regulations shall be retained at City Hall by the Electric Utility
Department, and shall be available for public inspection upon request.
Such Rules and Regulations may be modified from time to time, as
necessary, in the manner prescribed herein.
SECTION 2. All ordinance; and parts of ordinances in conflict
herewith are repealed insofar as such conflict may exist.
SECTION__3_ This ordinance shall be published one time in the "Lodi
News SP'1Linel", a daily newspaper of general circulation printed and
published in the City of [.;;di and shall. be in force and take e 'feet
thirty days from and after its passa,e and approval.

Re: Revision of Lodi Municipcil Code: Adoption of Rules and
Regulations
As vie discussed in our phone conversation of October 10, 1988, attached
is a draft ordinance, which will repeal H 13.20.010 and 13.20.020 of >
the Municipal Code, and reenact § 13.20.010, making provision for
adoption by Council %resolution of rules and regulations for electric
utility service customers.
Since this portion of the Municipal Code is now obsolete and in some
instances, contradictory to other regulations and practices adopted by
the City, this action is necessary.
Please let rm know if there is anything else needed.

SUBJECT: GENERAL OVERVEW OF ELECTRIC UTILITY DEPARTMENT

Application for and acceptance of electric service by a customer
from the City implies acceptance of the City's right to measure
electrical energy consumption, set service delivery conditions and
other rules and regulations. In the interest of uniform understanding
and application, w have written out the rules and regulations so that
our customers, staff and the City Council, which regulates our
activities, would hate a eanim source document.
The standard method of measuring electrical energy will be with a
City -furnished and installed meter for each premises (Rule 17). To
insure integrity of the meter and its accuracy, 'it must remain sealed
(Rule 16) and is subject to periodic tests (Rule 18).
Standards for customer and or City protective equipment to avoid
power surge and other harmful effects of certain loads 'like welders are
contained in Rule 2, and conditions f r commercial/industrial
development including new service favi 1 i t' es or degradation of existing
City facilities is detailed in Rules 15 and 16.
To insure conformity with prudent utility practice, w have
incorporated Electric Utility Service Equipment Requirements Committee
(EUSERC) standards which have an industry -wide acceptance.

From tine to time, it is necessary to trim, clear away, and if
necessary, cut down trees and brush in vicinity of overhead lines.
Rule 15 covers such line clearing activity.
Rule 16 specifies underground and overhead facilities which are to

be furnished by City and customer respectively - all detailed by
voltage level. Additionally, Rule 16 covers the areas of right of
access for operation, maintenance and repair of underground and
overhead facilities.
Provisions for undergrounding and formation of an Underground
{
Utility District is covered in Rule 20.
Rule 21 provides compliance with Public Utility Regulatory
Policies Act of 1978 requiring statement or conditions to be imposed by
the City on non -City -owned parallel generation by qualifying small
power prodG,;er.
The medical baseline quantity available to qualifying medical
conditions is spelled out in Rule 22.
Review of these Rules and Regulations no less often than every 36
months is recommended. Most utilities attempt to review their rules
and regulations as part of a normal rate review activity (this method
would have caused 34D to have reviewed rules about every 6 months,
whereas NAe would not have reviewed our rules since 1985). Therefore,
some reasonable interval exclusive of rate review appears appropriate.
