HomeMy WebLinkAboutAgenda Report - February 15, 1989 (65)CITY OF LODI PUBLIC WORKS DEPARTMENT T0: City Council FRGM: City Manager N EETM DATE: February 15, 1989 COUNCIL COMMUNICATION AGENDA TITLE: Approve Purchase Agreement for Well 22 Site, 2040 South Cherokee Lane, and Adopt a Resolution Designating its Use for Public Purposes as a Well Site RECOMMENDED ACTION: That the City Council approve a purchase agreement for the Well 22 site, 2040 South Cherokee Lane, and adopt a resolution designating its use for public purposes as a well site. BACKGROUND PTORMATION: The City has been negotiating with the State for this property for a number of yezrs. Acquiring property from the State is a different process than acquiring from a private corporation. The State does its own appraisal and negotiations start at that point. This acquisition vas more complicated because PG&E has an existing gas main on the site and needed an easement. Because agreement could not be reached on the ourchase price, the State gave a right -of -entry to the City so that the well could be installed. After many meetings with the State and PG&E, agreement has been reached. The total purchase price of the site is $45,000. PG&E will pay $5,000 for their easement and the City will pay $40,000 for the site which includes a water well hazard exclusion easement on adjacent property also owned by the State. Upon receipt of the $40,000 from the City and $5,000 from PG&E, Caltrans will request the California Transportation Commission to authorize conveyance of the easement and deed (see attached Exhibit A). During negotiations, the City appraisal and prepare another of the parcel from $54,122 to Jack .
