On behalf of the Board, the administration, staff, students and parrms I wish to' thank the City of Lodi for the ' consideration that has been shown to schools in the draft General Plan and for the cooperation and assistance that has been given the District as the various planning processes move forward. We Lock forward to working with the staff, omimmity, and Council in development of final Chmm1 Plan language, and ultimately on implementation. City Nat , Tom Peterson CommunityDevelopment Director, AmSchroeder City Attorney, Bob Mc Natt Ace Jbjscn,CountySuperintendent of Schools MJS:cw Attachment Lodi (209)331.7010 Stockton (209)953-8010 BEFORE THE BOARD OF TRUSTEES OF THE LODI UNIFIED SCHOOL DISTRICT OF THE COUNTY OF SAN JOAQUXN, STATE OF CALIFORNIA RESOLUTION 90-9 REQUESTING SUPPORT OF THE CITY COUNCIL OF THE CITY OF LODX IN ASSURING ADEQUATE SCHOOL FACILITIES WHEREAS, significant growth and dcvclopmcnt is projected and anticipated in the immediate future for California, San Joaquin County and most specifically, the City of Lodi; and WHEREAS, Ihora is a direct relationship between new developments within - the City of Lodi, particularly residential developments, and now school students: and WHEREAS, the Lodi UnlCte-d School District docs not havc sufficient classroom space to house any new studcnts; and WHEREAS, this Board of Trustees anticipates State funds previously used for school construction will be insufficient, or unavailable, to moot the inerouing need to finance new classrooms throughout the Stoic of California and mom specifically, in Lodi Unified; and WHEREAS, developer fees presently coiloctecd for school housing purposes are very useful in providing for interim housing, they arc grossly Insufficient in meeting the amount of funding necessary to provide permanent schools: and WHEREAS, it is the legal responsibility of this Board of Trustees to provide adcquatc school housing for all studcnts within the City of Lodi, the authority for approval of now development which results in new studcnts, lies with the Lodi City Council; and WHEREAS , schools arc an important and integral part of the infrastructure of the City of Lodi and, therefore, an important component in the community planning and dcvclopmcnt•implementatiun process; and WHEREAS, the City Council cf the City of Lodi docs have the authority to adopt and implement policies for integrated and orderly dcvclopmcnt of the City of Lodi, including all aspects of the necessary infrastructure, and WHEREAS, pursuant to the Mira Development Corporation v. City of San Diego Appellate Court decision. the City of Lodi docs havc the authority to deny specific rezoning petitions if adcquatc community services arc not available, including school facilities. NOW, THEREFORE, BE IT RESOLVED that the Lodi Unificd School District Board of Trustees hereby requests that the City Council of the City of Lodi actively join this Board in assuring that the present and future residents of the City of Lodi arc served by adcquatc school Tacilitics. provided in a timely manner, with other infrastructure of the community. by raking the following actions: 1, Adoption of general plan policies which require the provision of adequate school facilities before the approval of; near development: 2. Denial of ail rezoning requests which would permit any ' developmenCthat Fwould directly. or indirectly.,' result , in additional newu studentsi unless there are: provision- for adequate permanent sad temporary school housing; xY 3.
