AGENDA TITLE: Set Public Hearing to Consider Introduction of Ordinance to Require
Water Meters on All lav Water Services

RECOMENDED ACIKXv That the City Council set a Public Hearing for January. 2, 1992
to discuss the adoption of an urgency ordinance requiring water
meters on all new water services.
BACKGROUND P4UFMAIM- The City Council at the September 3, 1991 Shirt Sleeve
session gave direction to the Public Worms Department on
drafting an ordinance to require water meters on "new water
service connections" after January 1, 1992 as required by
Senate Bill 229. The State law does not adequately define a "new water service
connection" therefore it was felt clarification was needed. The attached changes to
Lodi Municipal Code 13.08 reflect the informal direction given to define a "new
water service connection". Also attached is the Council nam of August 28, 1991
which provides additional background information.

The schedule of water rates will be those established and adopted by the city council from

The city will not normally serve water outside the city ]idts. In those cases where it

13.08.030 Rates by contract.
In cases not provided for by this chapter, the rate may be fixed by special contract, as
agreed upon by the director of finance and public works director on behalf of the city, and
the water user involved. If such rates m o t be -agreed upon, the city council shall fix and

At the March 6, 1991 City Council meeting staff was directed

to:
o prepare a plan for metering all new
residential customers:

p evaluate a water meter retrofit program for

existing residential customers;
0 study an increasing block rate as part of any
future water rate studies.
Senate Bill 229 (Boatwright), which has been sent to the
Governor for signature, will require as of January 1, 1992
the metering of all new water service connections. Senate
Bill 229 does not clearly define a "New Water Service
Connection". In developing our plan for metering new
residential we have listed below a number of situations
which could be used to define "New Water Service
connections".
1. All new property annexations to the City
requesting City water service.
2. All existing parcels which have had no
previous City water service and a City water
service is requested.
3. At any new service installed from splitting a
parcel - metered service on both parcels.
4. All parcels at which an apartment,
condominium, duplex, etc. is replacing a
single family dwelling.
5. At any parcel where improvements costing more
than $14,100 (triggering off site
improvements) are being done.
6. When any water customer requests service
upsizing or relocating.
7. Change of ownership of property.
8. At any water service requiring upgrading,
repair, relocation, or work of any kind.

Staff feels items 1 and 2 combined are the minimum required
by SB 229, and items 3 and 4 may be interpreted as new water
service connections depending upon the circumstances. Items
5 through 8 may not be required by Senate Bill 229, however,
the City may want to consider metering in these situations
as they occur to avoid retrofitting them in the future.
Staff recommends that at least items 1 through 6 be used in
defining a "New Water Service Connection",
We are requesting informal direction from City Council on
the above. Staff will then return with draft revisions to
Lodi Municipal Code requiring water meters on new water
service connections. These installations will be triggered
by applications for building permits, approvals for parcel
splits, and requests for relocation, upgrading, or upsizing
of water services. The developer/owner will be responsible
for all water meter installation costs. Other revisions to
Lodi Municipal Code 13.08, Water Service, will also be
introduced to make it compatible with the sewer and
electrical service sections of the Lodi Municipal Code.
Currently all new industrial/commercial customers receive a
water meter and the retrofit program for existing
industrial/commercial customers is about 50% cumpleted. A
water meter retrofit program for all existing residential
customers will be brought back to the council at a future
date.
Staff will also be bringing Council pxoposed changes in the
metered rate structure for water. Currently there is a
minimum charge for metered service based on meter size,
which includes an allotted amount of water. Only when this
allotment of water is exceeded does additional water get
charged at the metered rate.
Staff will be proposing a lower base fee (ready to service
charge) for metered service and an additional charge for all
metered water usage. This will benefit customers who use
little water, such as the elderly. This will also encourage
conservation by charging for all water used, not just after
the large allotted amount is used. The evaluation of the
new rate structure will also include alternatives for using
the increasing block sate concept as directed by the City
Counci 1.
At the shirt sleeve session we will also be sharing with the
City Council:
o New methods of reading meters - now and in
the future.

Of course, the intent of the Boatright bill and the City's
General Plan policies regarding meters is to encourage water
conservation. The city has had an ongoing program since the
mid -1970's. Per capita consumption has declined over that
time as shown in Exhibit A.
A "Water Conservation Production Summary", (Exhibit B),
compares water usage in 1990 to 1991 showing significant

NOTICE S HEREBY LIVEN that on Thursday ,at the hour of 7:30 p.m., oras
soon thereafter as the matter may be heard, the City Council will conduct a
public hearing to consider the following matter:
a) the adoption of an urgency ordinance requiring water meters on
all new water services.
All interested persons are invited to present their views and comments on this
matter. Written statements may be filed with the City Clerk at any time prior
to the hearing scheduled herein, and oral Statements may be made at said
hearing.
If you challenge the subject matter in court, You may be limited to raising only
