If approved, direct staff to work with San Joaquin County on an agreement for providing water service to the unincorporated town of Victor. BACKGROUND INFORMATION: In early 1991, City Public Works staff was asked by San Joaquin County Public Works staff to review and comment on a study of the Victor water system. The county was considering its options for improving the Victor water supply, mainly to meet dibromochloropropane (DBCP) standards. One of these options was to connect to the City of Lodi water system. After some meetings with the county, staff responded with the attached letter, dated June 28, 1991 (Exhibit A), discussing some of the technical issues that would need to be addressed. We made it clear that City Council approval would be necessary. In order to meet state deadlines, the county has proceeded with a Safe Drinking Water Bond grant application identifying connection to the City as the preferred alternative. As the Council is aware, the City's policy has been to limit utility service outside the City. The wastewater ordinance prohibits service outside the City and the water ordinance requires specific Council approval on each request. In the past these water service requests have been granted for individual parcels adjacent to new or existing mains and are usually within the City's ultimate planning limits. This request essentially breaks new ground in the City's water policy. The negative aspects include: 1) precedent setting 2) control over demand 3) impact on the City's water system The county's response to our June 28 letter (Exhibit B) adequa aly addresses Items 2) and 3) by limiting the service area and flow and agreeing to pay the appropriate water impact fee. The issue of precedent will have to be dealt with on a case-by-case basis. Certainly, we will receive requests for hookups from property owners located within the two miles between Lodi and Victor (Exhibit Q. THOMASA. Since we will have a major transmission main in Highway 12 (Victor Road) and are providing service east of Lodi, we feel it would be reasonable to look at locating one or more wells in the area north of Highway 12 between Lodi and Victor. The chances of finding DBCP-free water in this area are good, thus we may be able to save the significant cost of a filtration system. The possibility of a well (or wells) in this area prompted our comment on the oversizing of the water main which the county feels the City should pay for. We are doing some engineering work to determine the optimum size. There are a number of details that would need to be worked out in an agreement, but before we do a significant amount of work, staff would like to receive Council direction. Of course, these comments must be considered "preliminary" and may not be complete or binding upon the City. 1) Service to property outside the City limits requires specific City Council approval. There are a number of issues that the Council will wish to consider, including the ones listed below. 2) Service Area - The service area should be defined with some provision for City approval if it is to be amended, 3) Standby/Storage - With only one connection to the City, some provision for a standby source or storage should be provided. This would also provide fire flow. 4) Flow Rate - Given #3, the peak flow rate would be limited. Based on your study, w have made our evaluation based an a peak hour demand cf 300 gpm. This will lessen the impact on the City system. 5) Connection - The connection to the City system should include a meter, bypass and appropriate backflow device, all located near the western edge of the Victor Service Area. 6) Water Main - The main from the City system to the connection point should be a 12" main, built by the County to City specifications, and turned over to the City for operation and maintenance. A Caltrans and/or Southern Pacific Railroad permi t wi 11 be needed. 7) Connection Fee - Based cn .the City's draft impact fee study (with some downward adjustments due to the County's operation of the Victor distribution system), a connection (impact) fee of approximately $220,000 would be applicable. g) Service Charge - Present City practice is to charge a 50% surcharge on water served outside the City limits. W would investigate the possibility of drilling walls in the area north of Victor Road between Lodi and Victor to service both communities. W would look to the County for support in site acquisition, etc. Again, the above comments are meant to raise some of the issues that. will need to be resolved by the City Council. The San Joaquin County Department of Public Works staff has reviewed the preliminary conditions and concerns expressed in your June 28, 1991, letter. The letter lists eight points of concern regarding Lodi water service to the Town of Victor. The following are the County's position on these various points: 1. City Council Approval - The County understands that final approval for any request for outside service must come from the Lodi City Council. 2. Service Area Size - The County agrees that any expansion of the Victor area being served by the City of Lodi Water System should be subject to City of Lodi review and approval. The county proposes to use an initial service area that is a combination of the areas which lie within the boundaries of the current County Service Area No. 14 and the proposed County General Plan for the Town of Victor. The extent of this proposed service area is shown on the map attached hereto as Exhibit A. All users currently being served by the system 1 i e within this service area. 3. Standby/Storage Facilities - The County proposes to provide a storage facility in order to lessen the impact of service interruptions and increase the system's reliability. The proposed storage facility will have a volume sufficient to supply the design fire flow for 2 hours duration and 25 percent of the maximum day demand for peak demands and emergencies. Both existing wells have DBCP contamination and will be destroyed. 6 -2 - Mr. Jack Ronsko VIC`1'OR WATER STUDY 4. Flow Rate - As discussed in item 3, the County proposes to provide storage facilities which provide for fire flow requirements and peak hour demands. With the storage provided, the City's proposal to limit the maximum flow rate to 300 gpm is acceptable. 5. Point of Connection - The County agrees to locating the point of connection at or near the western limit of the Victor service area. The proposed connection equipment consists of a 4" turbine meter with bypass along with a 4" back flow prevention device. The installation would be located near the corner of Cherry Road and Highway 12. This corresponds to the western boundary of the current service area. 6. Water Main - The County agrees to accept responsibility for the design and construction of the transmission main to City of Lodi specifications and for obtaining all permits. By providing a storage facility, the County has established conditions which permit the use of a 10 -inch main for the supply of Victor's water demands. However, if the City requires the installation of a 12 -inch main, then some ; participation by the City in the cost cf the main will be in order, since the oversizing of the 10 -inch main to a 12 -inch size is an ineligible project cost under the Safe Drinking i Water Program. 7. Connection Fee - The $220,000 connection fee appears y reasonable and acceptable. However, this fee should be subject to a credit for the oversizing cost of the transmission main as stated in item 6. 8. Service Charges - The water rates and charges are acceptable as they are based on current City practice. The comments above address the eight points raised by the City's Engineering staff. We feel the conditions are acceptable, with the principle exception being the cost of oversizing the transmission main. In order to maintain eligibility for these depleting funds, the County will resubmit an amended grant application reflecting the possibility of water service from the City of Lodi. San Joaquin County Department of Public Works staff will present the amended application before the Board of Supervisors on October 22, 1991, for its authorization to resubmit the application to the Department of Health Services. The State and County recognize that final approval for this proposal must come from the Lodi City Council and the San Joaquin County Board of Supervisors.
