HomeMy WebLinkAboutAgenda Report - November 20, 1991 (107)`w COUNCIL COMMUNICATION CITY OF LODI COUNCIL COMMUNICATION AGENDA TITLE: Adoption of Ordinance No. 1532 entitled, "An Ordinance of tha Lodi City Council Amending the Official District Map of the City of Lodi and Thereby Prezoning the Parcels Located at 1767 East Harney Lane (APN 058-210-02), 1831 East Harney Lane (APN 058-210-03), and 1865 East Harney Lane (APN 058-210-04) (Proposed Century Meadows It Development) to R-2, Single -Family Residential, With a Condition Relating to School Facilities Funding" MEETING DATE: November 20, 1991 PREPARED BY: City Clerk RECOMMENDED ACTION: Following reading by title, it would be appropriate for the City Council to adopt Ordinance No. 1532. BACKGROUND INFORMATION: Ordinance No. 1532 entitled, "An Ordinance of the Lodi City Council Amending the Official District Map of the City of Lodi and Thereby Prezoning the Parcels Located at 1767 East Harney Lane (APN 058-210-02), 1831 East Harney Lane (APN 058-210-03) and 1865 East Harney Lane (APN 058-210-04) (Proposed Century Meadows II Developmenti to R-2, Single -Family Residential, With a Condition Palating to School Facilities Funding" was introduced at the regular meeting of t"le Lodi City Council held November 6, 1991. Pursuant to State statute, ordinances may be adopted five days after their introduction following reading by title. This Ordinance has been approved as to form by the City Attorney. PETERSON per City Manager recycled pa C0 000M1/TXTA,02J/COUNCOM ._.._ ._......-.w.-..-..,�,w.--_ ,t�,,�-,....< ..,....,...1....'.....11 OC -1 ORDINANCE NO. 1532 ------------------ ------------------ AN ORDINANCE OF THE LODI CITY COUNCIL AMENDING THE OFFICIAL DISTRICT MAP OF THE CITY OF LOOT AND THEREBY PREZONING THE PARCELS LCCATED AT 1767 EAST HARNEY LANE (APN 058-210-02), 1831 EAST HARNEY LANE (APN 058-210-03), and 1865 EAST HARNEY LANE (APN 058-210-04) (PROPOSED CENTURY MEADOWS II DEVELOPMENT) R-2 SINGLE-FAMILY RESIDENTIAL, WITH A CONDITION RELATING TO SCHOOL FACILITIES FUNDING. BE IT ORDAINED BY THE LODI CITY COUNCIL AS FOLLOWS: SECTION 1. The Official District Map of the City of Lodi adopted by Title 17 of the Lodi Municipal Code is hereby amended as follows: The parcels located at 1767 East Harney Lane (APN 058-210-02), 1331 East Harney Lane (APN 058-210-03), and 1865 East Harney Lane (APN 058-210-04) (proposed Century Meadows II development) are hereby prezoned R-2, Single -Family Residential. SECTION 2. The above-described prezoning shall be conditioned upon the signing by the developer and/or owner of said parcels prior to the effective date hereof, of an agreement with Lodi Unified School District for the provision of school facilities funding. Failure tc execute such agreement shall delete the parcei(s) subject thereto from the effects of this ordinance. SECTION 3.. The alterations, changes, and amendments of said Official District Map of the City of Lodi herein set forth have been approved by the City Planning Ccmmission and by the City Council of this City after public hearings held in conformance with provisions of -1- Title 17 of the Lodi Municipal Code and the laws of the State of California applicable thereto. SECTION 4. All ordinances and parts of ordinances in conflict herewith are repealed insofar as such conflict may exist. SECTION 5. This ordinance shall be published one time in the "Lodi News Sentinel", a daily newspaper of general circulation printed and published in the City of Lodi and shall be in force and take effect thirty days from and after its passage and approval. 11 Mayor Attest: u ALICE hi: REI HE City Clerk State of California County of San Joaquin, ss.
