HomeMy WebLinkAboutAgenda Report - November 20, 1991 (74)OP aCITY OF LODI AGENDA TITLE: Adoption of Ordinance No. 1535 entitled, "An Ordinance of the Lodi City Council Amending the Official District Map of the City of Lodi and Thereby Prezoning the Parcel Located at 3820 East Almond Drive (APN 062-060-30) (Proposed Colvin Ranch Development) and the Parcels Located at 3886 East Almond Drive (APN 062-060-31), 3910 East Almond Drive (APN 062-060-32), and 3536 East Almond Drive (APN 062-060-33) to R-2, Single -Family Residential, With a Condition Relating to School Facilities Funding" MEETING DATE: November 20, 1991 PREPARED BY: City Clerk RECOMMENDED ACTION: Following reading by title, it wauld be appropriate for the City Council to adopt Ordinance No. 1535. BACKGROUND INFORMATION: Ordinance No. 1535 entitled, "An Ordinance of the Lodi City Council Amending the Official District Map of the City of Lodi and Thereby Prezoning the Parcel Located at 3820 East Almond Drive (APN 062-060-30) (Proposed Colvin Ranch Development), and the Parcels Located at 3886 East Almond Drive (APN 062-060-31), 3910 East Almond Drive (APN 062-060-32), and 3936 East Almond Drive (APN 062-060-33) to R-2, Single -Family Residential, With a Condition Relating to School Facilities Funding" was introduced at the regular meeting of the Lodi City Council held November 6, 1991. Pursuant to State statute, ordinances may be adopted five days after their introduction following reading by title. This Ordinance has been approved as to form by the City Attorney. PETERSON tj ncYeNd oaoa COUNCOMI/TXTA.02J/COUNCOM Cc -1 ORDINANCE NO. 1535 AN ORDINANCE OF THE LODI CITY COUNCIL AMENDING THE OFFICIAL DISTRICT MAP OF THE CITY OF LODI AND THEREBY PREZONING THE PARCEL LOCATED AT 3820 EAST ALMOND DRIVE (APN 062-060-30) (PROPOSED COLYIN RANCH DEVELOPMENT), AND THE PARCELS LOCATED AT 3886 EAST ALMOND DRIVE (APN 062-060-31), 3910 EAST ALMOND DRIVE (APN 062-060-32), AND 3936 EAST ALMOND DRIVE (APN 062-060-33) TO R-2 SINGLE-FAMILY RESIDENTIAL, WITH A CONDITION RELATING TO SCHOOL FACILITIES FUNDING. BE IT ORDAINED BY THE LODI CITY COUNCIL AS FOLLOWS: SECTION 1. The Official District Map of the City of Lodi adopted by Title 17 of the Lodi Municipal Code is hereby amended as follows: The parcel located at 3820 East Almond Drive (APN 062-060-30) (proposed Colvin Ranch development), and the parcels located at 3886 East Almond Drive (APN 062-060-31), 3910 East Almond Drive (APN 062-060-32), and 3936 East Almond Drive (APN 062-060-33) is hereby prezoned R-2 Single -Family Residential. SECTIOM 2. The above-described prezoning shall be conditioned upon the signing by the developer and/or owner of said parcels prior to the effective date herecf, of an agreement with Lodi Unified School District for the provision of school facilities funding. Failure to execute such agreement shall delete the parcel(s) subject thereto from the effects of this ordinance. SECTION 3. The alterations, changes, and amendments of said Official District Map of the City of Lodi herein set forth have been approved by the City Planning Commission and by the City Council of -1- this City after public hearings held in conformance with provisions of Title 17 of the Lodi Municipal Code and the laws of the State of California applicable thereto. SECTION 4. All ordinances and parts of ordinances in conflict herewith are repealed insofar as such conflict may exist. SECTION 5. This ordinance shall be published one time in the "Lodi News Sentinel", a daily newspaper of general circulation printed and published in the City of Lodi and shall be in force and take effect thirty days from and after its passage and approval.
