AGENDA TITLE: Purchase and Installation of New Miracle Playground Equipment at
Lodi Lake Park (north) Youth Playground Area by the Kiwanis Club
of Greater Lodi; allow a Loan of $7,500,00 to the Service Club
with Annual Payback by Written Agreement.

RECOMMENDED ACTION: W Resolution - That the City Council approve the purchase and
installation of new Miracle Recreation playground equipment at
Lodi Lake Park (north) Youth playground area and allow a loan
of $7,500.00 to the Kiwanis Club of Greater Lodi to be paid
back by agreement over a three to four year period.
BACKGROUND INFORMATION: About two years ago, I had a discussion with two or three
members of the Kiwanis Club of Greater Lodi about involve-
ment in Lodi Lake Park. Discussions involved building a
large-scale picnic area where they annually conduct their
pancake breakfasts; a 500 -person capacity meeting/picnic complex, possibly in the
new West Park area at the Lodi Lake; involvement in purchase/installation of play-
ground equipment on the north side of the Lodi Lake in the Youth area. This
discussion had led to their wanting to take the first step in assistance out at
Lodi Lake Park, that being the purchase and installation of new playground equip-
ment on the north side to replace the old and not so playable equipment that is
currently in place.
The Club has agreed to foot the bill on purchase of equipment and physically, with
members, install the equipment with a Miracle construction supervisor there to
direct this operation.
The total cost of the equipment and supervisory fee would be $9,000.00; the club
plans to present to the City, upon acceptance of the project, a check for $1,500.00
as good faith money to start the project. They would like a three to five year
payback agreement, -with a clause that addresses the continuance of the annual boat
races, as their major source of raising funds via pancake breakfasts. Should the
boat races be discontinued because of (a) low water conditions, (b) liability/risk
probiems that would cause the insurance needs to be so high that N.C.O.A. could not
afford to sponsor the annual event, or (c) any other problems that would prevent the
races, they would like to pay less those years, until they can come up with another
suitable fund -raiding event to cover their obligations.

We would suggest this money could be drawn from the Lodi Lake Enterprise Account,
which totals at this time $69,815.40.
We have had a good deal of success with doing projects in this manner and hope the
City and Council will move ahead and grant this request. The Parks and -Recreation
Conmission has reviewed this project and wholeheartedly support this endeavor.
I have attached for your review layout plans and rendering of said equipment, which
has been presented to both the Club and Commission for approval (See Exhibit A).
FUNDING: $7,500.00 from Lodi Lake Enterprise Account 122-650 (see Exhibit B -
Current status of Enterprise Ftmd).

AND APPROVING A LOAN TO KIWAMS FOR SAID PUIUHASE AND INSTALLATION
RESOLVED, that the Lodi City Council hereby approves the purchase
and installation by the Kiwanis Club of Greater Lodi of new Miracle
playground equipment at Lodi Lake Park (North) youth playground area;
and
FURTHER RESOLVED, Council hereby approves a loan of $7,500 to
Kiwanis Club of Greater Lodi from the Lodi Lake Enterprise Account
122-6500 toward the purchase of said playground equipment, all as set
forth in a payback Agreement to be entered into between the City of
Lodi and Kiwanis Club of Greater Lodi, attached hereto as Exhibit A.

AGREEMENT
PURCHASE AND INSTALLATION OF MIRACLE PLAYGROUND EQUIPMEKT
AT LODI LAKE PARK (NORTH) YOUTH PLAYGROUND AREA
AND LOAN TO KIWANIS CLUB OF GREATER LODI TO PROVIDE FOR SAME
THIS AGREEMENT, entered into this 20th day of November, 1991, by and
between the CITY OF LODI, a municipal corporation ("City"), and KIWANIS
CLUB OF GREATER LODI ("Club") .
WITNESSETH:
WHEREAS, at its November 20, 1991 meeting, the Lodi City Council
approved the purchase and installation of new Miracle playground equipment
at Lodi Lake Park (North) youth playground area; and
WHEREAS, Club, as a service to the community, has expressed its desire
to provide for the purchase and installation of said playground equipment
for a total project amount of $9,000, subject to the following terms and
conditions:
1) Upon the acceptance of the project, Club will present to City a
check in the amount of 51,500 as upfront money.

2; Crud requests a loan from the City in the amount of $7,500 to
provide for balance of funding for said playground equipment, to be
repaid to City over a period of four years, or shorter at the option
of Club.
3) Club's repayment amounts of said loan shall be dependent upon
Club's continued revenues from its fundraising activities at the
annual July boat races at Lodi Lake Park. Should Club's anticipated
revenues from that source fail to materialize because of the
discontinuance for any unforeseen reason of the annual boat races,
Club's obligation to City shall reflect smaller payments to the City
until Club can replace such fundraising revenues.
WHEREAS, the Lodi Parks and Recreation Commission and the Lodi City
Council have expressed their support, and have accepted the Club's proposal
to provide for said equipment; and
WHEREAS, the Council did at its November 20, 1991 meeting authorize a
$7,500 loan to Club;
NOW, THEREFORE, IT IS AGREED BY THE PARTIES HERETO AS FOLLOWS:
A. City hereby agrees to loan to Club the sum of $7,500, interest free,
under the terns and conditions outlined above, to be appropriated from the
City's todi Lake Enterprise Account 122-6500.

B. Club hereby accepts full responsibility for the repayment of said
$7,500 loan. Annual payments totalling $2,000 more or less shall be made
until $7,500 is paid in full. Final payment shall be made on or before
November 19, 1995 unless conditions as outlined in Paragraph 3 above shall
dictate that Club be allowed additional time to fulfill its obligation to
repay City, wherein the final payment date shall be extended by mutual
agreement.
C. A11 payment checks shall be made payable to the "City of Lodi", and
sent to the City of Lodi Finance Department, Attention Collections, 221
West Pine Street, Lodi, California 35240.

Kiwanis Club of Greater Lodi
Pursuant to City Council authorization at its November 20, 1991 meeting,
the attached unsigned Agreement has been prepared between the City and
Kiwanis Club of Greater Lodi which provides for a $7,500 loan to Kiwanis
for the purpose of their purchase and costs of installation of Miracle
playground equipment at Lodi Lake Park. Said loan is to be repaid to the
City over a conditional period of three to five years, or shorter at the
option of the Club, as indicated in the Agreement.
Would you please set up an account whereby Kiwanis can pay these annual
amounts? When the signed copy of the Agreement has been received, a copy
will be forwarded for your file.

AND LOAN TO KIWANIS CLUB OF GREATER LODI TO PROVIDE FOR SAME
THIS AGREEMENT, entered into this 20th duy of November, 1991, by and
between the CITY OF LODI, a municipal corporation ("City"), and KIWANIS
CLUB OF GREATER LODI ("Club").
WITNESSETH:
WHEREAS, at its November 20, 1991 meeting, the Lodi City Council
approved the purchase and installation of new Miracle playground equipment
at todi Lake Park (North) youth playground area; and
WHEREAS, Club, as a service to the community, has
expressed

B. Club hereby accepts full responsibility for the repayment of said
$7,500 loan. Annual payments totalling $2,000 more or less shall be made
until $7,500 is paid in full. Final payment shall be made on or before
November 19, 1395 unless conditions as outlined in Paragraph 3 above shall
dictate that Club be allowed additional time to fulfill its obligation to
repay City, wherein the final payment date shall be extended by mutual
agreement.
C. All payment checks shall be made payable to the "City of Lodi", and
sent to the City of todi Finance Department, Attention Collections, 221
West Pine Street, Lodi, California 95240.
