AGENDA TITLE: Pass Resolution 91-218; an application for State of California,
"Habitat Conservation Fund" monies for reconstruction of the
Mokelumne River levee in the area of Pigs Lake.

RECOMMENDED ACTION By resolution - That the City Council approve the passing of
Resolution 91-218; an application for State of California,
"Habitat Conservation Fund" monies for reconstruction of the
Mokelumne River levee in the area of Pigs Lake.
BACKGROUND P4;ORMATICN The levee at Pigs Lake is in a seriously eroded condition.
Until mv there have not been funds available to repair
this levee. However, the Wildlife Protection Act of 1990
provides $2,000,000 .00 annually to the California
Department of Parks and Recreation for. the Local Agency Grant Program. This is a
50%matching grant that is available to local agencies on a competitive basis. The
application deadline for the first funding cycle is December 20, 1991.
As soon as grant applicatione were available, Director Ron Williamson obtained
a copy. Since this was a competitive grant it was decided to use our National
Grant Services consultant to put together this grant. A you can see, vie have a
very short time line in which to put together our application for funding.
Therefore, vie placed this item on the Nature Area Advisory Committee agenda. They
approved the concept. Loss of the levee at Pigs Lake would inundate the Nature
Area. The Parks and Recreation Commission also approved the concept. The
Commission expressed concern that vie did not have a dollar figure on this project.
However, they approved the project for Council review. National Grant Services
is developing the cost estimates as part of the grant application. These figures
are not available as not all contractors have .asponded. It is necessary to
approve applying for the grant nm in order to make the grant application deadline.
In discussing costs of the project with National Grant Services, Duke Foster
was made aware of the City's financial condition in regards to the City's ability
to provide the matching funds. His approach is to take advantage of previsions
which allow for the City to charge for labor and equipment which can be volunteer
in nature. W would charge for inspection services and administering the contract.
W would use volunteers to do reforesting of the reconstructed levee. Duke's
feeling is that vie can offset substantially all of our costs in this way.

of the levee at Pigs Lake indicates a definite need for reconstruction to avoid the
even costlier rebuildin of the levee once it is breached and the Nature Area
inundated. It is the Department's recommendation that vve be allowed to apply for
the grant at this time.

A RESOLUTION OF THE LODI CITY COUNCIL
APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE LOCAL AGENCY
GRANT PROGRAM - FISCAL YEAR 1991-92 UNDER THE HABITAT CONSERVATION
FUND PROGRAM OF THE CALIFORNIA WILDLIFE PROTECTION ACT OF 1990 FOR THE
FOLLOWING PROJECT(S).
Lodi Lake RiQarian Protection
WHEREAS, the people of the State of California have enacted the
California Wildlife Protection Act of 1990, which provides funds to the
State of California for grants to local agencies to acquire and/or
develop facilities for public recreational and fish and wildlife
habitat protection purposes; and
WHEREAS, the State Department of Parks and Recreation has been
delegated the responsibility for the administration of a portion of the
program within the State, setting up necessary procedures governing
application by local agencies under the program; and
WHEREAS, said procedures established by the State Department of
Parks and Recreation re uire the applicant to certify by resolution the
approval of applications) before submission of said application(s) to
the State; and
WHEREAS, said application(s) contain assurances that the
applicant must comply with; and
WHEREAS, the applicant will enter into an agreement with the
State of California for acquisition or dere lopment of the project(s);
NOW, THEREFORE, BE IT RESOLVED that the City Council hereby:
1. Approves the filing of an application for the Habitat
Conservation Fund Grant program under the California Wildlife
Protection Act of 1990 State grant assistance for the above
project(s); and
2. Certifies that said applicant understands the assurances and
certification in the application form; and
3. Certifies that said applicant has or will have available prior to
commencement of any work on the project(s) included in this
application, the required match; and will have sufficient funds
to operate and maintain the project(s); and
4. Appoints the City Manager as agent of the City to conduct all
negotiations, execute and submit all documents, including, but
not limited to applications, agrcenients, amendments, payinent
request and so on, which may be necessary for the completion of
the aforementioned project(s).

Dear Ms. Reimche:
We are applying for a grant from the Habitat Conservation Fund
Program for levee restoration near Pigs Lake. Would you please
have your agency process the necessary environmental documents,
based on th.e following:
Project Description: Repair, restore and re -vegetate
approximately 1,200 feet of levee along the DIokelumne River in
the vicinity of Pigs Lake at Lodi Lake Park. Restabilize
approximately 4,800 feet of riparian corridor, provide public
access, vegetation and erosion control.
We are under a tight time -line of December 20 to submit all
documents. Please expedite the environmental documents and call
me when they are completed, so I can personally pick them up.
Also, would you please send me a• original Resolution approving
this grant application. This was approved by the City Council at
their meeting on November 20, 1991.

PROJECT.DESCRIPTION: The proposed project will rehabilitate
an existing public park by replacing the existing rest room,
installing new play equipment, constructing four (4) new
picnic areas with shelters, barbecues, and tables, providing
bicycle and pedestrian access through the park, installing
new park lighting to replace inadequate existing illumination
and providing benches near the existing pool and play
equipment. All. improvements will be replacements or upgrades
except for a new walking/bicycle pathway through the park.
The project site is located at 600 Columbia Street, or, the
area between the south side of Columbia Street and the north
side of High Street between Farr and Beech Street. The
property is more particularly described as Stanislaus County
Assessors Parcel Number 50-22-16.
The project has been reviewed by the City of Turlock
Environmental Review Committee and is considered to be
"CATEGORICALLY EXEMPT" from further environmental review
under Section 15301(d) , HExisting Facilities" and 15304 (b) (h)
"Minor Alterations to Land" of the California Environmental
Quality Act (CEQA) and (NEPA) Guidelines.
