BACKGROUND INFORMATION: Ordinance No. 1523 entitled, "An Ordinance of the Lodi City Council Authorizing Delivery of Unclaimed Bicycles and Toys for the Mayor's Annual Holiday Child Share Program" was introduced at the regular meeting of the Lodi City Council held September 18, 1991. Pursuant to State statute, ordinances may be adopted five days after their introduction following reading by title. This Ordinance has been approved as to form by the City Attorney. FUNDIl�Kr. CiiyManager ORDIlVANCE NO. 1523 AN ORDINANCE OF THE LORI CITY COUNCIL, AUTHORIZING DELIVERY OF LkJJAAED BICYCLES AND TOYS FOR THE MAYORS ANNUAL HOLDAY CHR D SLTARE PROGRAM WHQZEAS� the City Council is authorized, pursuant to Welfare and Institutions Code § 217, to direct the Lodi Police Department to turn over to a nonprofit organization, certain unclaimed bicycles and toys in its possession; and VffFEAS� the Lodi Service Center, working in conjunction with the Lodi Salvation Anny Service Extension Committee, has requested that unclaimed bicycles and toys held by the Lodi Police Department for more than sixty days be turned over for distribution during the Christmas season; and VVIEZM this program is known as "The Mayor's Annual Holiday Child Share Program"; NOW, THEREFORE, BE IT ORDAND. SECTION 1. The Council hereby finds and declares as follows: A. The Lodi Service Center and the Lodi Salvation Awry Service Extension Committee are nonprofit organizations, exempt from income taxation under Federal and State law; Be B. Both may participate in programs or activities designed to prevent juvenile delinquency; C. The program or activity for which such bicycles and toys are delivered is designed to prevent juvenile delinquency. The Lodi Police Department is directed to turn over to the Lodi Service Center and Lodi Salvation Army Service Extension Committee for the Mayor's Annual Holiday Child Share Program, all bicycles and toys presently in its possession which have been unclaimed for more than sixty days. SDCMN 3. All ordinances and parts of ordinances in conflict herewith are repealed insofar as such conflict may exist. SECTION 4. 'This ordinance shall be published one time in the "Lodi News Sentinel", a daily newspaper of general circulation printed and published in the City of Lodi and shall be in force and take effect thirty days from and after its passage and approval.
