AGENDA TITLE: Introduction of ordinance authorizing delivery of unclaimed
bicycles and toys for "The Mayor's Annual Holiday Child
Share Program".

RECOMMENDED ACTION: Council consideration of authorizing the delivery of
unclaimed bicycles and toys to the Lodi Service
Center and Salvation Army Service Extension Committee
for The Mayor's Annual Holiday Child Share Program.
DISCUSSION: Last year, the Lodi Service Center, working in
conjunction with the Lodi Salvation Army Service
Extension Committee requested and received all
unclaimed bicycles and toys neld by the Lodi Police Department, in lieu of
selling them at auction. This program is known as "The Mayor's Annual
Holiday Child Share Program". The items were distributed to
underprivileged children.
A similar request has been made again this year. If the Council deems it
appropriate, Welfare and Institutions Code §217 can be utilized to
authorize delivery of the toys and bicycles to these organizations for
distribution.

AN ORDNANCE OF THE LODI CITY OOLJNC
AUIHORLT\U DIIIVFRY OF UNCLAIMED BICYCLES AND TOYS
FOR THE MAYOR'S ANNUAL HOIDAY CHILD SHARE PROGRAM
VV EF ASS the City Council is authorized, pursuant to Welfare and
Institutions Code § 217, to direct the Lodi Police Department to turn
over to a nonprofit organization, certain unclaimed bicycles and toys
in its possession; and
VV TERM the Lodi Service Center, working in conjunction with the
Lodi Salvation Angry Service Extension Committee, has requested that
unclaimed bicycles and toys held by the Lodi Police Department for more
than sixty days be turned over fur distribution during the Christmas
season; and
VV TERM this program is known as "The Mayor's Annual Holiday
Child Share Program" ;
NOW, THEREFORE, BE IT ORDAINED:
SECTION 1. The Council hereby finds and declares as follows:
A. The Lodi Service Center and the Lodi Salvation Amry
Service Extension Committee are nonprofit organizations,
exempt from income taxation under Federal and State law;

B. Both may participate i n programs or activities designed to
prevent juvenile delinquency;
C. The program or activity for which such bicycles and toys
are delivered i s designed to prevent juvenile delinquency.
The Lodi Police Department i s directed to turn over to the Lodi
Service Center and Lodi Salvation Army Service Extension Committee for
the Mayor's Annual Holiday Child Share Program, a I I bicycles and toys
presently in its possession which have been unclaimed for more i.nan
sixty days.
SECTION 3. All ordinances and parts of ordinances in conflict herewith
are repealed insofar as such conflict may exist.
SECTION 4. This ordinance shall be published one time i n the "Lodi
News Sentinel", a daily newspaper of general circulation printed and
published i n the City of Lodi and shall be i n force and take effect
thirty days from and after its passage and approval.
