MEETING DATE: August 5, 1992 SUBMITTED BY: Electric Utility Director RECOMMENDED ACTION: That the City Council approve the Agreements for the emergency clean up of a PC8 storage facility in Utah, documentation. handling, redisposal and destruction of City or Lodi material stored within and authorize the transfer of funds in the amount of 530,000 from tyre Utility Outlay Reserve for this action. I 8ACNGROUND INFORMATION: The Electric Utility Department duri�q late 1989 and early 1990 contracted with North American Environmental, Inc. for transportation and destruction of PCB material. The material included 55 -gallon drums of oil and transformer carcasses. Unfortunately, the City was recently informed that North Amer man Environmental, Inc. has filed for bankruptcy prior to the destruction of all material from Lodi. At this time, 17 drums of -il and 2 transformer carcasses have �beeR •located in a warehouse in Utah together with naterial f:'om a number of oth r agencies. The Environmental Protection Agency (SRA) is now involved in thici elt-a-m up of the material located in the Utah warehouse. EPA has given all the generators (Lodi is a generator of the waste) until Septembcr 1, 1992 to remove and 'redispose' of this waste or EPA will contract and bill for such clean up and disposal, The City's most favorable option is to have the material removed 4nd destroyed prior to the deadline. The City has negotiated agreements for this tank with contractors approved by EPA for the clean up and at this point is ready to sign these agreements. It should be noted that EPA strongly recommends that a representative from the generator (Lodi) be precent at the site to monitor the clean up process. Therefore, this emergency funding request also includes the cost of sending an employee to Utah for the duration of the clean up, estimated at a maximum of 5 days. Page two August 5. 1992 I The estimated cost of this project is 530,000 and includes the removal from the warehouse, the loading and transportation to another 1-indli�g facility, the destruction of the material, a I I required documentation and manifests and the cost of having a Lodi representative at. the site during the process. It is further worth noting that the generator (Lodi) by law is rebponsible for this matter even though a once reputable company contracted with the(fcity Tor handling and destruction of the material. Only after final destruction of the material has been completed and documented w i l l this liability diminish. i FUNDING: Available within the Utility Outlay Reserve account. Henry J.
