AGENDA TITLE: Approve request by Parkview Terrace Homeowners' Association to
install and maintain (at association's expense) a self-locking
access gate between Parkview Terrace subdivisi,)n and Glaves Park:

RECORHENDED ACTION: That the City Council approve the installation of a self-
locking access gate between Parkview Terrace subdivision
and Glaves Park, to be purchased, installed and
maintained by the Parkview Terrace Homeown3rs'
Association.
BACKGROUND INFORMATION: Mr. Karl Greenlee, President of the Parkview Terrace
Homeowners' Association, approached the City Council
on April 3, 1991, to make a formal request to install/
maintain a self-locking access gate between Parkview
Terrace subdivision and Glaves Park. The council referred Mr. Greenlee to the
parks and Recreation Commission for consideration of this request. See letter
from Mr. Greenlee, dated April 1, 1991, (EXHIBIT A), and City Attorney's mems,
dated April 5, 1991, (EXHIBIT B) attached.
At our May 7, 1991, Parks and Recreation Commission meeting, Mr. Greenlee
appeared before the Commission and made his request. After lengthy discussion
about agreements, liabilities, locking and unlocking the gate during basin water
storage, etc., the Commission voted 4-0 to recommend that the Parkview Terrace
residents be allowed access between Parkview Terrace subdivision and Glaves
Park. Installation, maintenance and appropriate insurance will be at the
homeowners' association's expense.

Fron: Karl Greenlee, President of the Parkview Homeowners Assoc.
Subject: Installation of a gate into Henry Glaves Park from fence
bor"ering Parkview Terrace for the convenience of the homeowners.
We request that the homeowners association be allowed to place a
gate into Henry Glaves Park along the north fence bordering
Parkview Terrace and said park.
The homeowners association are suggesting the installation of a
gate similar to the 'walk-in' gate now located adjacent to the
drive in gates at the entrance to the Terrace. This gate is one
that is opened by a key and is spring loaded to close
automatically. Our suggestion is that -the gati installed at the
fence between the park and our area be keyed the same as our front
gate, therefore insuring the security intended for our area.
We also understand that Henry Glaves Park serves as a 'ponding
basin' for water retention and therefore there will be times that
<�the City wi11 have to chain, the gate 'closed' and we will not be
,permitted access due to impending rain or storms. We also
understand that the City is mandated by Public Works to close
basins based on long range weather forecasts and therefore the gate
may be 'chained shut' on a Friday and although no rain occurs the
basin is closed for the entire weekend as we do not send out
someone during the weekend or holidays to open any of the basins.
The opening and closing of all City basins is done during normal
work hours, other than emergencies.
We also understand that if the gate is installed that all
maintenance of said gate will be borne by our association.
I am more than willing to approach the Commission with this
request.

Subject: REQUEST FOR PRIVATE ACCESS HENRY A. GLAVES PARK
As discussed at th2 Council meeting of April 3, 1991, a format request has
been received fron Karl Greenlet', 2387 Hyde Park Circle, Lodi (369-4957
Residence, 333-0925 Business) as President of the Haim Owners Association
for access via a locked gate between the Parkview Terrace subdivision and
Henry A. Glaves Park.
Mr. Greenlea's prcposal is that the Homeowner's Association would pay
fur, install, and maintain a gate through the City's fence on the south
side of Glaves Park where it interfaces with the Parkview Terrace
subdivision. The Homeowner's Association is willing to give the City an
indemnity/hold harmless agreement and to keep necessary liability insurance
in effect naming the City as an additional insured. It is requested that
this matter be placed on the next Agenda of the Parks and Recreation
Commission for discussion and recommendation. Wbm a date and time for
