BACKGROUND P4il MATION This project wilt construct a walled patio space which will feature raised concrete planters for senior gardening. Community Development Block Grant funds will be used to pay for this construction. Bids were opened on May 29, 1991 and staff needs additional time to review the bids. An explanation and a more detailed presentation will be made during the Council meeting. Plans and specifications for this project were approved on April 17, 1991. Reimche City Clerk MEMORANDUM, City of Lodi , Publ is Woks Department TO: C i t Manager City Council FROM: Public Wo& Director DATE : June 4, 1991 SUBJBCT: Contract Award for Hutchins Street Square Patio Project 600 West Oak Street On Wednesday, My 29, 1991, bids were opened for the Hutchins Street Square Patio project. Six contractors bid on the project and Don H. Hughes Construction of Stockton was the apparent low bidder. After the bids had been opened, one of the bidders asked whether Irn H. Hughes Construction had included the Contractor's Statement of Experience and Financial Condition with its bid. They had not done so and of the six bidders only one had returned the Statement of Experience with the bid. Section 2.400 "Bidding Documents" of the specifications for this project included a sentence which stated: "The bidders shall fill out and submit with the sealed bid the Contractor's Statement of Experience and Financial Condition." It was not the City's intent to have this statement included in the specifications at all. Therefore, there was no form for the Statement of Experience and Financial Condition even included in the proposal package. The Council has the right to waive bidding informalities. It is therefore recommended that the City Council waive this informality and award the contract for the Hutchins Street Square Patio to Don H. Hughes Construction in the amount of $64,854.00. The project must be awarded now in order to have it completed by Field and Fair Day. Jack .
