AGENDA TITLE: Concur with the San Joaquin Council of Governments Amendment to the
Measure K Expenditure Plan to Utilize the Remaining Measure K Programming
Capacities between All Program Categories

RECOMMENDED ACTION: Concur with the San Joaquin Council of Governments amendment
to the Measure K Expenditure Plan to utilize the remaining Measure
K programming capacities between all program categories.
BACKGROUND INFORMATION: The City received the attached letter from the San Joaquin Council
of Governments (SJCOG) notifying cities of the amendment to the
Measure K Expenditure Plan, which would allow the remaining
Measure K programming capacities to be used between all program categories. The Expenditure Plan
provides a process forjurisdictionsto disagree with any amendments to the Plan, and decision-making
bodies would have until May 11 to approve resolutions expressing its opposition.
Staff has reviewed the proposed amendment and has no objection to utilizing the remaining Measure K
programming capacities between all program categories. If the Council concurs, no further action is
needed.

San Joaquin County voters passed the Measure K Ordinance and Expenditure Plan in 1990.

The Measure K Ordinance establishes and implements a %-cent sales tax for transportation

purposes up to year 2011. The Ordinance provides for the implementation of the Expenditure
Ft)N
Plan that identities countywide transportation facility and service improvements to be delivered

over the 20 -year period. Because the Ordinance covers a period of 20 years, there is a provision

in both the Ordinance and Expenditure Plan that allows for the consideration of amendments to

the Ordinance and Expenditure Plan every fiscal year.
In January 2009 the San Joaquin Council of Governments (SJCOG) initiated a solicitation for
proposed amendments. At its March 26,2009 meeting, the SJCOG Board approved a Measure
K Expenditure Plan amendment to use the remaining Measure K programming capacities
between all program categories.
No amendments are proposed for the Measure K Ordinance.
According to the Expenditure Plan, in the event that a local jurisdiction does not agree with the
amendment, the jurisdiction's policy decision-making body must, by a majority vote, determine
to formally notify SJCOG of its intent, in writing via registered mail, to obtain an override of
the amendment. The appealing jurisdiction will have until May 11,2009 to obtain resolutions
supporting an override from a majority of the cities representing a majority of the population
residing within the incorporated areas of the county and the Board of Supervisors. If a
jurisdiction does not obtain the necessary resolutions supporting the override, the amendment
will stand.
