RECOMMENDED ACTION: Adopt a resolution accepting the improvements underthe "White Slough
Water Pollution Control Facility Phase 3 Improvements Year 2007
Project" contract and appropriating funds as shown below and receive
notification of project change orders.
BACKGROUND INFORMATION: The project was awarded to Western Water Constructors, Inc., of
Santa Rosa, on November 7, 2007, in the amount of $16,387,000.
The contract has been completed in substantial conformance with
the plans and specifications approved by City Council.
The project included the construction of an additional secondary clarifier, an additional digester, aeration
basins, headworks modifications, minor administration building modifications, and associated electrical,
mechanical, utility, site preparation and demolition work. The improvementsto the secondary process
were necessary to meet current and anticipated State of California regulatory requirements and improve
treatment process reliability.
The original contract completion date was March 15, 2009, and the actual completion date was
April 14, 2009. The extension in contract time was due to changes requested by the City. The final
contract price was $23,979,210. The difference between the original contract amount and the final
contract amount is due to 45 change orders. The following nine change orders have been approved by
the City Manager since the November 19, 2008 City Council meeting:
Change Order No. 37 includes replacement of sidewalks at Clarifier No. 2, relocating conduits at Aeration
Basin No. 2, replacing the scrubber platform deck and installing new flow meter piping ($14,049).
Change Order No. 38 includes replacing leaking digester pipes and valves, emergency replacement of
Domestic Drive No. 3, and installing primary launder covers and canopy at head works control panel
($53,189).
Change Order No. 39 includes mortar lining of the domestic outfall manhole nearest the head works and
video inspection of the installed 42 -inch domestic outfall and the 30 -inch industrial outfall lines between
Lower Sacramento Road and White Slough ($64,411).
Change Order No. 40 includes additional steel reinforcement at the pump station and mixer mast poles
for Sludge Lagoon No. 1 ($31,926).

Change Order No. 41 is for various site improvements including the Vacon washout, grading of the storm
water retention pond, paving and regrading of roadways around the sludge lagoons and adding valley
gutters for storm water runoff ($135,168).
Change Order No. 42 is for work related to the aeration basins, adding a slide gate at Sludge Lagoon
No. 1 and extended overhead for additional contract time due to City -requested changes ($38,075).
Change Order No. 43 is for rerouting existing pipe and conduits to permit the installation of the aeration
basin cut-throat flumes, cleaning and repairing aeration panels and site storm water grading ($94,253).
Change Order No. 44 is for adding HVAC systems to the electrical rooms as recommended by the design
engineers to protect heat -sensitive new equipment ($64,183).
Change Order No. 45 is for replacing aeration basin spray nozzles, placing fabric and rock at the storm
water retention pond slopes, replacing irrigation pump VFD's, adding SCADA control at the digesters and
credits for alternate RAS VFD's and unused SCADA funds ($88,236).
The total cost of these nine change orders is $583,490. The total of change orders for the project is
$7,592,210, including major items previously approved by City Council: domesticoutfall replacement
(Change Order No. 11 - $4,594,387), Sludge Lagoon No. 1 lining (Change Order No. 31 - $787,585), site
electrical grounding (Change Order No. 35 - $391,996) and VFD replacement (Change Order No. 36 -
$330,793).
Following acceptance by the City Council, as required by law, the City Engineer will file a Notice of
Completion with the County Recorder's office. The notice serves to notify vendors and subcontractors
that the project is complete and begins their 30 -day period to file a stop notice requiring the City to
withhold payments from the prime contractor in the event of a payment dispute.
FISCAL IMPACT: Funding is available from the unused 2007 Waste Water COP fund
balance.

APPROPRIATING ADDITIONAL FUNDS FOR THE PROJECT
WHEREAS, the project was awarded to Western Water Constructors, Inc., of
Santa Rosa, on November 7, 2007, in the amount of $16,387,000; and
WHEREAS, the contract has been completed in substantial conformance with the plans
and specifications approved by City Council; and
WHEREAS, the project included the construction of an additional secondary clarifier, an
additional digester, aeration basins, headworks modifications, minor administration building
modifications, and associated electrical, mechanical, utility, site preparation, and demolition
work. The improvements to the secondary process were necessary to meet current and
anticipated State of California regulatory requirements and improve treatment process reliability;
and
WHEREAS, due to contract change orders, which added unforeseen work to the
contract, additional funds are necessary.
NOW, THEREFORE, BE IT RESOLVED that the Lodi City Council does hereby accept
the improvements under the contract for the White Slough Water Pollution Control Facility
Phase 3 Improvements Year 2007 Project and directs the City Engineer to file a Notice of
Completion with the County Recorder's Office; and
BE IT FURTHER RESOLVED that the City Council does hereby appropriate additional
funds in the amount of $150,000 from the Waste Water Certificate of Purchase Account for this
project.
