AGENDA TITLE: Reintroduction of Ordinance No. 1548 to comply with
State law requiring the opportunity for public comment
before Council action on Agenda items.

RECOWENDED ACTION: Council considerrtion and possible reintroduction of
Ordinance No. 1548.
BACKGROUND: Ordinance 1548 was originally introduced at the Council
meeting of April 1, 1992, in order to comply with new
State legislation. Its purpose was to allow the
opportunity for public comment on any item before
Council action on the matter,
Concerns were expressed that under the new agenda format, persons arriving
just a few minutes late would entirely miss the chance to speak because the
new agenda slot for public comment came so near the beginning of meetings.
In order to address these concerns', the attached amended Ordinance 1548
allows two opportunities for public comment.
The first (Item "E") comes before adoption of the consent calendar, and
allows comes nt on any topic. The second (Item "H") would address comments
on non -agenda items, and appears where it did in the old format. This

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LODI
AMENDING SECTION 2.04.100 OF THE LODI MUNICIPAL CODE,
REGULATING THE ORDER OF BUSINESS FOR CITY COUNC U MEETINGS.

BE IT ORDAINED BY THE CIT`r COUNCIL OF THE CITY OF LODI AS FOLLOWS:
SECTION 1. Lodi Municipal Code Section 2.04.100 "Order of business --
Assembly of officers". is hereby amended to read as follows:
"At the hour set by this chapter or other ordinance on the
day of each regular meeting, the members of the council, the city
clerk, city manager and city attorney shall take their regular
stations in the council chambers and the business of the council
shall be taken up for consideration and disposition, in the
following order, except that with the unanimous consent of the
council, matters may be taken out of oro,�r and that the order of
business set forth in this section may be changed from time to
time by the adoption of an ordinance by the city council:
"A. Roll ca 11 ;
B. Invocation;
C. Pledge of allegiance;
D. Presentations:
1. Awards;
2. Proclamatio,3s;
E. Comments by thepublic;
Consent calendar;
G. Counts by city council members;
H. Comments by the public on non -agenda items;
T Public hearings;
J. Planninq cornu i s s i on ;
K. CornrRQnica}ions ( city cle� );
L. Regular calendar;
M. Ordinanccs,
N. Adjournment."
SECTION 2. All ordinances and parts of ordinances in conflict
are repealed insofar as such ccnflict may exist.
SECTION 3. This ordinance ,hall be published one time in the "Lodi
ews Sentinel", a daily new;Paper of general circulation printed and
published in the City of Lodi and shall be in force and take effect
