AGENDA TITLE: Resolution Urging the State of California to Halt the Practice of Enacting Unfunded State Mandates or to Provide Funding for Any Mandate it Enacts MEETING DATE: April 1. 1992 PREPARED BY: City Manager RFCOWERDED ACTION: That the City Council adopt Resolution No. 92-53 urging the State of California to halt the practice of enacting unfunded State mandates or to provide funding for any mandate it enacts. BACKGROUND INFORMATION: Mayor Pinkerton has requested that this item be placed on the agenda for City Council. If adopted, copies of the attached resolution (Exhibit A) will be sent to the appropriate elected officials. FUNDING: None required Respectfully submitted, Thomas A. Peterson City Manager TAP:br Attachment APPROVED TV40MA& A PETERSON — -- Crty Managers / CCC0M458f TXTA _ 0!A cc l IRT AI RESOLUTION NO. 92- A RESOLUTION OF THE CITY COUNCIL OF THE CSTY OF LODI URGING THE STATE OF CALIFORNIA TO HALT THE PRACTICE OF ENACTING UNFUNDED STATE MANDATES OR, IN THE ALTERNATIVE, TO PROVIDE STATE FUNDING FOR ANY MANDATES WHICH IT DOLS ENACT UHEREAS. the enactment of many state mandates have resulted in tremendous costs to the taxpayers of the City of Lodi; and WHEREAS, these state mandates in many instances deal with laudatory goals such as the disabled and clean water, but require expenditures by persons other than those enacting the mandate; and UHEREAS, this effectively is a preemption of local rights and results in a diversion of scarce financia? resources from existing services to other priorities enacted by the State of California. NOY, THEREFORE, BE IT RESOLVED by the City Council of the City of Lodi, California: SECTION 1: The City Council of the City of Lodi, California urges the State of California to halt the practice of enacting unfunded state mandates or, in the alternative. to provide state funding for any mandates which it does enact. SECTION 2: The City Clerk is hereby directed to send copies of this Resolution to the League of California Cities and to members of the State.
